I read the entire TOS, I felt protected.

The level of personal security of each account was an order of magnitude higher than my banks, I had a 24 character password that was essentially a hash key, as well as a google authenticator with my smart phone, best part?
 I was using bitcoinica as an exchange, I just deposited my money in my account and was planning on turning into btc that same day for an investment with starfish BCB, then the hack happened.

I did my due dilligence on the company, and the risk of the company becoming insolvent was low at that time, please don't get angry at me for believing personal security measures was enough.
So it was no issue for you that they had been hacked a few times before?
Slowly I am starting to understand why they still believe that they can continue running Bitcoinica in the future. In a year from now, everyone will say "yes, they got hacked some 20 times, but I feel that it wont happen again".

After the initial hack, I was extremely put off by bitcoinica and completely avoided them, however upon returning to their site I could see that they began (at least facetiously) taking security very seriously, and I

 decided that they had a reputation to match mtgox (another hacked website, however is still widely traded on). I decided to use them for a wire transfer because they had an easier bank name to input at the

bank vs. mtgox's japanese bank, please stop harassing people that lost their shirt in a "semi reputable" business, I don't just throw my money around willy nilly, and your assumption that I do is insulting.
Sorry, did not want to insult anyone. Was just trying to understand how the site got that much trust, after being hacked and once it was public knowledge that it was run by a minor.

In the US, an officer of a corporation is required to do whatever is necessary to safeguard the assets of said corporation.

I'm not a lawyer, but I believe Genjix *purposely* refusing to call the police will make him criminally liable, and for this fact alone he could face jail time.  Make sure you pursue this with the lawyer.  I don't have enough invested to make this worth my while, but I wish you the best of luck.
I still think you are barking the wrong tree, genjix is "only" their workhorse, while Patrick and Donald where the C-something-Os, that made all those bad decisions that eventually led to the current mess.

Lawyers are going to be very expensive and what if the "investors" don't have any money to make you whole?

Thats what I plan to find out, and to find who can be considered criminally liable for the latest hack.

The tragedy of this route is that on the one hand it's the only active route that bitcoinica users can pursue at this point, but on the other hand I think it reduces the odds of anyone getting anything back.

its quite unfortunate and you're correct, but at this point I have absolutely 0 faith in the bitcoinica consultancy, I hate lawyers too but I at least respect that they can sometimes get things done.
Genjix stated multiple times, that Patrick and/or Donald where the one that did constantly delay the payout. Maybe this process can now be faster, since at least Patrick is gone. So hopefully genjix assumes that he is now authorized to do the actual payouts and does it without further delay.

As I said we know how and where the USD moved, so yes.
Can someone please quickly hack Mt.Gox to extract this very information?

BUT: after all they are a LP. i think this means that if the company don't have the funds they are not legally obeyed to pay out.

in germany if someone is a "security expert" (justice defines this term) and do very obvious failures in securing the money they are personally liable (or must go to jail).

i dont know NZ/UK laws and i dont know the policy of this forum.

personally i think they all deserve a scammer tag now.

This has been one of the most stressful situations with maximum suffering I have ever experienced. I am furious and I hope everyone involved putting us through this gets what's due to them. Karma is a bitch, you fucking wankers.

Right. Because this has not been the most stressful time of my life.

I have physical health problems and need to see a doctor, but haven't had the time. On the forums I'm called a scammer and repeatedly insulted. Someone is trying to sue us. My bank gave me crap and held my money. I was borrowing cash from friends and spent 3 days eating bad muesli and cheap milk. I lost a lot of code by accident. I put a lot of work into the bitcoin.org clients page to make everything fairer, and now it will be removed, helping to recentralise bitcoin again. Electrum maybe has a security flaw and Macs have random problems. The conference needs the CFP announced soon, but I have to deal with Bitcoinica first. My health is suffering and im getting headaches. Right now is the first time I'm feeling depression, and I'm a little worried because I've never had it before but my father did. I emailed a health professional and they advised me to seek help. I've started sleeping very long, being very lethargic and apathetic. When the Bitcoinica thing first happened, I was considering suicide until Tihan said he had the funds.

Don't do too much things at the same time. Deal with Bitcoinica first. Keep in mind, that whatever you will pay out, at least 2/3 of the recipients will be complaining. But once you have paid out all, there is at least nothing left fighting about. Then you can go back to coding and be happy again.

Someone is trying to sue us.
Did you expect everyone to wait forever?

Edit: The API key was changed, but someone had a LastPass account with the same password as that, and was actively updating it with new passwords.

genjix, use your brain and at least LOCK the damn account to YOUR yubikey. DONT SHARE IT ANY LONGER! NOW GO, DO IT!
Edit: and REVOKE all API keys!

Why did even Tihan have access to any passwords? That's ridiculous.

Whoever is in charge should have long time ago created a new secure store for Bitcoins (if not for the USD) with a proper authentication trail and transfer everything there.

In your own interest, hire a crisis management specialist and a PR specialist before you fuck up to the extent that you end up in jail.
Maybe some jail time for some of those would be the best that could happen to bitcoin. Those guys are criminal careless with other peoples bitcoins. In the past Bitcoin Consultancy did seek government regulation of bitcoin. Now give a good example and report yourself to the police.

They get hacked on a daily basis. I doubt that there will be anything left, before they really start to pay back.

It should simply be called MyBitcoinica.

Actually, I forgot that supposedly a few users already got paid out 100% of their claim, so unless they add some new money, people will get a little less than 2/3.
First I thought maybe one of them is actually Tom Williams.
But then, this Tom Williams handled the mybitcoin hack way more professionally then those "professionals".

We regret to inform you that there has been another huge breach of Bitcoinica. While all passwords were changed after the theft which occurred May 11th, the password for LastPass was not compromised and thus left unchanged. The breach today occured because the password for LastPass was in fact a duplicate password which had been compromised during the hack.
