People have received refunds ... sometimes fast sometimes slow.

I had absolutely no problems getting a refund.  Though I was only in the queue for 2 weeks.  Paid with BTC... refunded in USD via paypal.  I was completely fine with that arrangement (though 1 BTC ~= $42 at the time).

Anyway... I found them quick and courteous and the email response wasn't a canned response but a personal email.  Frankly I found the refunding process very professional (unlike the ordering process --- no email confirmation... no way of easily checking status).

I put in the refund request on a Saturday I think.  The following monday or tuesday I had been refunded.

I negotiated with my wife to order 2 Avalon's if I got a refund from BFL... so ... the choice was pretty easy (though I am pretty much tapped out as far as BTC savings goes).

The whole deal with bitcoin is that you shouldn't invest more than you feel comfortable losing.  If you feel like gambling that BFL will produce... let it ride.... if not... getting USD back is pretty darned painless.

here is a logical argument:   who took the picture that is accepted as the "hashrate" for this device?
Josh did, nobody's trying to hide or deny that.

should a BFL employee taking a pic [in KC] be considered valid evidence of a [shipped] hashrate?
I don't see why not.

People have received refunds ... sometimes fast sometimes slow.

Some people may have received refunds. I did not receive a refund from BFL and I did not receive a refund from bASIC. I clearly do not belong to the group of people getting refunds!

In the bASIC case, I received the promise that I will receive a refund, at least. In the BFL case there was no answer at all. In both cases I expect the money to be lost.

at least with KickStarter many people get refunds when things go south..  but BFL would of been rejected by kickstarter last summer and probably still couldn't convince them now to allow one with the crap proof they have shown

...Not that I believe they aren't scamming everyone.
