My own issues with them, for example, were always in the nature of competence rather than trustworthiness.

And if the argument being made was that they over-estimated the market share they would be able to capture and under-estimated the inherent problems in operating a Bitcoin exchange I would absolutely agree with that assessment.  I don't believe that anyone can successfully operate a Bitcoin exchange long-term in Australia at the moment because I don't think they can get sufficient volume to off-set the overheads and make a worthwhile profit.

I'll certainly re-consider my opinion of their trustworthiness if users do not start receiving refunds soon, but right now I'm not seeing any evidence of any plan to cut and run with user funds.  The actual evidence points more towards an idea that didn't work out and moving on to other things (for the record, I am checking ASIC notices daily and will certainly let people know if any indication of insolvency shows up - they'd be absolutely crazy not to seek insolvency protection if KenseyCol is in fact insolvent).  I'm also perfectly happy to help users navigate the legal options available to them in the event that user funds are not returned in a timely manner.

This is news to us.  We haven't received any communications in this regard and we have no intention of dropping the suit.  In fact, we haven't even personally received any contact from the liquidators regarding our claims, which is strange given that we probably make up > 50% of the total money being owed.  We await the liquidator's finding as to the responsibilities of the individual Bitcoinica directors, investors, founders.  If the liquidators wish to help our case against the other defendants, we might be willing to drop Bitcoinica from the suit.

The liquidators have stated that they don't have Bitcoinica's records, which puts them in a peculiar situation regarding attempting to contact alleged creditors.  They literally need creditors to contact them at this point, so you guys might want to get your lawyers onto that. I don't think this is the appropriate thread in which to discuss your lawsuit but I'd strongly suggest that you obtain an opinion from a NZ insolvency lawyer regarding the pros and cons of including Bitcoinica in the lawsuit at this point.  The liquidator cannot advise you on this point and you need solid legal advice on the implications of trying to cut deals with the liquidator.

Well, it is not certain for all megafauna, but it is pretty much sure for a lot of large animals, such as aurochs, Moa, thylacine, and so on.   Many fascinating creatures have been wiped out by humans in the last thousands years, and that is kind of sad indeed.

On what basis are you classifying the thylacine as "megafauna"?  The oldest of the species fossils discovered to date indicate that the first thylacines (over 20 million years ago) were actually smaller than the "modern" thylacine (4 million years ago).  Even the modern thylacine was a relatively small animal for an apex predator and definitely not in the "mega-fauna" or even "large animal" class.

I'm in Australia too.  I'm thinking that all Aussie Bitcoin businesses should probably put notices up about when they're going to be closed over Christmas given that a lot of people are rolling the weekend before Christmas into a long weekend so many businesses will be closed from the 21st December until at least the 27th.

Someone who starts a pass-through is risking other people's money, not their own - we generally hold people dealing with other people's money more accountable than people risking their own funds even if the "investment" involved is stupidly high risk.

While it's true that MtGox could convert USD to CAD to meet the withdrawal requests, exchanging currencies costs them money.  From a purely financial viewpoint, it makes better sense for them to either wait until they have enough CAD on hand to meet the request (from people buying BTC with CAD) or to encourage people to withdraw in a currency they do have on hand.

It is - however - annoying as hell that it often takes weeks to even get a statement from them about the cause of delays.  Just because you can get away with providing shitty customer service when you're the largest game in town doesn't mean it should be your standard operating procedure.
