He's already been in court, which was your point, he even defended himself pro se. He hasnt been found guilty yet, that will take some years no doubt.


I said "to my knowledge".. do you have proof that he is in court and not hiding somewhere?

he can be tried in absence but that wont mean much if they cant find him.

Transactions must be included in a block to be properly completed. When you send a transaction, it is broadcast to miners. Miners can then optionally include it in their next blocks. Miners will be more inclined to include your transaction if it has a higher transaction fee.

What mtgox does has nothing to do with securities.

I never said it did.. I was demonstrating the difference between failing to Register and the facilitating of a crime.
two separate issues.

Mt Gox failed to register and be compliant.. that doesn't mean they were criminal.
BTC-TC failed to register and be compliant.. that doesn't mean they were criminal either.. unless they actually knew the securities they were trading were potentially fraudulent...

If it ever went to court .. a case could be made in the defence of BTC-TC that once they found out they were dealing with potential fraud they shut down all trading.

But Cryptostocks would have a harder time trying to make THAT same defense argument because they Listed the stock after credible allegations of fraud were made publically.

ultimately the courts decide who is complicit and who isn't.. I'm just pointing out the differences between each of the players involved..

They knew they were advertising and trading unregistered securities, and public offering of unregistered securities to unsophisticated investors is indeed a crime.
Is it as big a crime as selling fraudulent securities, or is it only the amount of money that defines that, I dont know and i dont care,  thats really not so important is it?

sure it is.. you cant bring a class action against someone for not registering with he relevant authority.. but you can for being complicit in a fraud in which you lost a bucket load of cash.

now I'm not saying that Labcoin is a fraud but if it turns out to be a fraud and it turns out that Exchanges have been complicit in facilitating the fraud then investors could legally seek to recoup funds from the fees that the exchanges collected.

sure there are some investors interested in how big the crime is and getting some kind of justice... but I'm prety sure most investors just want more options for getting their money back and being done with the whole thing.

if LABCOIN shuts down and returns whatever money is left like BTC garden did then I'm sure most of this hoopla would just go away...
no doubt there would still be one or two jaded investors that want to see justice handed down but for the rest of us... dusting off our hands and moving on to better things would be preferable..

as this is now a confirmed scam or at best a very shifty company, shouldn't theswede75 return the BTC he was paid as there's absolutly no PR happen now or in the near future.
it's us share holders that's paid him and if he wants to be cleared from this it's in his best interest to return all (or most) BTC to share holders. or better still into some account that can be controlled by share holders. This BTC could be used for law-suite and end this shit once and for all.

So he did his part of the contract and now should pay it back to lower your investment losses? Sorry, I didn't realize (or remembered correctly) that he was paid in shares, but if were me I'd seriously want out of this and my name cleared.  I'd be honest and say at the time I did cash my shares for BTC and did spend some and I want to return whats left.  

You can call me stupid, but I'd rather be poor that be part of this shit.

But I supposes that's just my thoughts and I be stupid enough to do just that.

EDIT. I lost over $2000 AUD and I don't want a cent back.  I just want to see whoever involved brought to justice

I can tell you so far that TheSwede is trying to help solving this mess. Only not in the open. A limiting factor of course is that he only was at "Sam's" mercy regarding getting infos and all. But he is willing to help.

Iam personally want the scammers be jailed. I dont care so much about the bitcoins anymore because i realize that i will never get a reasonable amount of btc back. The more i want to jail this fuckers for drawing my bitcoins into their scam. I prefer a cleaner bitcoin community and scammers should know that they will suffer for their actions. I mean bitcoins is a world currency. Do they really await to be able to hide somewhere? I hope at some point scammers realize this.

i know it's my own fault.
but sometimes i wish this is just a bad dream, or even a bad managed company that eventually will bring the hashes online.
there is just too much money involved to let it slide... the most might be gone, but i still hope for some change and for justice.
that labcoin-move is just not good enough to get away with. ...labcoined Sad

We are still collecting evidence and organizing it for the complaint, every day there is coming in new evidence and more people joining us, we like to make the complaint as complete as possible before we submit it.
