If MtGox and Bitstamp are practicing the safe handling of your personal data, the risk is always there but not too much to worry about.
Howeer, if they storing the picture of your driver's license, passport, bank statements and credit card and phone bills on the server unencrypted, as they get hacked your private info is at risk.

Safe way must be Bitstamp.net and Coinbase.com. As a first time coin buyer, Bitstamp will get you the coins faster than Coinbase. Coinbase takes not just 7 days but about 10 days before they release the first coin purchase, IF THEY DON'T REVERSE IT during the wait period. If you can't wait for a week to 10 days, then another option would be... Localbitcoins.com can be scary but if you do the homework and the sellers give you all the contact info, at least if the seller scams you, you can call 911 on the spot or report him/her to the police. (Problem is it's cash based, so if you get mugged while waiting for the seller, you are done

I would say, give them a benefit of doubt. The voice mail voice sounds people with Chinese accent. If they have the Chinese Connection, it's possible they may have the unites in production in China, importing them to AU to sell.
If this was a scam, well thought process. Register a business, looking for a place to rent and setup an e-commerce site (which is not too hard to do).
Renting the retail space is not so cheap and many basement/garage startup use rental address or friends or family business address to initially register the company then, as they succeed, those companies may justify getting their own space. If this company was the VC funded project, then they should have a public office or the retail space somewhere but if a few people came up with the idea and personal/family funding, it really could be a small operation but trying to do a legit On-Hand Sales rather than the Risky Pre-Orders
I left them a voice mail. I'll see if I can contact them. If all things work out, I may go visit them or the other local guy can go visit to confirm.

In theory, they are the exchange. They make money from the trading fees. They liquidate your Bitcoins, when someone buys from you on the market. So when you try to withdraw, the money should be there.
If everyone want to sell off... Oh well, if no one is buying the Bitcoin at MtGox, MtGox is not the one buying them from you. It's their customers. So whoever can't sell the coins, can't get the FIAT Withdraw, but everyone should be able to get the Bitcoins at whatever the value at that time at the MtGox Exchange Rate.
I would say not worry too much about MtGox. At least what they appear to public, they are trying to meet all the financial regulations to keep Japanese Government, US Government and some other EU countries happy. It seems they are sooooo tight about Identity Verification and FIAT Info so they can report all the transactions to the customer's country.
Also, everyone knows MtGox, so if they are running slow, it could be they were getting the Ddos while we don't know about it. If it's in the US, most large company would prevail from the attack and be back on line, however, the Japanese currently don't have the same knowledge to combat and prepare for the disaster as USA does.
It didn't close the door in April, when their US Bank Accounts were seized, they survived, when they go into the legal problems in the USA, they survived. So they will survive for whatever they are facing now. (Hope)

If they really wants to take it down, it would have been done already.
My guess is they are going to regulate it now.
US Federal Judge already stated Bitcoin is a form of currency.
Bitcoin exist in China, England and other EU countries, started to spread in the USA, Japan with each government approval one form or the other already. Each government may have different version of regulations but so far, none of those big countries are try to shut it down.
Some example of supression but now more they are educated what it is, it will open up the door for everyone to be accepted.
Just remember when Paypal came out, everyone was saying that was bad, geek's money, you must be doing something bad if you have to use Paypal to pay someone. Now, Paypal is another form of payment.

Instead of typing your private key, use the smartphone and scan it, if you are mistyping the key, auto scan will pickup the right key from the barcode!
