Hello, I am a lawyer (Malaysia and Australia) and I have been asked by clients to consider whether it is better to buy on an exchange or a tender to obtain some BTC (ie parcels of min 500 BTC and above).  I have chosen MtGox as an example.   

I have advised my client to do the tender method (ie find a seller and negotiate directly) and to formalise this by contract. I have made this decision based on my observation below which I hope will assist others. If I have improperly posted this, is because I cant post it elsewhere.

1. I do not know much about the company other than from wikipedia where its reliability is untested. In any event, it says that MtGox is operated by Tinbanne Co which itself has a capital of 5,000,000 (Yen) or roughly USD 47K. The latest address is stated as Cross Office Shibuya Medio, 11-5 Shibuya 2-Chome, Shibuya-ku , Tokyo , 150-0002 Japan and MtGox's  is at Sarugaokacho 26-1, Shibuya-ku, Tokyo, Japan. There are no details about ownership or operation of MtGox on Tinbanne website.

2. The terms of service make interesting reading (https://www.mtgox.com/terms_of_service). Firstly no mention of what law is applicable, I assume this will be Japanese law, notoriously expensive to enforce if you are not based in Japan and note that the law applicable is civil law not common law. The difference between the two may not be obvious but in civil law, the judge interpret the law first and decide without the need to follow precedents set by Higher Courts. Without precedents, there will be uncertainties. I know this as I have done litigation in Mongolia which is also a civil jurisdiction.

3. Under liability clause it says "Subject to the foregoing, Mt. Gox's aggregate liability in respect of claims based on events arising out of or in connection with a Member's use of the Site and/or Platform, whether in contract or tort (including negligence) or otherwise, shall in no circumstances exceed the greater of either (a) the total amount held on Account for the Member making a claim less any amount of Commission that may be due and payable in respect of such Account; or (b) 125% of the amount of the Transaction(s) that are the subject of the claim less any amount of Commission that may be due and payable in respect of such Transaction(s)." This is great if the Coy can actually pay. One can actually calculate the profitability as seen by the volume traded. I leave this for you to do.

4. There is a lawsuit against MtGox but no mention of this anywhere on its website (well thats because is not a public coy).While the suit claims that jurisdiction is proper, I doubt so as it is common to say the best avenue is where the alleged damages happened which in this case in Japan. http://www.scribd.com/doc/139160091/Coinlab-v-Mt-Gox

Anyway, the above is my thoughts. I am preparing the sale and purchase agreement and the tender document. This may not be available immediately so will announce later. Those who are interested will need to read both documents and get legal advice. Will be interesting to hear from other lawyers who have done BTC transactions for clients.

For automatic scripts also delivers blockr.io API access.

Users can use address bookmarks for fast access to their addresses and are able to see their balances on each account. Interesting transactions and blocks can also be bookmarked, twitted or posted to Facebook. There is no user data saved on server, all bookmarks are localy stored on user's computer in localstorage.

Becouse Blockr.io block explorer is primarely community oriented, allows users to send comments about blocks, transactions or addresses they want Blockr to examine.

Although I do not have a business that deals with bitcoin, I think it is really important everyone was trying to promote bitcoin transactions to also promote a method which I think is effective means of trading in bitcoin during this investment heavy time. If you keep a certain amount of US dollars or any other fiat currency in the pool in your trading account, when you make a bitcoin purchase immediately purchase the same amount of bitcoin by using your pool of fiat currency. This way you promote bitcoin transactions, while also not spending for example 1 bitcoin (700 USD) on an item which then due to the rapidly increasing value of bitcoin overtime ends up costing many times the amount (i.e. 1 bitcoin = 10,000USD in 2015). This gives us the best both both worlds since it is so important that businesses promote transactions.
