I do believe that Acension is not going to pay anything to anyone,but I know that complaint this guy to SEC under the criminal of selling fraudulence stock will be help. Have you seen that recently the owner of stashidice have been fine by the SEC because of selling unregulated stock to the public. Anyone who stay in the USA ,that is conviniened to contacting SEC should help the rest of us to against this guy by filling a complaint sheet .

I'm trying to contact him presently. He said in early May that he expected dividends to resume in about a month and expected to repay the loan by the end of the year.

I'm going to try to find out if he is still on track for that timeline.

I've talked to SOSLOVE868, and will likely join up with him for a lawsuit in the event the loan is not repaid. I think that are best chance is to avoid the legal route if at all possible. We may have no choice though.

fyi, ukyo owes me roughly 250 btc. I'm not sure how much he owes SOSLOVE868. A smaller amount, but still a significant amount if I recall correctly.

I am still waiting for u, u r right that Ukyo owes me about 210 BTC and about 300 for Rockxie ,I have contacted with Rockxie ,he also willing to join the lawsuit. However taking customer's fund or either taking loan without consider to pay back,it's a fraud and criminal behavior. I think Ukyo knows it.

2: all cost related to against Ukyo is calculate based on the percentage of how much UKYO owes you towards total liability that against Ukyo in this lawsuit case.
For example, if Ukyo owes me 100 BTC , and there are 1000 total liability in this lawsuit is against to UKYO. then I will respond for 10% of the total cost. of course, that I also will received 10% from what UKYO pays in the future.

Just for a update, I have talked to a lawyer who specialize dealing with debt collection.
He said ,that if UKYO has really taken user's fund and not intend to return, he will going to jail because this is a criminal behavior.  

and he can't hide any fund, because all BTC transaction is traceable ,right now, the only things concern me is the cost legal fee.

If going to sue him alone, it going to cost me 20-30K dollars, so I still looking for more people to join me ,become a group people against UKYO.

If anyone interest on this you can PM me ,with how much he owes you.

all cost relate to this lawsuit we be shared proportionally by joint people.

I am totally agree with this, and I will fly to Dallas by this sunday ,and have a pointment with a lawyer by the following Monday. I think I need someone to gathering all people to against Ukyo, not only myself. However because I am not living USA, It is really costly for me to fly from London to Dallas again and over again.

How long do you plan to wait before you would consider that your money has been stolen. It has been about 3  months. So what then, wait another 3 months? 6? A year even?Would you even then, after a year, start to suspect your money was stolen? All the indicators point to this being the case, good luck with Jon coming back in the future and returning your money  Undecided

It's a tough choice. He claims he has the money invested in new business ventures and that those investments should eventually return a profit allowing him to pay back the loan. Unfortunately he won't tell us what these ventures are or what their status is.

Since he has owned or ran several businesses in his life, he likely has some assets. If you sue him and he declares bankruptcy as a result, you won't get his house. The courts will likely let him keep that. But you may get something. After the lawyers take their giant share though. Before you do that, you should get a good idea of what his assets are.

I think I am still ukyo's biggest creditor, and I'm one of many. Ukyo's total liabilities are estimated at $2-$3 million between ukyo.loan and bitfunder. I'm getting a bit frustrated too. The well over hundred thousand that ukyo owes me would definitely make it worth my time to get the best lawyer I could find if I decide to go that route. Whatever you do, make sure you've thought it out very clearly first. You might end up costing yourself more money that you get out of it.
Do you want to join me with this ?the total liabilities from u and me  is around 40k USD, and the legal cost for two of us should be the same as only one .  it is worth to give a try, I think stay and waiting here would be useless.  what you think?

I would, but I haven't decided definitely to go that route yet. I sent a message to ukyo a few days ago and I'm going to give him a chance to respond first.

I would give him more time thought, the cost and time I spend to Dallas isn't cheap , but Ukyo never reply My message, I do not know about u ?did he reply to u ?

The last I heard from him was at the end of January. That was before the MtGox collapse. If his new business venture was taking over business for MtGox in the US, then that is all lost now. In that case, the only thing left to do would be to contact our lawyers and force him to liquidate his remaining assets to pay off the loan. There is a possibility that his business ventures were not tied to MtGox, but until I hear from him otherwise, I'm going to assume that that isn't the case. I messaged him about two weeks ago and I haven't heard anything back yet. I'll give him another week or two. I'm sure he is really busy but he should at least be able to spend the time keeping in contact with his creditors. The total value of ukyo.loan is still well over a million dollars.

I am going fly to Dallas this sunday, I have contact with a attorney already, I made a pointment with him by monday morning, Hope I can get some wise suggestion from him.

  I am plan to fly to Dallas on next Monday, before that I really hope to find a lawyer to discuss about this issue . however I have send out plenty of consultation requests form to these law firm companies in Dallas, none of them had been reply-ed. I am really kindly asking all of people who watching this thread to introduce a lawyer in Dallas to me ,I will try my best to helping us makes Ukyo pay us back through legally matter, to deserve what he should .
