Great.  A former employee using Bitcoinica-held customer information for personal communication is just what this clusterfuck needs now.

I'm sorry for those who think this email is redundant or useless.

I obtained the information from Bitcoinica to facilitate fund returns, as an independent individual (not employee). In my opinion updating customers from a personal perspective isn't spamming, and the emails are not unsolicited.

If you feel annoyed, simply unsubscribe and you won't hear from me again.

Maybe he will send someone to my PO Box to look for me. (And the mailman emails me every morning if there's anything in my PO Box, so I go there like once a week.)

But anyway, I don't want to cross the line here by providing more detailed identity information about him. At least he's doing a favour by returning the money. This will be the first ever Bitcoin-related hack that has the funds returned.

Out of curiosity: could you offer him this guarantee? Did you receive this guarantee from Bitcoinica? According to Tihan Seale, none of the board of the directors member was moving or talking, so whose decision was it?

Does this also mean that you do not intend to collaborate with the investigators should a legal action be started, and that you will withhold the identifiable information you possess about Chen Jianhai while you know that he committed the crime and did not return the whole stolen property (especially given today Bitcoin exchange rates) belonging to Bitcoinica creditors? Wouldn't that make you an accessory of the crime?

Obviously, I can't. But I sort of made up his mind for him. Even if police investigation has to take place, the punishment will be much less if he can return majority of the funds in a reasonable timeframe.

I believe that in any case I have no liability for offering him this guarantee, regardless of the outcome. I just want the money back, more than anything else. I have never said that I would not co-operate with any investigation.

EDIT:

For me, there's no trust or whatsoever with Chen Jianhai. In my previous dealing with him, all was about his experience in credit card fraud. I acted like sort of a journalist who paid some insiders to know truths.

A mature Libertarian knows that for his needs to be satisfied, he has to do good for others first. In a market, he improves the marginal utility for the counter-party so that the trade can happen mutually voluntarily.

They can only possibly say "got mine, f**k you" when they know they will die soon. Otherwise it's never good for his self-interest.

Can you tell me, why you see the need to monitor who is viewing this and clicking which links?


I use Campaign Monitor to send emails to 1,000+ recipients without being banned or categorized as spam. The email addresses were obtained with permission and the content is very close related to Bitcoinica.

I can't use Postmark to send the email with a script because this is not a transactional email. I can't use Gmail because they don't allow so many recipients. I don't want to send emails individually for obvious reasons. I don't want to send the emails with Postfix/sendmail because that will be result in false positives or IP ban (Amazon EC2 IPs are mostly tainted with spam already).

So the only choice is Campaign Monitor, which is very similar to MailChimp.

I'm not interested in tracking the opens or clicks. Campaign Monitor is just a tool to send emails in this case.

To my best knowledge the progress of fund recovery has nothing much to do with Bitcoinica fund returns. I spend most of my time waiting for Bitcoinica, bankers, lawyers and the hacker. So contributing irrelevant information doesn't slow down the fund returns to customers. Don't worry!

zhoutong may be thief or not, but those (AurumExchange) who fingered/accused zhoutong as thief, so far NOT done/doing anything legally & just watching how forum members get angry, shouting, scolding zhoutong.

The main issue is that this had been brought publicly on this very forum before by Zhou Tong himself, complaining his funds were stuck with AurumXchange.

In that kind of case, the only thing a company can do is to release a statement explaining what happened.


Without blaming anyone, I would like to suggest a better way to handle similar situations in the future:

Release about half of the information to the suspect privately, and give him 12 hours to explain himself. This way you can use his explanation to check against the other half of the evidence, to determine whether it's a made up story or plausible truth.

After 12 hours, post the full evidence alongside with the explanation in public. It also protects privacy and encourages the community to act in a neutral manner.

When you want to apply for AML Level 2 status, you can get their physical address easily on the website.

To end this speculation just skype right now with one of the forum respected members.  I just listened to that interview you had.  If this is really you, I do not doubt that your english is that proficient, and I would imagine you are proficient at many other things.  

To me, some of the interview seems "scripted."  Just my opinion.  Not that it matters, it could still be your voice.  And I do believe that could be your voice, the voice of a 17 year old.  But, since there is all the sudden this idea floating around, why not put it to rest?

I'm trying to do good and help people, but people don't give any merit to that.

To end the speculation now, Zhou Tong is fake and the guy behind it wants to help Bitcoinica customers to get their money back. Bitcoinica is just an illusional product that has never been built.

I think there was one question that you didn't answer from one of my earlier emails. You said you could recover 20k BTC and to date have recovered 15k BTC. Are you still able to recover the other 5k BTC?

Yes. I'm recovering the first 15k BTC to show "good faith" and "co-operation". The remaining will be recovered after all the fiat has been recovered. The fiat money is the most legally sensitive part of this deal, and it should have taken place before Bitcoin.

Hey asshole - send the remaining 25k BTC NOW.  We all know the fiat money is locked up until you identify yourself, and it's clear you are not going to do that.

I'm also trying to figure out if this mounts to extortion. So far, many of the statements from Zhou have been of extortion nature. Promising to have the funds released if no legal action is taken is a prime example. Its time to just send the funds Zhou. Too many people have suffered too long because of this fiasco.

Send to who? Send to satoshi? Send to Red Cross?

I'm trying to resolve this problem for Bitcoinica customers, not just for myself.

Send it Patrick Muirk as you sent the first 15k BTC. You could ague that you are waiting for bank account information for the fiat (which may or may not be true) but you can't argue that for the 5k BTC. We already know there is an address you can send that to.

To my best knowledge, he is holding this case at the moment to obtain instruction from Bitcoinica regarding a minor aspect of his representation.

You can email him personally to request that. He's very responsive and he acts in interest of Bitcoinica clients, and I have no problem of following his instructions. Just do that and I'll follow his instruction within reasonable timeframe.

There is solid evidence that the $5,000 was Bitcoinica's stolen properties, because the email and LR account matched the hacker's identity. The bank account was purchased from the black market though.

It is interesting that you consider the fact that the email matched the one used to perform the hack "solid evidence". The only solid evidence we have so far (as per your own admission) is that the email used to launder the proceedings of Bitcoinica was created by you, and was under your control, at least at some point in time. We also have an exchange order using that email requesting funds to be wired to a stolen chinese bank account purchased in the black market (as per your own admission). Do you follow? You still think we are not legally obligated to hold your funds?

We have sent you the address where to elevate claims, along with a request from KYC information, which we are well within our rights to request. We have also sent you our company address as well, contrary to your statements on this forum. You are refusing to provide KYC information under the basis that we are a "shady" company, completely ignoring the fact that we have no public track record of wrong doing, that we have been operating since 2007, and that you considered us trustworthy enough to make us funding partners in Bitcoinica AND to use us to exchange $40k USD on behalf of a friend.

In any case, this conversation is an exercise in futility. At this point we don't even know who you are because you continue to systematically refuse to provide KYC information. Feel free to sue me, or the company. No further statements from me regarding this issue.
