It sounds to me like GLBSE has decided to hand the user funds (both what Theymos and Nefario hold) over to ColdHardMetal, who is to (reluctantly) manage their distribution to the claimants.  Is this correct, GLBSE ppl?

I don't think Nefario agreed to send BTC to CHM.
4502  Economy / Scam Accusations / Re: Nefario on: October 09, 2012, 07:44:49 PM
My understanding is based upon the most recent email from the secretary.

The motion was:

Code:
[05/10/2012 18:32:35] <nefario> I propose a motion to have theymos return the user BTC which has in his posstion for the purpose of allowing me to repay users

So I sent CHM only the amount of BTC designated as user funds. I still hold the operating funds.

Here are the results so far.

Voting ends Oct. 15.
4504  Other / Meta / Re: Who or What owns bitcointalk.org? on: October 09, 2012, 01:45:01 PM
Sirius founded the forum and still owns the domain name, so I would say that he owns it.
4505  Economy / Scam Accusations / Re: Nefario on: October 09, 2012, 01:32:03 PM
Theymos has already admitted he would be perusing the argument that the illegal business should continue.  Nefario had no obligation to continue to break the law while convincing his compatriots to come clean.   In fact he had a responsibility to stop what he was doing when he realized it was not legal.

Laws don't give you the moral right to break an agreement, even if they might give you the legal right.

If Nefario was worried, he should have just resigned.

Disallow Scams and Ponzi Schemes in the Forum rules

OK: All scams are hereby disallowed by the forum rules. I trust that all forum users will respect this rule and refrain from scamming in the future. Wink

I'd rather let hundreds of scam threads exist than remove one non-scam thread by accident. Maybe someone will figure out how to legitimately pay 7% interest weekly someday; who knows? It's not the place of moderators to decide which products/investments are good and which are bad. Buyers must decide for themselves who to trust.

Here's an example of someone new who didn't understand what a scammer tag meant and sent coins to a now-outed scam service where the operator has run:

If he doesn't notice a scammer tag then he's not going to notice that the thread is in a scammer section. Making scammers' posts stand out more will just give them the power to annoy people with their bright posts, and it will discourage them from being constructive forum members (as a few scammers have been). And someone that careless is eventually going to get scammed anyway.
4507  Economy / Scam Accusations / Re: Nefario on: October 08, 2012, 12:17:35 PM
I've decided Nefario will get a scammer tag for this.

Thank you.

Are those timestamps "may 10th" or "october 5th" ... around these parts, it looks like "may 10th" (and you didn't specify elsewhere in the post)

October. My IRC client does use a strange date format. Slashes usually indicate American format.
4509  Other / Off-topic / Re: Should bitcointalk exist? on: October 08, 2012, 02:14:50 AM
A forum with free speech is very valuable to Bitcoin. Free speech allows people to determine the truth through discussion without moderator interference. If you prefer to not use a free-speech forum, you can go elsewhere.

I'm not too concerned about what potential Bitcoin users think.

what country besides the underworld of satin would accept bitcoin?

Maybe the seven hellish layers of wool would also be willing to accept Bitcoin.
4510  Other / Off-topic / Re: What does your username mean? on: October 08, 2012, 01:59:33 AM
I made it up for a fantasy role-playing game when I was 13 or 14, and then used it for every browser-based game I played. I ended up using it for every site so I wouldn't have to remember multiple usernames. It's supposed to sound like an appropriate name for a wizard or something.

It's nice and unique, but I sometimes wish that I had chosen something more meaningful.

Oh, I never considered quick reply. I don't use it. I'll look into it.
4512  Economy / Scam Accusations / Re: Nefario on: October 07, 2012, 04:35:30 PM
theymos, have you discussed on your shareholders' meeting about why GLBSE don't just use the exiting trading platform to return the bitcoin to its users? why he create the trouble and delay to start another new system to return the bitcoin?

He wants to require AML info before allowing withdrawals.
4513  Economy / Scam Accusations / Re: Nefario on: October 07, 2012, 04:27:01 PM
Regarding the 800BTC you hold. When he really still would hold 8000BTC why should he need the 800BTC? Didnt he want them for lawyer cost? And doesnt this imply that he doesnt even has 800BTC to pay the lawyer?
Or you think he only want them to put them into his new project?

He doesn't need the 800 BTC to start paying back users.

Others say you should send it to ColdHardMetal and not to nefario. Whats correct?

I'm to send it to ColdHardMetal, who will presumably send it to Nefario at some point.

Quote
So you mean 4-5 shareholders have the password and 2-3 would make a backup? That would be cool if it happens because then it doesnt all depend on nefario. In case he runs crazy we would have still the list of assets owned by what person. Even better 2 shareholders independently downloaded the datebase so that not one shareholder could manipulate it and we could compare.
So if possible i would try this. Just in case.

Nefario encrypted his entire password database with a shared key using Shamir's secret sharing. 4 out of the 5 shareholders Nefario selected would need to agree in order to access the database at all. There aren't enough people in agreement.

And is that correct then theymos? Or dont you think its the correct address? I mean its not hard to guess who are the shareholder in the thread and i dont see your actions here as if you want to scam. But hearing that usermoney isnt sent while you could do probably could be a bit worrying for persons that hold money at glbse.

This is not true.
4514  Economy / Scam Accusations / Re: Nefario on: October 07, 2012, 04:19:39 PM
Actually he was asked to send the coins to CHM before the meeting, when he said he was going to sell his shares.

He refused because he wanted to hand them over to the new guy who bought his shares or whoever took over his position.

bitcoin.me is a BitcoinGlobal shareholder who is clearly being fed lies by Nefario.

Nefario previously asked me to send him the entire treasury because I was selling my shares. I refused because I am still the treasurer and it is my duty to hold the funds and dispense them according to shareholder motions until I am no longer treasurer.

The recent motion was to send the funds to BitcoinGlobal's accountant, ColdHardMetal. He never sent me an address because he's uncomfortable with handling such large amounts of BTC. CHM just sent an email to all shareholders about this.
4515  Other / Archival / Re: Reply to a Watched topic, then it is automatically Unwatched on: October 07, 2012, 03:43:33 PM
On the reply page, "watch this topic" under "additional options" should be checked if the topic you're replying to is watched. If it's not checked (maybe your browser is weird or you watched the topic after opening the reply page), it will unwatch the topic.
4516  Economy / Scam Accusations / Re: Nefario on: October 07, 2012, 03:36:02 AM
Tell the shareholders and Nefario that you want an instrument drawn up by an actual lawyer which indemnifies you against any liability for losses suffered by users/issuers as a result of you handing over the funds.  If they're going to pay for Nefario's legal costs, then they can pay for a lawyer to draft an indemnity, too.  You have as much right to protect yourself legally as Nefario does.

That might be a good idea. I'll think about that.

straight out of college

Heh, I'm in college. Smiley
4517  Economy / Scam Accusations / Re: Nefario on: October 07, 2012, 02:57:26 AM
By "accountant", do you mean someone with an actual accounting qualification and accounting practice who has been engaged by BG in a professional capacity?  If so, then hand the funds over - if they're mishandled by a licensed professional then people have recourse through professional indemnity insurance.

No, the BitcoinGlobal officer in charge of accounting.
4518  Other / Meta / Re: Remove "securities" subforum. on: October 07, 2012, 02:47:30 AM
I will not ban a subject of discussion on the forum unless it's very clear that the forum cannot survive while allowing that discussion. I think discussion of securities is pretty safe. If not, it probably wouldn't be too hard to move the forum somewhere where it is safe.
4519  Economy / Scam Accusations / Re: Nefario on: October 07, 2012, 02:41:13 AM
Theymos, can you tell us whether you control the ~675 BTC currently in GBLSE address 1FX22c76vybHJSJdCCjKHDHhcMDhDX87nw, or if Nefario does (or none of the above)?

I am seeing conflicting information.

I hold ~800 BTC in "anonymous" user funds. It doesn't belong to anyone in particular. If I had the GLBSE user database, I would send this BTC proportionally to all GLBSE users.

Nefario has, I would guess, 4000-8000 user BTC in total.
4520  Economy / Scam Accusations / Re: Nefario on: October 07, 2012, 02:37:13 AM
I want for Theymos to step up, and agree to manage the dispersal of customer funds.  He has shown himself to be far more forthright than mr. Nef, and is treasurer after all.  Giving over the treasury funds to Nef now after all that has happened is highly unlikely to result in a happy ending for us users IMO.

Theymos, I understand that your position sucks, and you just want out of it, like you did even before this whole situation exploded.  Unfortunately, you're our only hope, and the funds that you hold are valuable leverage.

Please do not give our monies over to Nefario!  Instead, demand a copy of the user database, and manage the dispersals yourself, as a proper Treasurer should.

The shareholders voted that I should send the funds to BitcoinGlobal's accountant. The only reason I haven't yet is that the accountant hasn't sent me an address. Even if I wanted to defy the shareholders, Nefario refuses to give me the database. It's unlikely that I could get the database in any reasonable amount of time.

If there's a lot of public noise about this very soon, maybe I could get a motion passed to keep the ~800 BTC in user funds with me.
