JohnK isn't the problem, he's done everything in his power to contact Avalon for the refund. The problem is primarily Avalon's lack of a response.

and yet some are holding on to getting 2nd gen from these clowns...  I like the idea too, since they say all these DIY boards will work with them but can Avalon first create a customer service team?

They would only need a team for about 3 months

There's no refund to the Group's address until now. There's a very high probability that the chips are shipped already.

Guess we'll have to send them back, then. We are clearly entitled to a refund.

Who will send them back while the group buy manager is missing

If we send them back, you can expect to never have anything in the end.

JohnK isn't the problem, he's done everything in his power to contact Avalon for the refund. The problem is primarily Avalon's lack of a response.

Bullshit. He disappeared for a couple of weeks when we were trying to contact him to request this thing. I don't think he's ENTIRELY to blame, but the guy who's REALLY to blame isn't getting compensated one bit. JohnK got his escrow fees, and part of that agreement was to facilitate our recourse if things went sour.

It's like an insurance company saying, "It's not OUR fault you wrecked your car." True, but there's a reason I send them a check every month, and it's not because I like their commercials.

There's a reason we paid JohnK a percentage of this deal, and it's not just because we like him. It's because we expected results, in the event that things went sour. Things did go sour, and JohnK left us wanting for anything remotely resembling results.

Again, I don't blame him for everything else leading up to this clusterfuck. I only blame him for his lack of professionalism and presence in these forums when it came time for him to 'pay the piper' and perform the duties we had paid him for.

So I ask again, what the fuck does JohnK believe is the purpose of the 'service' he's providing?

Quote
The escrow holder, John, assumes and gives no liability or guarantees on the satisfaction of all parties involved, although he agrees to mediate and facilitate the deal to the fullest extent he is capable of.

If the results we've seen from JohnK represent the "fullest extent" of his capabilities, he needs to find another line of work.

I sold my chips a while back, but have been watching this thread. I think RagingAZN needs to be tagged as a scammer at this point. Honestly, I think he should be under criminal investigation for investment fraud.

Has he stolen any chips, or just been extremely unresponsive on the forum? Personally I think as long as he delivers the chips to the rightful owners once they arrive, the scammer tag is probably not warranted.

People might have strong views on his trust rating from their individual perspectives, but I think that's different from definitive fraud / outright scamming.

JohnK - what is the interplay between the escrow system and the scammer tag? Clearly ragin is not fit to run another group buy, so that should be made clear to any potential particpants somehow? What would be the appropriate course of action at this stage?

BTW, if we have indeed failed to cancel our order, by the time these chips are delivered by Avalon, they won't be worth much more than the shipping cost to anyone.

JohnK supposedly filed for a refund a week or so prior to the latest round of shipping chips took place.

I have little reason (so far) to doubt JohnK. So far.

Is Yifu so inept that he couldn't be bothered with processing the refunds in queue instead of shipping out those orders?

I would not put it past him.

BUT,

JohnK is up BTC15 for being the escrow for the Group Buy.

I think that his reputation might suffer if he doesn't at the very least come to this thread and either offer suggestions or request them on our potential courses of action.

Sure, I don't think Yifu or Ragingazn's issues are the fault of JohnK.
But, did he not accept some risk when he accepted our bitcoins?

Issue here is Avalon / BitSynCom / Yifu. JohnK reputation should and will remain pristine as a result of this Group Buy. He has and will do what is required for the group and have gone well above the required services he was first asked to provide. At this point this group buy is suffering from Avalon Flu. Symptoms include slow response to stimuli especially emails and phone calls. Suggested remedy is a lawsuit enema.

Sorry, I disagree. As I said before, when it came time to actually EARN his escrow fees by anteing up the service that we paid him for in advance, all we got was crickets. Roll Eyes

Can we at least get an update from John K. about whether the shipping status on Avalon's site has changed?

Well, it looks like it's finally over. This morning, Avalon did a bunch of refunds. This group buy was one of them: https://blockchain.info/tx/730e45ef0d59847973bb9e80e6e05c014787e5c91b01094647a39d7a5ab76199.

Excellent news! Hopefully John can get our individual refunds sorted and processed soon.

Whew!

I vote we do a refund process similar to steamboat, where we sign a message with the bitcoin address we'd like the refund sent to.
