I am afraid you are incorrect. Contracts of sale cannot be unilaterally cancelled unless the contract explicitly allows for doing so.
Just imagine that we agree today that I would deliver you 10 bushels of wheat in 3 months for a given price. If 2 months later the price goes up, I cannot unilaterally cancel the contract and give you a refund.
As for damages, one can calculate the earning capabilities of the item that was ordered, and one can seek compensation for a reasonable period (few years) of use. It would be several thousand dollars at the very least.
What you've described is in fact a very specific type of sales contract usually called a "forward contract" - If the buyer could produce such a contact then there would be a legitimate case for damages incurred. However, never was any such contract offered by BFL... so I doubt the OP has such. I respectfully disagree with what you say. What is special about a "forward contract" is that the delivery may be well in the future, and in most cases so is the payment. In the case of BFL, they accepted payment now, and promise to deliver. Failure to deliver on time (or within reasonable time) is a breach of contract. For example, if I sell you my car, and you pay me the price, then I cannot unilaterally change my mind, and simply give you back your money. I will also have to pay you all damages that you incurred from my failure to honour the contract. Even this setting isn't stable ! Do you have a single card? What happens if you lower the memory to 1500 and increase the core to 1000 or 1050? Can you paste your cgminer.conf?

I'm only running 3x 7970 gigabyte hd edition and they crank out 2.3-2.5 mh/s. I can post my config for you if you want OP.

Did you read SCRYPT-README in the cgminer source directory? Yes shaders value x4 is recommended in scrypt-readme How many cards do you have? Can you paste your cgminer.conf file?

Such an action has very serious legal consequences, and if the reason for doing so is malicious (i.e., to retaliate for negative comments made on a forum), then I could easily see punitive damages being awarded in top of compensatory ones.
Hopefully the FTC and Missouri AG see it that way as well. What about small claims court?

Has anyone ever figured out how to unlock voltage on these rev. 2 cards? Really wish I could under volt them.
It is possible to flash them with modded BIOS. The question is whether they will remain stable at a lower voltage.

What speed has rate do you get that way? Sorry, 725 kh/s on most of my 7970s. Did you try 1050/1500 or 1080/1500 (on Gigabyte 7970OC)? Are you getting any better results (with 8192 thread concurrency)?

Hello I have a rig with 3x 7970, Gigabyte GV-R7970C-3GD...
I have tried everything on the internet to get these cards working at 650+, actually they won't mine above 580 kh/s... I have noticed a strange thing running settings that people over here post... I would usually get more kh/s if I remove the -g 2 ! Which people say is needed for speeds over 700 kh/s.. I have Catalyst 13.4, latest App SDK 2.8.
Quite annoying thing, I have spent more than 10 hours trying to set it up but no progress so far !
Currently running at 550 kh/s using stock settings at -I 13
Try engine at 1080 and memory at 1500. thread-concurrency at 8192 lookup-gap at 2 and (very important): gpu-threads at 2.
