As for ponzi's , the owner can run away with the pot any time (which is going on here almost every other day), not saying that this will (it might), but you got to always expect the worst.

This fits in all of those requirements. So this is provably fair.
And if we would give negative trust for the
possibility to run away with customers money, then every exchange and gambling site should have negative trust here.
And this has been around for over 1 full year now, without running away with customers money.
