October 2020.  In the meantime is anyone going to write him a letter and ask for their bitcoin back?  I think it might be entertaining to write him and see what he says?  Not sure what questions to propose in my first letter.

I've been in contact with the Lawyer responsible for the refund: sent him the papers she hasn't replied since October 2018.
You mean the victim representative?  I didn't see the email in October 2018 and by then it was too late to make a claim as a victim.  Oh well, he isn't going to pay any of it back anyways.  It is odd that they put a person in prison for 2 years, but you only have a few weeks to make a claim.  I'm still getting victim notifications, so you would think they would still pay any recovered money.  I was joking, but not really, but a bitcoin now is worth a lot more than what was stolen.  I still think he has a secret wallet somewhere.

He is enjoying life at Club Fed!  2113 NORTH HWY 175

In Texas: that is the right place for him.

Out in 15 months I think.

Garza v. Audet is getting pretty hilarious.  Anyone keeping on top of it?  https://www.docketbird.com/court-cases/Audet-et-al-v-Garza-et-al/ctd-3:2016-cv-00940

I like this one in particular.  https://www.docketbird.com/court-documents/Audet-et-al-v-Garza-et-al/Exhibit-10-Decl-of-T-Donelan/ctd-3:2016-cv-00940-00140-011

There's a shit ton of new documents on Pacer.  About 300 pages worth.  Looks like they are taking a random sample of losses from various individuals.

What are the questions?

So where is this fucker?

Does anyone know?
Write him a letter and ask him?  Could call the Federal Marshal and ask too.  They have custody of him.

I can post the document later, but they spent an hour and five minutes filling out a form to certify the class action possibly.  For some reason the box isn't checked that grants the certification of the class.  They checked the box for advisement.  I'm guessing they are still arguing who the class is exactly.

Sometimes I forget.  April 12th is coming up.

NOTICE: On January 25, 2019, the Court issued an order setting a hearing on the96 motion to certify class and the108 motion to exclude declarations for April 12, 2019 at 10am. At this juncture, the Court will not determine before the hearing whether an additional evidentiary hearing is required. Rather, at the April 12th hearing, the parties should be prepared to discuss the96 &108 motions and address whether an evidentiary hearing is needed. If the Court determines that an evidentiary hearing is required after hearing from the parties, it shall make itself available for seven hours on one of the following dates: April 26 at 10am, April 30 at 10am, or May 3 at 10am. At the April 12th hearing, the parties should be prepared to advise the Court about their availability for an evidentiary hearing on these dates. Signed by Judge Michael P. Shea on 3/15/2019. BOP inmate locator still says Homero is not in custody but I'm just gonna assume he's being punted around various facilities and not settled in yet. Which is probably great, meeting new people and all...

Its down tonight, but after clicking around on their not very intuitive website I got the same information that I got off the victims website that he is indeed in transit.  Its one of the links after you click on his name.

Awesome... so let's say if I want to visit him...

People will continue to do these crimes because off the lenient sentencing.  Serving a few years isn't an issue when you get millions of dollars from actions.  The risk vs reward is worth it because white collar crime just doesn't get punished.
I still stand firmly and say that he probably has a bitcoin wallet stashed somewhere.  Anyone in his family could do local bitcoins and cash that secret wallet out for cash.  How is he starting a new business without the support of Uncle Stu?

Dropping in to say thank you to everyone that helped put Garza away for his scamming and stealing!
It was mostly Shinners that ensured his conviction.  Strange we don't hear much from the guy.  He was the only one in court I believe also.

Great news that he's being shuffled from one jail pit to another instead of ticking off days playing mini golf.

Here's an oddly timed piece: (5 months later)
Cryptocurrency Fraudster Sentenced

Good to know that our F B I is totally on top of this, LOL.

I spoke to Munster the FBI investigator when I registered for the victims list.  This is the first article where I have seen him interviewed.  He was just your typical douche bag cop.  I mentioned the real kingpin in all of this was Stuart Fraser.  He acted like he had never heard of him and didn't have much to say, but I'm sure he isn't as dumb as he played with me on the phone.

Thanks truckin, well that's relativity good news  Grin "BOP - in prolonged transit" appears to a a real thing and fairly common.  As suggested he's in between facilities and still holed up in county or other for now. According to prison talk chatter out there people can be stuck in this position for up to 7 weeks from sentencing.  The even better news is that Homero's actual sentence does not start until his safely locked up and registered in a Federal facility. He can remain in limbo in a country lock up, or some sort transition house for however long and it does not count as part of his sentence. Federal Crime, Federal sentencing, Federal prison time. Clock only starts ticking once actually incarcerated in the Federal jail. Absolutely must make it even more trying for the loser. Apparently its a huge big deal for others that their pathetic loved ones are suffering so unnecessarily boo hoo Roll Eyes

Let's wait another month and hope his foul rotten name finally shows up where it belongs...

I called the inmate locator number and the guy told me that "not in BOP custody" means that he's in BOP custody, but under the control of the Marshall's service.  He said I could call them to find specifics, but I didn't.  He told me that they move them in groups from contract jails so he could be anywhere.
