shakaru aka Andrew Nollan accepted payment of $1600 for 4 EVGA 580 GTX's Classifieds 1.5 weeks ago, has since tried to worm more money, change the conditions and finally reneged on the deal. He owes me 4 EVGA 580 GTX's Classifieds which he has refused to send. He owes me $1600.

I have done numerous transactions with shakaru and he has always been a stand up guy.  You are leaving out details to help prove your case and attempting to force a trusted member to give in to your scammy ways.

Posting something like this knowing that you would need a large amount of evidence to prove to the community that you (a known shady character) got scammed from a trusted member is beyond me.  This whole situation stunk of astana was soon as I saw it.

I do some business with Astana, would like to see how this plays out.

From talking with shakaru, astana not only created this mess but is adding to it.  Astana has called up his credit card company and disputed every transaction (processed thru paypal) with shakaru.  So even after being refunded and ultimately losing nothing he is going back for more.

I spoke to Astana last night, and I asked him to sort this out. Regardless of the facts, right or wrong, its up to both parties to sort this out. I strongly believe that if he wants to keep a good reputation (or salvage the one he had) on this forum and with the pioneers of the Bitcoin community, this needs to be resolved.

It's a shame, because Astana and I have been doing business for the last 2 months and I have had nothing but good things to say.

On that note, until a resolution is made I personally won't be doing business with the flagged parties in this thread. Of course, I can't speak for anyone else. Take what I say with a grain of salt.

To date, Astana has reversed over 600sud in btc trades via paypal over the past 3 months and states that he does not know me and that his paypal account was hacked. I will let paypal sort this out and I am not to worried about it.

These are the two btc revsals. I am trying to get my skype logs right now. With luck, a few of my rigs have skype on it that has been running for months. Normally when I walk in I see all my convesations on the screens, so I hopfully can have that to send to paypal.

This was a misunderstanding. astana was sent a refund from shakaru's bank, but he didn't understand that it takes several days for the refund to complete. Because of astana's actions, this issue has become much more complicated. As a result, this investigation has been put on hold until all of the various Paypal disputes are resolved. I fully expect that both of you will send the other enough money to make this even between you in the end. PM me or post here if this doesn't happen. I am subscribed to this thread, so I will receive all updates as they are posted.

Honestly, I could care less who views his private information. I just want him to submit it to somebody that is reputable. All Hero Members are allowed to arbitrate disputes and gather private information. If the arbitrator decides that someone is a scammer, they submit a summary of the information as well as the specific incriminating evidence to theymos for his decision. However, before submitting to theymos and potentially wasting his time, we usually recommend sending that information to a Global Moderator for an initial review.

The only logs that do exist are from Skype. No irc chat was ever used (the freenode servers can back that up) also, all forums pms have either been me stating that I do not trust astana and I am refuding his money, and a series of onsided pms to me with some wounderful lillt quips.

Right now Paypal is going through the materials that I have provided them and I am waiting a return call to discuss the matter with them. If anyone wants to help by sharing their expiences with astana, send me a pm and we can discuss.

And I agree with desloc. It would be a conflict of intrest in regards to our dealings together for him to objectivly evaluate. However, if there is anyone who knows me best on this forum, it would be him.

I know Shakaru to be an extremely honest member of these forums, and seeing from the evidence presented (Astana, you still have no shown anyone any evidence) it looks like Shakaru is the victim here. At the same time, I have done business with Astana and have had no issues, he is actually quite friendly.

Having said that, I dont think I'm the best choice to be objective here. I'll gladly take a look at all the evidence and present my recommendation to the forums. However, what I say should not be the final word.

This was obcheived by means of Cheaper n Bitcoins for 1 of the 3 remains units, and 2 by means of the SoCal craigslist.

During our transaction, you told me of issues with large numbers on paypal, lack of access to btc and the need of multiple transactions. You also told me of how you didnt want to pay fees and pointed out how you liked my practices of our previous btc trades in the form of the "Gift" options as it saved you fees and provided me with security. You even screen capped that part. Sure the rest of the conversation both preceding and the resulting conversation ommited. You also omited the part about the remaining $48 ballace for the cards, the shipping cost, plus the pre-decussed matter that 2 of the cards would be purchased under a resale agrement and that CA sales tax must be paid. You asked me to lie, and said I should not charge you tax. I told you I would not give you an extra %5 discount as it would be coming out of my pocket. So, instead of setteling your debt, you aske me to sell you harddrives on credit as it was "good business". Not only that, at a discount at what I was selling them at. If the public wishies, you can see where I sold 4tb hdds to AmazingGrendo who still is using them. I refused this deal. Then you stated that "if I knew anything, I would reconsider" I told you that it made no sense to sell to you for less minus the cost of shiping because it was repeate bis as I did ok on my own.

Well recently I had a deal go sour in the UK. It was my 3rd int deal and it was pretty simple. cards, mobo, psu. MONEY $$$.
So I send off the tracking, wait a bit and the guy is he lost the tracking and its not there. And in that time in all fairness, I probably tossed out the tracking number, but we have talked for a while not on skype and Im ok with him, so we agree that if its not there by X date,  I will sent a replacement package of the SAME hardware (if you know my op, you know what I got) and yeah its a loss, but I have a weekness for the miner. User [Deslock insert dickhead FIRE RIG kid here that we bought hardware for and was mininging part of payb.tcs contract here] got free cards, psus, a trip to frys for killawatts and some nic gear befoe taking off. So I took that loss for england guy. Well after I sent package #2 w/ a trackng. He called his cc an revesed it for a shitload of money in british pounds. So you this that with a tracking numeber its open and shut? Nope. Number CP8804198759us currently waiting some fees at the post (who knows why) but they say he never got it. So because of that, I would guess they are going to do the same. Expect the worst, hope for the best.

Awesome!  One step closer to back-to-business is getting those Paypal transactions reversed.  I found that Paypal is pretty reasonable, and after I had a dozen people try and scam me, all I had to do is phone up Paypal every morning and tell them my story again (didn't expect selling bitcoin on eBay to be so horrible!) and having proof of sending the coins by making movies of the transaction, Paypal always sided in my favor.  Even if they vote against you in a decision, call them again, they'll re-open the case.  Keep re-opening, you have proof, you're the clear honest person, you'll win.

When accepting MoneyPak for bitcoins...

• Do so with trusted parties
• Withdraw funds to a prepaid debit card (greendot)
• Receive a scanned copy of all receipts and both sides of the MoneyPak itself*
• Do NOT send bitcoins until you can confirm that you have received the funds into you Debit Card

I believe there is a waiting period for adding funds to Debit Card. Make sure that both you and the other party understand this. The person receiving bitcoins will have to wait.

Given the fact that it costs roughly 5 dollars to fill a MoneyPak, the larger the balance in it, the better the exchange rate for the sending party. This increases the potential of loss for both parties. If both parties take the right precautions, a new user should be able to purchase bitcoins with MoneyPaks. It is an extremely easy way for someone to turn cash in hand into bitcoins and I would not like to see it ruined by a few scammers.

*There have been occurrences where people have scammed Convenience Stores to receive filled MoneyPak codes over the phone. Having a scanned copy of both sides of the MoneyPak excludes you receiving stolen copies by this means.

Astana registered a new user by the name of astana_. I linked to two of his posts, both indicating that he was furious. They are now removed.

I don't post often but I've been asked to say a few words. I know astana, I sold him 100 bitcoins when I first joined and have him on icq and msn, he has a foul mouth and bad attitude I agree. But he has always paid upfront and there has been no trouble with money. I don't want to get involved, I'm just relaying information here that he sent me on icq and msn because he very strongly asked me to do so.

shakaru have you refunded his $1700 or what ever the amount was he gave you? He says you haven't returned the money and have cancled the refund. I asked for screenshots to post here to back up those claims but he said he was taking his girlfriend to the hospital she is pregnant.

Also I've read this thread from the start and some of you need to have a reality check and need to rethink your actions. Saying your going to call the police on him or the tax office is not a good thing to do. It's not the best to ruin someones life because some financial deal went wrong on the internet when you consider he has a child about to be born.

That locks up the whole procedure with PayPal until that investigation is done, they can't proceed with theirs. He tried to commit a crime and was stopped.

End of story, no reason to think he is going to get anything back, he is not due anything, he is not entitled to anything and I suspect he is not going to get anything. Supposed pregnant girlfriends who show up being driven to the hospital not withstanding. The refund was cancelled by PayPal when they found him to be in the wrong. Actually this is where your wrong. First, I still have yet to recover a single cent in the matter as of yet. Paypal has ruled in my favor, but nothing has changed yet. Second. Yes I refunded him, and he reversed his credit card payment and paypal took over the matter when that happened. As far as the authorities. What girlfriend? He told me he had a wife at one point, and his facebook list him as single with no mention of dating anyone, or becoming a father. While that is not evidence, it dosent look good. Also, even if I wanted to give astana free money, paypal will not allow it. Also, why am I not beign reimbursed for the fees that I was charged as a result of his reversals from October? Why did he reverse them after paypal emailed him saying that they had to hold his funds for 3 days? Why did he revese the 1600 too? It might be worth re-reading page #1 again where it says 1600 refunded via paypal, and as there is a dispute, it is in the paypay system as has been mentioned several times.  And page one is also where the claim is made that Astana wanted both the GPUs and the 1600.  So he wanted them for free - not good business.

Just so everyone knows. I dont mind about 90% of this. The matter is pretty much closed and as I have said before that I am really amazed from everything I was told about Paypal, they are handeing the situation with amazing help and profesionalism.

The refund would have appeared in your account on the 21st if you hadn't reversed the previous transactions. Had you waited until then and not received a refund, shakaru would have had quite a bit to answer to.

How can PayPal hold funds that were reversed by the credit card issuer? All that is on hold is $1600 of shakuru's money that should never have been held in the first place if a certain itchy trigger finger didn't try to scam both the refund and the cards.

This "ruling" needs clarification, and I would submit for the Court's consideration that a certain amount of this is due to shakuru for having his operating funds tied up for so long in an attempted theft, and a measure of consequence to the scammer who tried to cheat him, and the others that he has offered up in his screen caps.

If I was seated on this jury shakuru would be awarded damages exactly equal to whatever amount he has on hold, and astana would be held accountable for this activity, along with being banned, with all sockpuppets, from this community for life.

I think defamation has been described elsewhere on the boards, but you need to prove that it was a false belief on the part of the defaming party.  If someone honestly holds a belief, then that is typical defense.  The last 16 pages might go some way to explaining why particular view is held.

Honestly, I think the best thing to do when someone is threatening you with a lawsuit is to never talk with him again unless you are absolutely forced to. On the off chance he is serious about this, however unlikely, you wouldn't want an unfortunately-phrased sentence being turned around on you.  Some people's egos will take them way further than you would expect they would go.

Australian defamation law is a bit different to US defamation law, but it's immaterial as astana is full of shit.  He doesn't have grounds for pursuing a defamation action in Australia and he's not going to find a lawyer willing to even try to launch an action in another jurisdiction.  

Astana has acted illegally and continues to do so - no lawyer who wishes to retain their licence is going to enable him in his harassment campaign and they aren't going to launch frivolous lawsuits on his behalf because the fines for doing so come out of their own pockets.  The legal advice he's most likely to receive if he actually does consult a lawyer is to see a mental health professional and to wait for his credit card charge-back to go through unless he wants to end up with charges for both fraud and harassment as well as attempted extortion being pursued against him.

I'd be very surprised if astana hasn't encountered legal problems related to this kind of behaviour in the past.

Paypal never keeps funds for them, funds have to go one of the ways, or to the original recipient or to the original sender if it was reversed.

In case where the account is frozen, and notice I said account, not funds, all funds on the account will be held 180 days until paypal writes a check with those funds and mails it to the address that is on the frozen account.

So, Shakaru, is the money astana sent you on your side or is it on his astana's side and his account is frozen?

Maged, you better check this and do the right thing.

Because astana has initiated a credit card chargeback, the PayPal money should be returned to Shakaru.  If that doesn't happen, then astana would get refunded twice - which it's pretty obvious was his original intention.  How long it takes astana's credit card provider to return the funds to his account isn't Shakaru's problem.

Having just read through the whole thread the money is currently with Astanas CC provider as he put a stop payment on and that is why paypal is holding the transaction because of this stop payment, did I get that right?

Do you want to check it? Honestly, now that astana has officially threatened to sue me, I could care less what happens at this point. If you know what a credit card chargeback is supposed to look like on both sides with a PayPal account, that'd be nice to know. I haven't been unlucky enough to experience it, myself.

I have experienced it, regrettably astana is not the only douche-bag who has figured out the PayPal/CC charge-back scam.

PayPal will leave the funds in shakuru's account frozen until they get a final determination from the issuing CC company. In this case that will be astana's CC. Unfortunately for astana, his CC company will be looking at all the facts and documentation in the matter, and will have PayPal actively supporting their investigation. In the end, the attempted double dip will be obvious, the CC company will not reverse the charges to the benefit of astana, they will release the funds to PayPal, who will credit them back to shakuru. At that point, shakuru can determine what, if anything, he chooses to do with those funds, re-initiate a refund to astana, spend it all on hookers and cocaine, or buy more hardware to sell to other, honest, customers. It will be his money free and clear, and his alone to deal with. Astana will have no claim for anything, as his only claim now is the charge-back which he has already admitted was fraudulent.

It ties up your funds for half a year, but in the end, if the other party is a lying piece of trash who clearly attempted fraud, then you do get your money back.

And as a side note: @blue.dipshit? Feel free to contact me with your actual personal contact details so that I can provide you with the same for service of legal proceedings. I am certain that I am one of the parties that you feel has "defermed" you (interesting how both astana and blue.dipshit use the same mis-spelling on that word isn't it?) and I would welcome the opportunity to meet you in any competent court of law to satisfy this matter.

As far as providing my banking info, I'm afraid I can't do that. Here's why. I only have one bank account and that's business related for my reclaimed barn wood business. Although I rarely use it for personal use, I've opt to not do anything outside of that account that's not related to barn wood. That even includes funding or accepting anything related to Bitcoin. The bank and city of Sandwich, IL, already has the red-ass for me because of where my physical warehouse(s) are located, although all my business practices are on the up-and-up, including with the IRS. The last thing I want is to give the bank an excuse to close my account, even though I've had it for a long time. Just recently, they held a large check I deposited for several days, and it came from someone who banks with them and is in good standing. They sure have been acting weird the to me the last few months. Sorry about that.
