I'm a very large shareholder, and I would be strongly against any legal action at this moment.

We are finally seeing some movement by Ken, and I think it is best to give him time to keep the momentum going.

We now have our shares, mining is happening, there is improvement.

We still need to know more, and for more to happen, but now is the time to allow that to happen.

If it doesnt, then we can revisit thoughts of legal action.

Taking action now would be shooting ourselves in the foot, and a sure way of killing any hope of return of wealth.


I would agree. Since shareholders can now exit, it would not make sense to take legal action, from a financial standpoint.

As soon as my shares are listed, I'm out. I simply don't see this venture succeeding. He has made improvements, but the communication issues alone are too much. Customer service is a mess, and who knows where the financials are?

this company could use a little improvement in public perception right now if you want the share price to rise at all.
I know Ken is MOSTLY 99.9999% responsible for this and doing a lousy job... but threads calling for lawsuits don't help either. you should probably delete. Its not like he is Kenilworth, who outright took money and disappeared... ActM is simply a poorly run show, sorry to say. Let it do what it does and hope for a little "uptick" It's better than zero.

OK guys, like I mentioned above I have been having a hectic week with little time available for this, but here is what I have so far;

start here > http://www.asic.gov.au/asic/asic.nsf/byheadline/Report+misconduct+to+ASIC?openDocument > scroll down to the "making a report" section and click the "sample reporting form" because the actual report must be completed in one session and requires all sorts of infos about the "where when who how and why" regarding the dispute plus contact info for yourself. I'm gathering together these infos now and will attempt to compile it into a report ASAP. Its way more complicated than I thought, but it is the only recourse outside legal action available to me, and since I only lost a relatively small amount on this piece of crap I wont be going to any lawyer. they do suggest contacting the police in kenilworth's jurisdiction as well as a few other regulatory bodies that I am unfamiliar with. all this is laid out clearly in the form, so look at the sample and see what you can here http://www.asic.gov.au/asic/pdflib.nsf/LookupByFileName/Report%20Form%20Sample%2028102013.pdf/$file/Report%20Form%20Sample%2028102013.pdf

It tells you all you need to know, what you need to do etc. IF THEY RECEIVE ENOUGH OF THESE ONLINE COMPLAINT FORMS THEY WILL CONTACT THE COMPANY WHO IN TURN IS FORCED BY LAW TO COMPLY.

REMEMBER; do not click the actual form until you are sure you have everything you need as laid out in the sample (almost all the info is also buried in ASIC's website, such as Kenilworth's corporate registered info, name, location, serial number etc. which you can find here http://www.asic.gov.au/asic/ASIC.NSF/byHeadline/Search_business_names by searching "Kenilworth" in the "business names index" (first link on the above page)

This form is a lot of clerical work for everyone who fills it, but I am on the job of doing my copy now and you should too. I'm sick of the BTC investors sphere being abused, and I feel it is contributing to the overall negative image of BTC itself and must be dutifully held to account by all BTC backers, believers, and fans or the FUD will continue to grow and eventually every n00b will only ever hear about scams and burns and eventually dismiss BTC altogether, and there will be no argument against!

This thing is going to take me a while to complete, I hope you guys are attempting to navigate the process as well because some of this legalese stuff is Greek to me so if we can compare notes we can figure it out together. Any help or guidance on how to best complete this form could make filing a simple process for all, then maybe we could see some Australian mining exploration scammers burn and provide a win for BTC's tarnished name.

Anyways, my personal dramas continue here and I will have to wrestle some time to go over this more thoroughly, so check back here mid-next-week and I will share all the pertinent info I gather.

There's incompetence, and then there's just plain stupidity. This is an example of the latter.

1. Sign up on Bitpay. Use their start package with 1% fees if you're just testing, or pay your $30 a month for no fees.
2. Download their Prestashop plugin from here or clone from the github repo
3. Follow the 5 steps required to install and configure it

Oh look! You now accept Bitcoin! And it pays out in USD and/or Bitcoin in whatever ratio you like!

Do you want me to invoice you for the time I spent explaining this? Or better yet - fire your "project manager" and hire someone that has 2 braincells and we'll call it even.

If anything, now is the time to let the cheerleading to begin. hype this thing now. This is just a correction caused by all who lost hope ages ago.

Other than taking forever to get the shares up and ken being very poor at communication active is doing well. A few decent div payouts and continuing sales and hash rate growth and people will forget about all the bullshit

ALL engineers, especially computer engineers SUCK at communication. ALL chip manufacturing is fraught with delays.

The lawsuit died in utero , the MSD thing is moot, the trolls were having a hey day.

You didn't expect this thing to fly to the moon right away did you?

If you can report back details on how you filed a complaint and the result you got, it would make it easier for others to follow your lead.

I have been horribly busy the last couple days with some very serious family matters, so I will get to it either late tonight or tomorrow. I have perused the ASIC website and see that it is difficult to navigate (like every gov website) so I'll keep detailed notes on where to navigate and post easy to follow directions

Don't be ridiculous.  You gave your shares to Ken, and he doesn't want to list them or pay you dividends.  He simply conned you again.  There's absolutely no evidence of any investigation beyond Slaughter's own claim.  Shares in Active Mining are trading on CT right now.

don't try and make this an ActM thread. I simply used the analogy to point out the repercussions of bringing the authorities in on Kenilworth.

Here are some points from the "complaints" page of the Australian Securities and Investments Commission.

OK guys, if you have a stake in this jalopy you must have an opinion as to what needs to be done. My vote is to go to the Australian authorities. We probably wont get any funds back, but these scammers will feel some heat and hopefully not perpetrate this sort of bad faith dealing in the future.

to tell you the truth I have been hesitating to file the complaint.
I will explain by way of the example of another contentious security in this forum, namely ActiveMining. I also have a position in ActiveMining, who recently had a complaint filed with their local regulatory body, and that has only resulted in all shares being untradeable, thuslty screwing all the investors, whether they had faith in ActM or not. Needless to say there are some pretty angry investors out there.

Activemining has had problems getting their act together, but now it seems they are delivering on their promises...EXCEPT for getting shares online, but because of the actions of one disgruntled shareholder, everyone is out in the cold.

In comparison, Kenilworth has basically disappeared (no replies here, or from direct emails) so it is not fair to compare them. Activemining is actually trying, Kenilworth looks like they are simply a thief...so I would like to complain, and would advise all shareholders to do so, BUT ... I do not want to act alone and then bear the wrath of members here who feel they should continue to be given a chance.

maybe we should have a poll? Are you invested in this apparent scam? would you like to see actions taken vis a vis complaints to the Australian authorities?

I have a very small stake in this shitty mess, so I am not desperate to recover funds. I invested in good faith for the novelty of the idea and to support this sort of BTC/real world investments direction, but I feel like I have been taken for an ass.

Put your feelings regarding filing of complaints in here and I will take it from there.

If you can translate, or edit texts, or if you have some graphic design skills there are plenty of jobs you can do from home, but don't expect to get rich.

A few years ago I fell in with a crew of guys who showed me how to exploit a loophole in Google's AdSense program whereby I created a blog, monetized it with AdSense advertizing then entered a pool where we would surreptitiously trade clicks for clicks. There were a series of evasive maneuvers that we each did to deceive the Google algorithms into thinking these clicks were legitimate and from different people every day as well as various methods to inflate SEO and page views.

Believe it or not, after about a month of getting all the elements in line and attaining regular click-through-rates and cpc I was making anywhere from 5000 to 8000 USD a month. It took Google almost 2 years to catch on and then the whole click-fraud ring got b& for good, but not until I had earned over 75K (would have made more, but I regularly took time off to travel using my ill gotten gains). Also, no one ever got prosecuted. Google would rather protect its image in the eyes of their advertizes than admit how pervasive this form of fraud is, plus they would have to reveal the algorithm they use for detection if they were to take any of us to court, so they just ban you if they catch you and that's the end of it.

 It was fun and I made a ton of lulzy new friends in IRC. In fact, it was the first place I ever heard of bitcoin and due to these anons I became an "early adopter" buying a modest amount of btc on speculation because of their advice. I wish I had bought 10X as many, but still, I got my first handful of btc at under 10$.
 I was laughing every day, especially whenever I saw ads selling "make easy money online" scams, which, In case you were wondering NEVER make you one cent unless I click them on your fake blog for you  Wink

I never had a problem with to and too, but I can't seem to ever spell their correctly. I never confuse they're, there, and their, but I have to stop and remind myself every time I write the possessive their because my instinct is to always spell it "thier"

worrying about it just seems to continue the confusion and "i before e except after c" does not apply in this case. I guess I could be dyslexic, but that's KO with me!

with the amount of unedited text I read every day, from strangers on forums who may or may not be native English speakers, from auto-correct mangled text-messages, to outright intentionally misspelled phrases like "teh funneh" I stopped worrying about correct usage a long time ago. Any grown man who bitches about spelling and grammar obviously has no penis or testicles.

also-I find many non-native English speakers to actually posses greater and more elegant grammar, spelling, and overall English usage skills than most mono-lingual North Americans. We simply lazy.

Actually, BTC will go to da moon, but it will get there by drilling straight down through the earth, emerge out the other side straight up to the sun, through the sun, across the galaxy, into a black hole, until emerging in a parallel, mirror image universe retracing its previous route all the way back through the hole it made in Earth and out again until this time it actually is directed at our lunar satellite.

In other words, it will take the scenic route.
