I was an incredibly productive member for 2 years until this fiasco and now I get treated like a common scammer, I will look at your order when I get home and write back to you about the refund thanks

this is starting to get really painful. BTC just hit $53 each... Tom is clearly waiting for the price to keep going up before paying out remaining BTC refunds. I submitted by request for refund over 2 months ago. The 244 BTC I paid will get returned to me in the form of just over 50 BTC even if he refunded me now. So I'm just supposed to take a loss of $10,000+ while not having access to my funds for half a year? This is unacceptable. I only live 4 hours away from where Tom supposedly lives, I'm really tempted to drive up there.

To start off my reply I am going to say that I too had units pre-ordered. 5 of them. As Tom has stated the website you purchased the bASIC units from displayed prices in USD. Since that is the case when you paid in bitoins you take the price of the unit divided in USD by the market price of BTC at the time of purchase. That determines how many bitoins you paid. Just because Tom didn't deliver a product doesn't mean you entitled to a refund worth over ten grand. Had tom actually shipped the bASIC product and then you decided you wanted a refund do you really expect him to take a $10,000.00 loss? Before you decide to rant and rave on the forums you should put yourself in his shoes and really think if you ran this project and you had failed and you wanted to make things right would you refund person X the amount they paid in BTC or USD? I agree with you. That said, if a refund isn't done in a timely manner (I asked for mine more than 2 months ago now), interests should be added to the refund. I don't know the applicable law for Tom's business but where I live 12 to 15% annual interest is standard.

if you sell more BTC on mtgox then wont it be tom buying your BTC to replay you the BTC you used to pay tom .... my brain hurts

You misunderstand. I don't want a refund of my full 244 BTC back at $64/btc, I want what was owed to me in BTC when I requested my refund over 2 months ago. BTC was at $28 when I requested a refund. People with orders later than mine who paid in BTC have already gotten a refund; there is no excuse for the prolonged wait I've had to go through.

hmm no answer from tom on my emails asking about wither or not he plans to repay me my btc bar or not. anyone know the legal standard for trading goods for goods i trade a 100 btc bar from https://www.casascius.com/ which is worth 100 btc. does tom owe me my bar back or does he just owe me $1000 since i trade a good for a good. and dont say im trying to be greddy or shit bc the bar was worth more then the asci at the time i made the deal with tom and i was also willing the whole tim and still am willing to take a 24 hour average of usd to btc of the time i request my refund which was jan 14th where tom again would make out so im not being greedy or unfair. yes i think i am owed my good which is a btc worth 100 btc but i am a responsible man. tom plz email me so we can work this out i have all skype convos on are agreement if you need me to post i will i just want to work this out
