Claimed to all of us that there product can overclock to 230 GH/s. This product cannot be overclock to 230 GH/s. Therefore the orders we placed are not as described according to the UK Trading Standard.

If MiningHardware.co.uk or Tech Clinic LTD fail to return a full refund including the shipping it cost me to send back to them.

My lawyer will be dealing with my case, as he already looked at the whole case. And we will be taking MiningHardware.co.uk or Tech Clinic LTD to the civil court.

If anyone else is not happy that the miner they purchase from them are not as described, you can ask for a full refund. Because this miner supposed to be able to overclock to 230 GH/s. Which we all know this doesn't go anywhere near 200 GH/s.

You have stated in numerous occasions that your firmware can get it to 260, now if you have been running at that and it has damaged the machine, then tell me why you should get your money back when the T&C's state the machine should not be overclocked and it has been mentioned on this forum about not overclocking the machine.

If He fail to refund, all of you are welcome to join me for a group lawsuit against Tech Clinic LTD - Mining Hardware .co.uk. Which my lawyer already said all other people are welcome. As he has already taken up my case.

Make your mind up you have stated you where getting 260GH out of it, now you saying it does not reach 200GH, Well Mine does I am getting 210 on each when frequency is 1300 so if I overclock it (which I am not going to do) it should reach nearly 230 (Give or take 10% as mentioned on their website)

Just reading through these forums, I have noticed your posts and you removed the fans and put new ones in (a few days after getting them). Then the machine stopped working so you had to turn it off and wait for it to cool down for it to work again. Then later on in this discussion you posted two screen shots of it working, one frequency at 1300 and another at 1500 which clearly shows your machine working so what seems to be the problem.  Huh

You have stated on this discussion on numerous occasions your machines work and you have improved them by upgrading the software and some hardware (fans) and getting them running better then most which is why people have been asking your advice, by the sounds of it and reading the post you have made; it is something you have done to the machines and not a problem with the issued product, (which was not working at first but was working fully once the problem was rectified as stated in your post running at 254GH/s).

I would suggest you get your solicitor to read what you have posted before you make anymore comments.

I have consult my lawyer. and I am advised to report your company to the trading standard if you fail to comply. Also I want the refund as bitcoin.

I will send you a formal letter later, detailing the regulatory requirements which you must comply. As your term and conditions of your business does not comply to the UK trading standard.

You told me the fault on one of the units which we agreed to swap when UK stock arrives but nothing on the other?  Not even a telephone call?  And the first thing you do is threaten and demand your money back?  I'm shocked.  Call me.  You have our number and launch a complaint properly please so its dealt with in the correct manner.

Therefore this item was sold to me not as described. Also the second miner is faulty, and can't even hash at all. I also see that this is not as described. Therefore I also want the refund for this one. I want payment back using bitcoin. I am letting you off, for the waste time I could have had if they are up to the desciption.

When did I stated I got 260GH out of it? While the miner was booting up? It doesn't stablise, it just keep reducing the hash rate to under 200 GH. Prove that you can overclock it to 230. Yes as it was mentioned on their website, give more take. But this is why my miners received was not as described.

The machine doesn't work as descibed on the website that is the problem. 254GH can't be overclocked with the standard built machine. I had to do some crazy hacking to get to that. That also can't be done by the standard software and hardware which comes with the box.

My solicitor had already spent 2 hours in a meeting with me, and they had seen this website. And all the things I have posted. And they are happy to take on this case, if MiningHardware refused to refund me according to the regulations of trading standard.

I look at it like this, I buy a car which claims that it can reach top speed from 200 - 230 mph. I saw this advertised, and I ordered it online.

The car arrived, I can only get to the top speed of 198 mph, so I contacted the seller and ask how you can get to 230 mph, Then the seller told me, if you change that number from 1300 - 1600, you will be able to get to 230 mph, I tried again, with the 1600 setting, which actually doesn't get to that speed. It was actually slower than 160 mph. Now what this car sold as it was described? NO OF COURSE NOT.

I can go to the trading standard and complaint to them. I can also contact the ASA to complaining the false advertising.

Kenshin,  this is now the final time I will reply to your slander and threats.  I think all members of this thread have had enough of you.  Let me make this simple:

A:  no one asked you to do anything.  No one asked you to open the unit and change the fans the very first day you got it?  I did not give you permission to firmware upgrade? I did not give you permission to overclock.  If a customer asks me on how to overclock, I will answer BUT I will follow by saying "THIS WILL VOID YOUR WARRANTY".  I remember telling you this but your answer was:  I DON'T CARE. More importantly, when did I tell you this?  In-fact, don't answer unless you can prove it.  I clearly can't remember telling you in writing to overclock and it won't break your warranty.

Do you see where it says +/- 10%.  It means the figure is estimated @ plus or minus 10% which is 207.  READDDDD

C:  why didn't you call me with your concerns or try and contact me regarding and expectation of 230GH/s?  You have my number too?  You could have easily expressed your concern via the correct channels?  I'm not a nasty guy and you pleasantly told everyone here that you appreciated me spending an hour with you via teamviwer weeks ago.  If you approached me with your over clock concern, I would have happily spoke to you.

Finally.  Your attempt of mining bitcoin then trying to offload will not work with your trading standards and law threat.  Terms and conditions were very carefully written and clear.  Any solicitor or trading standards who will have read it would have told you to read and absorb.  Throwing demands like that just doesn't work.
We all know what you did to your miners by telling us all how you customized the units.  How your firmware is custom etc etc.  Kenshin, quite simply, you have voided your warranty a long time ago.  And before you try and delete all your posts; its too late, I already made a copy a few days ago of everything on this thread and I believe the admins will also help to gain any communications if required.













So, I now recommend getting some proper advise to whom ever you need.  The law is also there to protect me from guys like you.  And yes, I understand law very well as we also own a law firm in the family business.
I will now ignore you on this thread and ask that you communicate by the correct channels if you do not agree to your warranty being broken.  If you continue to harass then I WILL pursue further action.

Once again, pickup the phone and call me if you want to express your concerns and options.  That is not hard!!!

I know who has been deleting posts, and it is tampering with evidence in what could be a prosecution/claim.

Yeh, just been through a couple of pages and some of the post's which are missing are the main pages with comments on and it sticks out like a sour thumb that someone has tried to cover their tracks (unsuccessfully).

If a prosecution/claim is made then those people involved would be made to pay big style and as there is no legal aid for this type of thing now I hope they have deep pockets, but removing items shows that they have something to hide !!!

If it has been done once taken legal advice (which I doubt because you are trying to alter the facts) then it has just blown their case out of the water, because they do not understand how a forum works

NineLives, voiding the warranty, and asking for the refund for the miner which was not sold as described is not the same thing. I never threaten you, I am just letting you know what I am going to do.

Also what laws are involves, the Weights and Measures Act 1985, the Consumer Protection Act 1987, the Trade Descriptions Act 1968 and the Consumer Credit Act 1974.

I have been looking through this discussion and noticed a lot of your post's have been removed (I can supply you the complete pages without alterations if needed) which state what you have done to the unit(s) to void the warranty, if you do not have it in writing from the supplier that it is fine for you to alter the product then you may have a problem.

Taking you other post about the car, if you bought a car which stated it could do 54 mile to the gallon and your only getting 50 do you take it back? NO, because the figures they quote are an average. You then alter the engine to try to get the 54 stated but the car will not work, does the car dealer take the car back even though you have messed with the engine and made it common knowledge you have messed with the engine. NO.

I suggest you either :-
1. Talk to Ninelives and see what they are able to do for you (if anything)
2. Stop crying about it and get on with your life.

NineLives has the patience of a saint, I'd have told Kenshin to do one, I doubt his lawyer threats are anything more than hot air, anybody dealing with legal action goes about it like a regular civilized human being, not spouting nonsense and trying to clean up their admissions on a forum.

Careful he will probably accuse you of been NineLives lover, or NineLives on another account, If I could see holes in Kenshin evidence then a qualified solicitor will rip him it to bits, and since he has removed a lot of his posts stating what he has done then he has just shot himself in the foot.
