Dave, for your own protection right now I strongly suggest you hold onto copies of any information you hold related to BTCFPGA.  The whole CAN-ELECTRIC fraud is very likely a criminal offence and investigators are probably going to want to talk to everyone who was associated with BTCFPGA about what's transpired over the last few weeks and how that fraud came about.

All I can say is that this is Bitcoin. I don't believe it until I see six confirmations.

What is Tom's contact info? How can a person submit for a refund request now that you aren't helping? I'd really not like to have to escalate this matter if possible.

Almost a month since the refund was requested. I didn't get the email requesting the return btc address either; however I did send this unprompted along with the refund request. No sign of a refund for the shipping upgrade either.

By the by Dave, how many of the BTC orders actually got refunded? I requested my refunds on the 15th of June (the day I heard about it) and the only contact I've had was from yourself a couple of weeks ago saying that I'd get my refund within 48 hours  Wink

You're not going to have enough people for a class action, for a start.  There are already people looking into what civil law remedies might be available but you need to bear in mind that you can't get blood from a stone.  The fact that you can sue someone doesn't mean that you'll recover anything by doing so.

All I can say is that this is Bitcoin. I don't believe it until I see six confirmations.

Unless a Court has something to say about it.. If legal recourse is founded, a Judge could order Tom to pay it all back plus time behind bars.

There's little doubt that Tom would be ordered to refund people - that doesn't mean people would actually get refunded, though.  Ask the people still waiting to be refunded by Bruce Wagner from the Bold Funding scam how effective court orders are when someone doesn't have substantial assets which can be seized to satisfy a judgement. 

Criminal action increases the likelihood of Tom being punished in some way if intention to defraud (and associated offences) can be proven, but it doesn't necessarily make it more likely that people will receive what they are owed. 




All I can say is that this is Bitcoin. I don't believe it until I see six confirmations.

  My fingers clearly not on the pulse, i was under the impression that they were going to release the bASIC under new management until today. Had it been under new management i would of waited for the bASIC to be released, this clearly changes things.

   How are you guys asking for refunds, direct contact with Tom/Dave or through CC companies?

   My order number: 1254
   Date order placed: 8/10/12
   Outstanding refund for bASIC $1099

   Just emailed Tom and Dave to see whats going on, as in btcFPGA forum, Dave said all CC refunds had been processed as end January.

   Dave if you see this any update would be much appreciated, before i contact CC company about refund.

  UPDATE: Spoken with Bank and refund received. Thanks Dave.

    So seems i'm also a little paranoid, Avalon address is listed as Albany NY and btcFPGA, people should be avoiding were only couple of hundred KMs away in Hannibal, NY.

That's an average of about 18 orders per day. Assuming the average order was for $1,000?... holy crud, do the math.. that's a cool million right there!!

Anyone know when bASIC orders began?
And can I assume people were ordering up until January 2013?

Contact your CC company immediately and start a chargeback for fraud.  I mean how much warning signs do you need?  Wait and there is a good chance you will never get a single penny.

The numbers are deceptive as in November or December the orders moved from http://btcfpga.com to http://bitcoinasic.com

The counter was probably bumped to a new virtual zero (2000?) at that point

my bASIC order was #299 and that was the old system. I was around the 20th person to order a bASIC, so those order numbers are
mixed in with older fpga only orders.

There I fixed my signature.

The signature was from that awful contest that bASIC ran.  I had to post everyday for weeks to be eligible.  Nothing I said was worth reading.  The burden of that contest is worth another $1000 lost.
