They will handle all aspects of suing Alpha, all paperwork and court hearing, without any involvement from you being necessary, for a reasonable flat-fee. The fee that was paid to them has been recovered on other cases, as well they argued that Alpha should pay 8% annual interest on the money they refused to refund, which the court found in favor of. On my sliding scale based admittedly on nothing but my own opinion and observation of this and other similar situations, the odds of bankruptcy are far greater than that of delivery of anything at this point. there hasn't been a substantive update in months that I recall and they seem to be getting their ass handed to them in court. line forms to the left to sue. run, don't walk. no pushing.....

We plan to email all customers as soon as we have the shipping date but we are hesitant to estimate at one at this time. We are still in the final stages and are currently tweaking the devices to try to get the most efficiency out of them so if everything goes as planned than it shouldn't be much longer. We are working not only to deliver the product our customers have ordered but we also feel it necessary to do our best to improve it. As long as people allow folks like this to steal from them, they'll continue doing it. They closed up physical shop for a reason, to prevent people from seeking them out.

Translation: LOL Marttijn, This has been a windfall for us. First we got all of you to fund our research efforts. We actually have had many working miners hashing away for a few months now. We are currently in the process of having the miners cleaned by a professional computer cleaning crew so as to look unused. Once we finish here we will hold the miners a little longer, just to make sure they are completely worthless. The last thing we would want is customers taking delivery of their miners. Currently we are planning our exodus from England where we will be reunited with our Family in India. Thanks for the plane fare, Grandmas retirement (and ours), etc. We will continue to "offer" refunds when the law requires it. Has anyone been able to enforce payment on their judgments? I have only heard one or two stories of people who managed to corner them and get them to cough up some money, but nothing very substantial. They owe so much money and are so slimy, I am suspicious that they have moved money out of reach by now...and I'm skeptical that a winding up petition will yield anything through liquidation, because I suspect they have outsourced pretty much everything and that the company has no real assets to liquidate. I'd like to go to Manchester and give them a piece of my mind, though.

Hello all, Came to this thread by accident. I've not read through it all but what I have read makes me very angry, so I'd just like to introduced you to a little known legal tool in the UK called a 'Statutory Demand' which is way of demanding payment of monies owed to you by a company, whether it's an individual or a limited company (US corporation), This is the government website link: https://www.gov.uk/statutory-demands/overviewIt was really designed as a way of one company forcing a debtor to pay up, it's not used an awful lot and almost never by individuals, but that doesn't mean that individuals can't use it. It doesn't cost anything except the cost of registered or recorded delivery post to 'serve' it on the company in question. Now here's the killer: Even if your claim may rest on soemwhat shaky ground in terms of Alpha's T's & C's, you can still put in your claim and: LEGALLY THEY MUST RESPOND TO YOUR CLAIM WITHIN 21 DAYS. IF THEY DON'T THEN YOU CAN ENTER A PETITION TO WIND UP (LIQUIDATE) THEIR COMPANY Now one person doing it will just be a nuisance to them, but 100? or 1000? They don't have the option to ignore any one of you, because you might be the one that petitions for liquidation! This is not in any way similar to a small claims action, that takes place in a court before a judge (or sheriff in Scotland) and each claimant has to pay court fees to lodge their claim. 'Class action' cases' are difficult to bring before UK courts. The key here is mass action, one individual demand won't cut it. I'm pretty sure that there will be some of you that live in the UK to coordinate this if you go down this road. What might be advantageous to you all is to write (NOT EMAIL) to Alpha and demand your money back (on the basis that you haven't got the product or refund you were promised) giving the 7 days to do so. It can be 'served' by recorded delivery post, about £1.80 in the UK. They will likely ignore you or send out a standard letter, it doesn't really matter what they say, your DEMAND is what they ultimately have to answer, the 7 day letter merely reinforces your Statutory Demand. This is not driven by consumer law, that's why it's so sneaky! If nothing else it will force them to do something. Everyone's claim will be different so they won't be able to get away with a standard letter, there is too much risk that a court will accept a petition for liquidation if they do this. If they get liquidated yes, you may lose your money bus as a creditor you have rights and that includes forcing the liquidator to bring the company directors to account, and perhaps even asking for criminal action to be taken against them if they have behaved fraudulently. It does happen regularly, believe it or not. Hope you all get a result of some kind! I'm not familiar with all that's gone before here but I think this is worth looking into. If Alpha's people are reading this then they might want to consider telling you the truth about what they've done with your money and try to find a resolution. Directors have statutory duties in the UK to protect monies they are given either as investment or payment for goods, They can be jailed if it's found that they did not exercise due care in protecting those monies and spent them on their personal enrichment. Think on.

anyway...I got refunded...thru cc and amex in sept 2014 if i remember right...the process was i put in a dispute to Amex (talk to an actual person on this) They made a complaint (wrote it all down including web pages/bitcointalk pages and their own no refund policy on pre-orders) ........
then alpha has 30 days to reply..on the 29th day alpha sent them a pdf of my bill saying the item was paid in full (this was the 30% down thing I paid for the 50mh miner).pretty much saying it was NOT pre-order and item was paid in full ie implied it was delivered ..hoping i'd let it drop i guess on the dispute loss...so AMEX then refused my dispute (only found out cause I called amex again)...they sent me the .pdf they sent and I was like wtf i never paid for the whole thing and no i did not get it...
so ...back to square one
called amex again...got a hold of someone with web access (supervisor) told the whole story with web links to alpha and the scam.....took like 30 min (i think the amex rep was thrilled..much more fun then telling folk their balance)....had a NEW dispute written up.....and flag'd do fraud...every bell/whistle and stupid we will not give you $$$ back on the alpha web page
because of comments and links and such .....the fraud dept probably looked at all the stuff the amex rep put down and EVEN THOUGH IT WAS PAST 45 DAYS for my Amex dispute stuff....or whatever the time line was (maybe 60 days) ie a couple months past...AMEX got ALPHA TO REFUND (from the fraud dept guy's point of view all the research was in the comment thread of the dispute and easy resolution their part of the problems cut/dried imho .... not a mean trick..not sure ...but I THINK they contacted alpha's bank directly that was collecting funds yet ...for the last 70%.......and
Amex was not very pleased to see alpha take 30% down and not deliver and then turn around and say pay the other 70% and we might deliver anything and keep your 30%
anyway ..amex would not comment on how they got alpha to pay ..but that is likely how they did so with the bank at the time in place to take the last 70% funds from folk via wire xfer....so i think amex used the bank to get the funds back to m....and if i remember right that did not last long either I think the bank pulled the plug on that as well from complaints
so get amex they are brutal on chasing back your $$$ on anything online.....so anyway thats the catch ....if alpha has no assets to track and contact like the bank...hard to get the $$ back or impossible...and no doubt it has been too long for any cc options now...a lot of work to get my ..i think it was 700 bucks or some such back for my 30% down on their smallest unit
anyway ....i think it went down somewhat along the above lines..so i may have gotten really lucky they had a bank involved to track from their taking the last 70% at that time via wire xfer..

Amex will eat the losses in some cases, this I'm sure. They do not like to use their own money to refund customers, but if all else fails it is an option. For some reason i think that Amex ate the loss, I seriously doubt Alpha Sprouts Tech has any funds sitting anywhere. They are accountants after all, or are they just as bad at that as they were with this latest scheme. Wouldn't surprise me if they were.
I did have a post deleted from this thread a while back. I was mocking their announcements and my post got deleted within 24 hours. Since then I have lost interest in this scam. They may have moderator power here, which reflects horribly for this B.B.

Wow people forget about your losses and move on i know its hard but your not going to get anything back,this was a scam from day 1.I am a miner who lives in Manchester and almost ordered a miner from Alpha, but after a visit to there shop in a shit part of Manchester and chats to people around Manchester who knew of the brothers, i knew it was a scam, i did a load of research and told you all and my friends in Manchester to spread the word but all i got off the crypto community was a load of abuse.eveyone was blind because all you could think about was how much cash you could earn,im sorry to say your cash will have long gone,And i have to say what a great scam it was,oh and by the way from day 1 the brothers were no where to been found in Manchestr,so i would imagine they are living it up on a beach somewhere with a shit load of money.i really do feel for you all.best of luck whatever avenue you all go down.

I am asking if anyone was refunded FINAL PAYMENT - should have been specific. I know that people are getting their pre-order payments back, I did too...even though I asked for a lot more than that. They just reversed the PayPal payments and considered the matter closed...keeping the remaining (and much larger) final payment amount.
So I'm wondering if people have managed to enforce judgment on the refund of their final payments, as well. I have seen stories of people getting judgments, but not much in the way of people saying they'd successfully enforced them, when it comes to final payments.
For my part, as slimy as these guys are, I'm skeptical that the money is even there anymore. They've had two family members leave the company since it started and it looks like it's down to one guy, now. They've outsourced pretty much everything. So even if a winding up petition were entered...I kinda doubt there are any real assets to liquidate. Alpha-T is pure fraud.
