I'm pretty sure this isn't the only case of this happening. I distinctly remember many others having similar issues when there price spikes.

They would get denied their price if the price rocketed right after their purchase. Of course this is just from my memory of people's posts, so don't quote me on it.

ok so there is a 5 minute extension for ever bid placed within 5 minutes of the previous bid.

Once a 5 min time span passes the auction will officially end.

If he was dead that doesn't change the fact that he could have given access to the private keys to someone he knew or trusted.

Private keys and bitcoin don't care if you are alive or not. Only if someone alive who has access to them.

Easy just add a '2' and replace the '1'.

Couldn't you just use poloniex to get monero bought with BTC, then send it to yourself with a mixin of 5 or 100 or whatever you choose, then convert it with XMR.to back to BTC?
