For hardware it might be too late with most cards, it's been almost 6 months. But they sold actual hashlets on gawminers.com via CCs, and these should be easy to dispute. Unfortunately if GAW's accounts are empty it's going to be the bank or the payment processor holding the bag.
It depends on if it was paid off or not, in the USA as far as I can tell by reading the paperwork, so long as you owe at least $0.01 on it you can dispute the charge.
As always YMMV. Can't hurt to try.
And if the is money not in the account there the bank eats it.

On the contrary, it means quite a lot. In 2011 the U.S. Supreme Court ruled provisions in a TOS prohibiting class action lawsuits as enforceable. This was a case against AT&T. A class action against GAW by its customers will immediately be thrown out due to the Supremem Court ruling.

Yes, but since they changed the TOS so many times in so many ways w/o giving notice the entire TOS including the no class action part could be tossed out.

Hello. First of all, we hope that you are enjoying the holidays. As you know by now, we, sadly, were not able to be a part of your gift exchange.

We finally received an update from the factory on Monday. They let us know that production is still going, but that they won't be able to ship before the 25th of December (today). At this point, we were told to expect them any time from 26th onward, without any explicit dates. As a result, our CTO had to cancel his holiday vacation, and is spending it in the office, waiting just in case they arrive some time within the next week. Some of our developers are staying home so they can be available to help package and ship as well, and I'll still be around to give any updates, help with processing and placing shipping orders, and to listen to any concerns, complaints, and angry disappointed letters should anyone feel like directing them our way. To give a better estimate for the time, here is the process once we get them in the office: our devs and CTO will be flashing the units (we have a rig to do many at a time), packaging and sealing them, and then when they are done shipping them in bulk to our distribution centers. Flashing and packaging will probably take a day or three, and shipping another few days. From there, they will ship directly to you. I don't know exactly how long flashing and preparation will take, because there are a lot of orders to process and items to pack. At this point, we have 915 units ordered to ship. We tried to expedite the manufacturing process by asking the factory to do a 1000 unit production run as a rush job, instead of the 5000 as we initially planned, and ordering the remainder for a later delivery. Lucky for us, our preorder numbers were below 1000, so everyone should be covered. Unlucky for us, this rush job still ended up being not fast enough.

Anyway, that's all the information we have at the time. Again, we are sorry we couldn't be a part of your holidays, but we hope that they are full of cheerful and happy celebrations for you

If someone bought a bunch of Hashlets in the past month or two with a credit card, would it be reasonable to chargeback the purchase? Or, should they view it as an investment that went belly up?
Most people buy miners (including cloud miners) and leave them alone to accrue coins. Problem is, in this case, the company changed course and no longer works to make those miners profitable. Thus, the investment was made relying on a false premise. On the other hand, maybe a person should monitor their investments on a daily basis.

In conclusion, should those that bought with credit card attempt chargebacks? Or, since many people paid with Bitcoin, maybe a class action suit would be more appropriate (because more people could participate) for anybody that made a Hashlet purchase in the past couple months under those false premises and before the company changed course from mining to whatever this PayStaking scheme is going on now.

Or, do nothing, as sometimes in life people get screwed over and should use it as a lesson learned and move on?

Yes you can do a chargeback. Depending on the amount charged and the card used it may or may not stick.
