So then you think it's perfectly legal to "sell" a product to a customer and then NEVER deliver his product OR refund their money?

No, of course not. But your statement is a straw man. Clearly, BFL has delivered their products (albeit pathetically late). You seem to be insinuating that they never deliver their products, ever. That's simply not true.

I was specifically speaking about the case linked below (the one that the troll I quoted was speaking about) and responding to him about this case directly.  Of course BFL has delivered product (lots of it too) but reportedly not to this person.  I would have thought it clear since everyone know's that BFL has shipped merchandise that I was speaking about the case at hand and not generically.  It wasn't a straw man bro, was a comment on this specific case.

Without the link or ANY kind of context in your post, it was absolutely a straw man.

Well I'll have to disagree with you I posted my response to a quote.  The quote I responded to mention this case specifically.  So I responded to something about this case in a thread about this case, I don't think it's unreasonable to assume the comment was about THIS CASE and not a generically blank statement about something that is pretty clearly not accurate.  You threw in all customers not me.

Would it have left less ambiguity if I provided the link, possibly, but the lack of the link doesn't change the intentions.

Personally I doubt this lawsuit is going very far,

So then you think it's perfectly legal to "sell" a product to a customer and then NEVER deliver his product OR refund their money?  What fucking planet does a stupid troll like you live on??

You will get to see first hand if this ends up in a court room that all the FTC rules we have been quoting for months are going rip BFL a new asshole.  For a genius your grasp of very old and very tested consumer protection laws is incredibly lacking.   If this hits a court room BFL will lose, probably not the full 5 mill the dude is asking for but he will win much more than the 60K BFL owes him by law already.  And as for you laughing at the guy because he is asking for so much, do you even know how this shit works, that is exactly what you do, you ask for the absolute maximum you can think of then either settle it down or work it out with the courts to determine a number set by the court.

You're a stupid troll, will be fun to laugh at you and BFL when they get a good schooling I can't wait!!!!!!!!!
1624  Other / CPU/GPU Bitcoin mining hardware / Re: {BFL} Bitcoin miners sue Butterfly Labs on: February 06, 2014, 02:06:23 AM
How come they miscalculated their development time again. It being their 3rd generation miner I would have expected better.
Maybe it's their business model.

It's a good thing I didn't order from them again.

At this point it isn't miscalculation what it really is, is fraud.

His lawsuit, filed in December 2013, accuses BFL of breach of contract, fraud, and negligent representation.

SOOOOOOOOOO much pure win in that lawsuit, it will be funny to laugh at BFL and there fanboys.  Interesting how the lawyers cites all those FTC rules some of us have been going on about for the last year and a bit.

Good fucking bye and good fucking riddance you scum bags now it's time for you to understand what the real world thinks of your illegal business practice and your ignorant attitude.  You are going to get a well deserved lesson in reality that I suspect a lot of people will be happy to see.

All my opinion.

Back on topic, another write up.  More people calling up this lawyer.  BFL is about to be taught a lesson in how retail operations work in the real world and I can't wait to laugh my ass off at them.

Hey Josh LOLOLOLOLOLOLOLOLOLOLOL, couldn't happen to a nicer bunch of fucking scammers!  You better pray to everything you know and love you win this case or that shit sack of a company you work for is going to be gone!!!!!!!!!!!  If enough of these go through the authorities will have no choice but to do their own criminal investigations.  This has the potential to get real good.

This part was special:
“I think it’s pretty disingenuous to say it’s [Meissner’s] fault,” he told Ars. “If he had never e-mailed, what were they going to do? Were they the kind of people that were going to keep $63,000? It’s funny, the blame-shifting game they’re playing. I find it distasteful, the lack of responsibility.”

Funniest part is the answer to the question is absofuckinglutely YES of course they would have LOLOLOLOLOL.

All of this is my opinion though!

All of these new people wanting to get in when it's too late. Go buy some Block Erupters.

You know you're 100% right, too bad for him he wasn't around when HashFast was selling miners for 50+BTC that when finally delivered will be lucky to mine half of those back even with the MPP like oh sooooooooooo many hero and senior members did...
1627  Other / CPU/GPU Bitcoin mining hardware / Re: Can I use X1 to X16 Riser in a Full x16 Slot? on: February 05, 2014, 01:36:22 AM
my motherboard has 3X PCi-e x16 Slots   and 2X pci-e x1 slots.
I want to get 5risers like these, but was wondering can you use these x1 to x16 risers like these in the FULL pci-e x16 slot as well? I know there are x16 to x16 risers but I have heard they are bulky/crap and its trouble buying them..

anyone can confirm that these x1 to x16  works in full x16 slots?

I have it set up exactly as you describe in my rig and it works fine.  Actually I have the X1 rsier in a full X16 slot and another in a full X8 slot.

So,feb-march-april-maybe in may is 2 months Huh  Looks like 3 months at least if they do deliver by may 1st   Roll Eyes

The original ship date was the end of Feb not the beginning. No one ever expected to see shipping before the end of Feb, if you did you where completely oblivious. So you math is a bit off, April-May(be) is 2 months.
Has anyone ever shipped on time?
Seriously, has anyone ever shipped on time?

I stand corrected,starting from march 10th,april 10th-may 10th is 2 months extra waiting..............

My orders are 1st batch,so yes I expected feb 24th to march 10th as my ship dates

Yes ASICminer-no delays,KNC-1-2 weeks,MBP-1 month I think,I'll be corrected,I'm sure  Cheesy

Everybody always leaves out Bitmain.  Selling and shipping only what they have in stock, those lads deserve some credit.
1630  Bitcoin / Hardware / Re: Official BITMINE CoinCraft series 28nm ASIC miners thread on: February 03, 2014, 01:06:45 PM
So did anybody find out if just the Desk line is going to production or is the rig line starting production as well?

Are we going to have another BFL where rig customers have to wait forever in a day to get a machine??  Roll Eyes

Both! did u read the new?

Actually yes I did read the news.  Reading the news is what prompted me to ask the question.  You see some of us around here have seen the games these manufactures play with words.  In fact they got you on just that.  See Bitmines responses above me and you will see that you thought based on their "new" they would ship at the same time.  In reality rigs are delayed by at least 2 weeks over desks.

Many of us have seen this play out a number of times already and as such we ask questions based on our past experience.  In this case people who paid for Desks AFTER people who paid for Rigs will have their unit shipped first.  How were those first customers to know this?

This is exactly what BFL did and it rightfully pissed A LOT of people off.  Bitmine should have been upfront stating CLEARLY that Desk and Rig units are different Q's

I think the reason for people calling us a SCAM is that we've didn't post any real pictures, videos, etc.
Thank you.

And I think the reason people called you a SCAM is because you are a SCAM.

Now that BFL product is available for purchase at Tiger Direct, I wonder what TD would say about selling an apparently non FCC certified electronic device?  Anyone got a couple of minutes to send an email off to TD??

Since your digging around, why not look into those apparently cheap ass fire hazzard PSU's BFL is shipping with their miners, are they really UL approved, a logo is pretty easy to attach and there are some pretty shady suppliers around.  Not accusing them of anything just asking a question.
1635  Bitcoin / Hardware / Re: {BFL} TigerDirect is making a BIG MISTAKE partnering up with Butterfly Labs! on: January 31, 2014, 09:15:54 PM
I wonder if Tiger Direct cares that they are now selling apparently non FCC certified products?

I also wonder how the hell the PSU they ship got a UL cert.  I wonder just how legit the UL cert is...  Anyone care to dig into it?

Can we get a direct official statement from Miner Source for their customers, will refunds be offered for B1 customers?
1637  Other / CPU/GPU Bitcoin mining hardware / Re: {BFL} Bitcoin miners sue Butterfly Labs on: January 31, 2014, 04:06:10 AM
I am going to guess BFL's strategy will be to either delay this as long as humanly possible and then settle and gag this guy or settle and gag him ASAP.  I also guess BFL never wants this to see the inside of a court room.  However if both sides dig in for a battle it will extremely interesting to see what discovery will bring to the surface  Smiley

Jez,

Will I ever be able to fund my PKR account with BTC? Smiley

I sure hope so one day!  I'm a Bitcoin fan of course. But we need our regulators to agree. And I think there's a good chance. Maybe in a year or two.  We're regulated in Alderney and they're actually quite pro bitcoin and think progressively. So fingers crossed!

Alderney?? Really, fuck that, those bozo's couldn't regulate my arse...  These Asshole's IMO let Lederer, Bitar et all get away with running a sinking ship WAY to long.  They we're against segregated player accounts.  Fuck these pricks IMO they do not have the little guys interest IMO, it's IoM or bust baby!!!  Thank god for PS or I would have been out a decent chunk of change...

Might as well throw the KGC in their as another joke regulator...
1639  Bitcoin / Hardware / Re: Purchasing ASIC Mining Chips on: January 27, 2014, 12:41:51 AM
Ok. Why can't one just buy the ASICs that have already been designed, then by the PCBs to accompany them and the other parts, ie. PSU, coolers, etc. The big question is, can I approach Global Foundaries and ask to buy 100 of the ASIC chips manufctured for someone other company and then approach the PCB manufacturer and buy the same boards manufactured for that chip. Don't want to reinvent the wheel, just want to purchase some.

What your asking is for the Fab to steal their clients IP and sell it to you.  It is not going to happen bro a fab would go out of business if they ever tried to do this not to mention legal issues.
1640  Economy / Service Discussion / Re: Butterfly Labs Nimbus Cloud Mining Service $40 a GH on: January 26, 2014, 09:58:15 PM

https://products.butterflylabs.com/homepage/nimbus-mining.html

BFL has now started offering Cloud Mining for $40 a GH

Talk among yourselves.

Try not to laugh
I'm trying not to laugh at your stupidity... BFL ain't selling this...

Next you'll be saying TigerDirect is a shill company for selling BFL products.......

Really?  For a genius you can't read to fucking well...  Here let me copy and paste from BFL's website for you so it's a little easier.

Purchase Terms:  NimbusMiner contracts are served by nimbusminer.com.  Butterfly Labs (BF Labs Inc.) acts as the hardware supplier and the retail sales agent for this mining contract product.  Support and service is provided by nimbusminer.com.  NimbusMiner hardware is provided from either off the shelf 65nm products or from NimbusMiner's own 28nm hardware as it comes into service from it's own pre-ordered purchases of Monarch chip production.

BF Labs is absolutely selling this and they spell it out in plain old English so even super intelligent people like yourself can understand it.
ROFL, You highlighted it yourself: RETAIL AGENT.  BFL is doing for Nimbus what Tigerdirect is doing for BFL, acting as a go-between.  BFL didn't set the price, they are just advertising it, yet you and all the other fools are all like "BFL is so stupid for setting this price at 4x what the monarch pricing per GH is".

Contine to play your little word games, you trolls love to twist things that you don't understand.

I'm still laughing at your stupidity!

For someone with a self claimed IQ of 138 (IIRC), you sure have a poor grasp of comprehending written English.  Your posts and general contributions to this forum lead me to believe you're closer in intelligence level to say a retarded donkey than a normal human being let alone genius.
You don't remember correctly, but then again, I don't care.  Let me break this down into kindegarten for you:

1) BFL is not hosting said service
2) BFL is not setting the price on said service

If I were to use YOUR logic, then TigerDirect is owned by BFL since they are offering BFL products.  Or, conversely, BFL is owned by TigerDirect as TigerDirect is selling BFL products.  Have you seen the stupidity of your ways yet?  Nah, didn't think so.

Hey shit for brains feel free to highlight where I suggested, implied or said that BFL was hosting said service or that BFL was setting the price on said service.  I was simply correcting your lie when you said BFL was not SELLING it, which any non retarded person can clearly see they are.
