Hi all,

I've received a message from a member of this forum and a victim of this scam. Please write me at paul.madore@cryptocoinsnews.com if you would like to be quoted/included in the story I write about it. It will be a lengthy one and won't be published for a few days, so you have some time to gather your evidence and send it my way. Screenshots and original e-mails are great.

Thanks!

@bitillionaire - The article covers almost all the story, though the central point
should have been given more prominence. The promises made by bitmine regarding the
refund included a ten percent penalty to be paid if the equipment cannot be
delivered on time. Leaving the engineering and the legalities aside for the moment,
any company that promises to pay out more than it takes in has to be a ponzi
scheme at at some point - that just the mathematics.

That makes the people running Bitmine either fools or knaves and perhaps both
at some point in time. And that's aside from the currency risks they ran that became
fact because of bitcoin's fall in value post November 2013. Order in November,
receive a refunded pay out x5 bitcoin the next year (in your dreams ...).

The question I would ask of Bitmine is where did the money come from to recapitalise
Bitmine early in 2014? Around the time that Georgio was hinting that his customers
were investors in Bitmine?

Just what does it take to get the Swiss to investigate one of their Companies?

Perhaps I will get these answers soon, I'm awaiting a reply to a request ...
then I get a lawyer ...
then ...

If you get any answer from the Swiss and going to add a lawyer i will join you. Perhaps if you want some other people will join and we can sue him for more.
I will take a look every day on this forum as allways.

I have a case ref. from CYCO and have contacted my local embassy.

As someone that has stood up and been counted, I suggest you all do the same.

This is a good place to start if you have une peu d'Francais

https://www.e-service.admin.ch/eschkg/cms/navigation/Betreibung/99_index_html_fr/

Unfortunately, there seems to be no English version, the alternatives
are German and Italian. You will also need a Swiss postbox to fill in the
online form. With the form completed, you download a pdf, print it,
sign it and post it to Switzerland.
And Wait ...

I'd suppose that most of the recent posts belong on a legal forum, but
until cross-posting is enabled, this is the only game in town.

Still no response from the Swiss authorities, still waiting ...

I received a reply from CYCo stating that they were sorry I had lost my money, but that they were "somewhat removed from the prosecution process" and that:

" - if the conditions of fraud are fulfilled according to Swiss law (art. 146 CP), you have the possibility to file a complaint to the public prosecutor of canton of Ticino (Ministero Pubblico, via Pretorio 16, 6900 Lugano). You will have to give all available information's and clearly explain the case (name, address, facts, documents, etc.);"

They state that it should be possible to conduct the complaint with the public prosecutor in English.

I am going down this road for now.

Some news about my case. I'm not doing a recap, it is pretty easy to click on my user name and see what i already posted here.

Bitmine did have until the 14th of april to give their side of the story and documents to the judge.
They did not send anything, so we are going to continue the process. Should be done in less than a month.

This is the last step (3/3) in the legal process, no more avoiding your responsibilities Giorgio.
We are gonna shut you down !!

BTW I tried, for curiosity, to call Bitmine once a week this last month.
They never picked up the phone, maybe I was calling when they were too busy running away.

Can everyone please leave untrustworthy remark on Giorgio Massarotto.  His profile is at this link: https://bitcointalk.org/index.php?action=profile;u=113395
Click on the Trust link from there and add a negative review.  I think enough people do this he will be banned from BitcoinTalk.  He doesn't deserve to be on here and we need to unite to get him kicked off this forum.

Also just in case you were wondering what this guy looks like here is a picture of him.  He is the one on the right side.  If you live in Europe and/or Switzerland keep an eye out for him that way if you see him you can confront him.

They rightly should along with a number of other threads.

Final step in my legal process planned on the 3rd of june.
Swiss justice is slow, but I hope it will be efficient.
