we're talking about like ~8900 BTC, like $105,000, this is a crime taking place.

If bitcoin securities are illegal because bitcoin is now officially money,

then Nefario has stolen >$100k,

and that is a crime,

and he will go to jail,

I made an appointment with my lawyer today, we'll see what he says.

You have over 100,000$ on GLBSE?

No he has an illegal gambling security on glbse  Tongue

You sure are quite a troll.  You have no right to say what is and isn't legal on GLBSE, from what I hear like 100% of the tickers on GLBSE were either legal or illegal, depends who you ask.

No, but I think that was the estimated total of coins Nef has of GLBSE users' (900 being what Theymos has).

Well, uhh, you know we're dying for more information here, I assume.  Have you any more to offer on what the plan(s) may be?

I don't know Nefario's plan.

Have you contacted law enforcement yet to tell them your side of the story?

Not everyone is a whinny baby like you. Grow up.

Here is a recently completed auction of the Essemtec reflow oven pictured.

http://www.ebay.com/itm/ESSEMTEC-RO300FC-REFLOW-OVEN-/320989507198?pt=LH_DefaultDomain_0&hash=item4abc772e7e

Is there any way BFL could prove they won the auction?

Who has an account on ebay? Someone could ask who was the buyer.
I sent a message to the seller, linking him to the announcement, pointing out the image, and mentioning the skepticism surrounding BFL.  I asked if the machine was being shipped to somewhere in the Kansas City area.

Everything still checks out as the auction was won Sept. 28 and it is reasonable for it to still be in transit.
I received confirmation from the ebay seller that the reflow oven was bought by BF Labs.  The seller asked BFL's permission first before confirming them as the buyer.
^ I got my confirmation back from the seller as well, same message.

I did a blog post on sep 27th on Andrew and BitcoinAdvertisers about scamming and clickfraud.  It looked like he was actively participating in click fraud or allowing it to happen to directly profit off of it from advertisers.  This definitely deserves the scammer tag.

http://btc411.com/2012/09/27/bitcoinadvertisers-scamming-the-bitcoin-community/

So glad to see Andrew's scam-service vanish.

Thank you for this! Cheesy
1088  Economy / Services / Re: Gigamining / Teramining on: October 09, 2012, 10:03:00 PM
Change the structure of gigamining.  Instead of it being described as a bond, have people lease the hardware indefinitely.  People transfer leases all the time.

I believe that's how Sony "sells" their PS3s as well. Just a perpetual transferable lease. It makes sense for the mining companies to take this path when and if legal issues arise.

You dont lease a PS3 with the aim of making money.
And I fear just relabeling it wont really help. I came across this, granted, for Arizona, but I suspect it will similar all over:

I. Defining a Security.
The first step in deciding whether the securities statutes apply is to determine whether the transaction at issue actually involves a “security”. Arizona broadly defines a security as any:

[N]ote, stock, treasury stock, bond, commodity investment contract, commodity option, debenture, evidence of indebtedness, certificate of interest or participation in any profit-sharing agreement, collateral-trust certificate, preorganization certificate or subscription, transferable share, investment contract, viatical or life settlement investment contract, voting-trust certificate, certificate of deposit for a security, fractional undivided interest in oil, gas or other mineral rights, real property investment contract or, in general, any interest or instrument commonly known as a “security”, or any certificate of interest or participation in, temporary or interim certificate for, receipt for, guarantee of, or warrant or right to subscribe to or purchase, any of the foregoing.[7]

The definition for each of these securities is either listed in the Act under A.R.S. Section 44-1801 or provided by judicial interpretations and tests.[8] In determining whether a certain instrument is a security, a court will consider the substance rather than the form of the instrument.[9] “Essentially, if the purchaser will be a passive owner―relying on someone else’s efforts or conduct in order to make money on the investment―the instrument is probably a security.”[10]

What I want to know is where were all these legal aids when all these bitcoin securities started up?  If you guys knew all this before why not put it out there?  So now do all of us bond holders need to pony up some dough for lawyers?   Would have been nice to know some of this before buying into these, I guess I can say it is partly my fault for not looking into all the angles but it is just strange that all these legal aids have come crawling out of the woodwork....

just my 2 bit cents.

Naelr

No shit!  A week ago it was *buy shares now!  clear upgrade path!* and now it's like *well, you didn't call your lawyer, how stupid are you*

on a side note, i just wanted to quote Nefario:

I do not agree to your proposal.

Then you're asset holders should push to have you prosecuted for fraud.

You have a fiduciary duty to your asset holders http://en.wikipedia.org/wiki/Fiduciary_duty

And you have been given all the information needed to carry that duty out.

I reread that post just yesterday, it is so ironic, right?

Man, he doesn't understand his own words.

this forum is full of crooks and it appears to be run by a crook also.

I propose this as the forum's official description

Indeed, I think most would agree.  I don't think satoshi had this in mind when he started this place..

Does it support 7970's yet?
Official BAMT does not, however Phillips' modified BAMT can run 7970s out of the box.

1096  Economy / Scam Accusations / Re: Nefario on: October 09, 2012, 04:06:58 PM
GLBSE itself was a criminal organization.  This is like arguing that a mafia don has an obligation to talk it over with his consigliare and his Lieutenants before going to the police to turn them in.   Nobody cares that you all signed a blood oath together, those private rules are entirely irrelevant.

As a simple non-shareholder user who opened an account, deposited BTC, and then had it all disappear in a matter of hours, I saw no disclosure that anything about the place was in any way illegal.  There was no warning when signing up like "By using the platform you risk losing everything if regulators interfere."

Y'all seem to be saying that the supposed illegality of GLBSE was and is glaringly obvious.  Well it sure wasn't to me, if in fact it even is.

Just how deep should one have to dig to be considered to have met the obligation of Due Diligence?  Should I have been expected to consult an attorney before signing up?

My thoughts exactly.  He manually listed my ticker on the exchange only hours before closing up shop, and there was no "oh btw we are under investigation".. it was business as usual.  I deposited my bitcoin just like many other investors just to have it all taken away in a heartbeat, thousands of dollars worth vanish, and now they make it seem like it's our fault.

Took about 20 minutes to register and post my ad, because your site is running INCREDIBLY slow at the moment.  But I did it!

Just put up another ad too Smiley http://www.bitcointrading.com/forum/new-hampshire/2007-jonway-ranger-%28honda-helix%29-250cc-motor-scooter/new/#new

lolllll soo sorry about that, man i was just freeeaking out about that slowness, i was seeing a huge traffic flow and it looked exactly like a DDOS, i even went through the trouble of replicating the site, databases 'n all on a different server.  After a long time of troubleshooting, I finally discovered that my putty window was glitching and totally maxxing out my internet connection, basically DOSing my own site!  That's why restarting my server did nothing to help.  And my laptop actually died before I could get home, but Windows resumed it's state and it resumed DOSing my site..  omg that was such unneeded stress tonight but it was funny knowing the cause.

welcome to the forum!!! make lots of ads Cheesy

sorry i dont know if we can post a scam that happened elsewhere than on this forum but if anyone has any info about the user poke-her on seals with clubs i would appreciate it.  I lent him 2500 chips (2.5btc) and gave me his e-mail and told me he was going to paypal the money the my account.  we e-mailed back and forth a couple of times, and after some time went by i tried to e-mail him about where my chips were and the e-mail was deleted.

so if anyone knows if he has an identity on this forum id like him to have a scammer tag.

he set me up good and i actually trusted him,  he popped my scam cherry.

he lent me a couple hundred chips once when i was broke, when i tried paying him back extra he only accepted what i had borrowed.
we would play at the same table and bullshit for hours.  He asked to purchase and since i felt we were becoming friends i sent them first.

like the topic in the newbie section says TRUST NO ONE

  wild wild west for sure

lmao scammer cherry
