281  Bitcoin / Legal / Re: Question about capital gain. on: March 27, 2024, 12:06:21 PM

The loopholes exist because most countries haven't completely legalized cryptocurrencies and most of them will not accept crypto nor bans it but keep it in the grey area. This is a major reason why there are no clear rules and people find a way to bypass the crypto tax. Also at some points, the decentralization nature of the cryptocurrency makes it harder for the government to enforce everyone declare their crypto assets honestly.
In my country there are no laws that oblige citizens to pay taxes on cryptocurrencies, but there are laws that require citizens to pay taxes on income.
Those who do not want to pay taxes exchange cryptocurrencies for cash. But you have to be careful here and then do not spend this cash in banks, so that tax inspectors do not have unnecessary questions for citizens.
282  Bitcoin / Legal / Re: Gary, tell us what is Ethereum? on: March 27, 2024, 12:00:13 PM
https://cryptobriefing.com/gensler-confusion-ether-gop/
"Two GOP-led House committees seek to demand clarity from the Securities and Exchange Commission (SEC), specifically chair Gary Gensler’s position on Ether (ETH) as a security.

The House Financial Services Committee head, Rep. Patrick McHenry, and House Agriculture Committee Rep. Glenn “GT” Thompson released a press statement to query Gensler over the regulator’s overdue stance on Ethereum.

These actions came after Prometheum announced last February that it would begin offering custodial services to institutional clients for Ether. Prometheum will work on this offering through its subsidiary, Prometheum Capital, despite the SEC and CFTC recognizing ETH as a non-security digital asset.

“Your unwillingness to clarify the treatment of ETH only exacerbates the confusion and uncertainty regarding ETH’s classification […]” the lawmakers said.

The SEC’s longstanding ambiguity on whether ETH is a security has further fueled the uncertainty surrounding this issue. The SEC has rather famously withheld defining Ethereum, in contrast with other cryptocurrencies. Now, the regulator might be pressured to actually define Ethereum, which will have broad effects on the cryptocurrency industry in the U.S."

https://cryptobriefing.com/gensler-confusion-ether-gop/

The Alliance Of Bitcointalk Translators, и я не знаю причины, зачем он туда зашел со своими советами. Тема с обвинениями была позже конфликта.

larry_vw_1955,I think that if someone suddenly starts living like a millionaire, then the tax office will have questions for him, regardless of the checkmarks in the old declaration. The tax inspector sees a person’s official income, and when his expenses exceed his income, this will be a reason for an audit. The only way this is done in my country is that you exchange cryptocurrency for cash and rent luxury real estate and Lambo for cash. But this method also has many disadvantages.
289  Bitcoin / Legal / Re: I need help/advice on how to efficiently recover money invested in an ICO on: March 24, 2024, 10:53:37 AM
This is the right start. Fraudsters usually have an exit plan in mind, and I have often seen scams with the same company names. They can register companies with the same names for completely different people or register a company that will be similar in its activities to a decent company. And in such cases, the chances of getting the money back are zero.

The laws in registering a company are so shit that you can even register a company in a few countries without even being in that country. I saw a few YouTube videos on how scammers, money launderers, and even politicians can open up a company in the UK without physically being in that country. This news was alarming to me as many Indian businessmen who could not repay the debt of banks have left India for the UK. If this is common in a first world country then imagine how a third world country works. In my country to form a company it takes more than 2 months and then bribing is still common if we need to expedite the process.
In my country it is also possible to open a company without the presence of the applicant, but this will require a notarized power of attorney, and the person must issue a power of attorney in my country.
In this case, I have not yet understood who owned the real estate, but it seems to me that the company Platform Ltd, which is registered in St Vincent and the Grenadines, did not own anything, but only received money.
290  Bitcoin / Legal / Re: I need help/advice on how to efficiently recover money invested in an ICO on: March 23, 2024, 09:04:50 AM
There are two things that I can see in this issue and the first one is that they were paying you rent. The amount and for how many days/weeks/months you have received it is not mentioned in your topic. The problem started happening when COVID hit and there was a lockdown, which is considered a natural global disaster as it happened globally. Now, my question to you is how would you like to challenge a global disaster that did affect business or organizations. Some countries that are tourist destinations are still not able to get out of the problem they faced 5 years back due to COVID.

The next problem is that under liquidation, you cannot ask for money that is already starved. This is not a case where you can spend thousands of your money to get that amount which I feel is practically lost. You can talk to a lawyer and try to find a loophole in the law that can only help you in getting your amount back. I am certain that you have already done that and that is why you have come up with this topic to find out if anyone here has gone through the same situation. Which might help you in finding a solution to your problem.

I am currently researching my options and trying to figure out in which country I should be looking for legal representation.
There are enough clues to suggest it was an exist scam. It will take hours for somebody new to absorb all the information related to the case.

The main thing is there are assets (properties) that are still standing and being used to generate income. I know the exact buildings, locations, etc. They are listed on Booking.com and on the developer website too. I have copies of the deeds/titles of said properties.
Have you found out who owns this property now?
How many owners of the property changed after the company went bankrupt? If this company sold the property to affiliated parties, then you have a chance of creating legal problems for the owner, but if the current owner is not associated with the company in which you invested and is a bona fide buyer, then you have very little chance.

I have not yet, I am just starting this journey.
I found some related Thai legal services on Fiver, which might help me get that information.
This is the right start. Fraudsters usually have an exit plan in mind, and I have often seen scams with the same company names. 291  Bitcoin / Legal / Re: Do Kwon arrested on: March 23, 2024, 08:53:34 AM
Most likely, the issue of Do Kwon's extradition will be decided by the Constitutional Court. In my country, this is a very long undertaking, and since the Constitutional Court is very busy, cases can last for years, and if desired, this process can be extended. Stocking up on tons of popcorn Smiley
292  Bitcoin / Legal / Re: Argentina to Pressure Citizens on Declaring Their Crypto on: March 23, 2024, 08:44:36 AM
But how does the law work? A person is randomly checked somewhere at an airport, train station or other public place, his phone is checked, and it turns out that he is an active crypto user who does not pay taxes. It’s even worse when it turns out that he is a member of groups that oppose government power.
And after this, all laws and large fines will begin to be applied. Such cases are constantly published in the press to intimidate the majority. This is how this tactic works.

A phone is personal property and i don't think anyone has the right to check the phone  Shocked
Such things do not exist in our country but even still if it exists that not a perfect way to know how much crypto a person own. There can be a situation in which a person has installed a Binance app on his mobile but he never deposits or trade  Huh

If people in my country knew that their cell phones could be randomly checked at public places by authorities we would never install any app on our mobile phones and keep our crypto-related activities through our laptops at home and use a good VPN so the ISP couldn't even track our activity either. There are many ways to hide our crypto assets and the government cannot track how much people have in their personal wallets.
Of course, we live in different countries, but you shouldn’t be so naive as to think that someone has the right to check your phone.
Of course, this is not the way to fight cryptocurrency users. Thanks to this method, the police are fighting drug pawners who place these drugs in different places in the city.

On your phone, inspectors can find the Binance application. This is the first flag. If you are subscribed to communities of crypto users, then this is the second flag. If you have crypto wallets installed, then this is the third flag. And then a specialized specialist can take over your case legally.

That's my opinion which is why I have delayed advising the people asking me to do hi end escrow amounts unless they can get into a direct relationship with coinbase. I do not see the 1-3% fees working if they get 100 'bad' BTC coins in an escrow.

In addition to direct purchase from miners, it is possible to get "clean coins" if they are bought at auctions - and the US has a considerable amount of seized BTC that it occasionally sells at auctions.

However, even if clients would buy 100 BTC through the OTC of one of the well-known CEXs, wouldn't that be a sufficient guarantee that that BTC is "clean" enough to not have problems with it in the future?
https://cryptonews.net/news/bitcoin/28718789/
"The U.S. government’s holdings of 210,392 BTC worth $14.4 billion make the country one of the largest holders of the coin.

The head of CryptoQuant, Ki Young Ju, noted that the U.S. Department of Justice, the Internal Revenue Service, and other departments have not sold a single Bitcoin (BTC) since July 2023. The government’s unrealized profits increased 2.4 times."

I would say that such auctions do not happen very often.

Nigerian Court Orders Binance to Relinquish Data of All Nigerians Trading on Its Platform: Report
The interim order comes after an earlier report that Nigeria wanted Binance to give information regarding its top 100 users in the nation and all transaction history spanning the past six months.
The Nigerian government understands that it will be very difficult to get money from the Binance exchange, but it is very easy to check the activities of large traders and fine them.
Most likely, the data will be provided and demonstrative floggings will begin. This is why I don't like large exchanges. Even if everything is legal with you, verification of crypto-exchange and banking transactions cannot be avoided.

297  Bitcoin / Legal / Re: IRS taps into strategic hires from private sector to improve crypto tax enforcem on: March 22, 2024, 12:58:30 PM
Every tax authority around the world hires people from private sectors or contracts with the consulting companies to strengthen their operations and enforcement power. It's no surprise that IRS did the same to bring in talents to help them operate more efficiently.

The modus operandi of IRS is very clear on digital assets. They want to come up with maximum governance to ensure no leakage in revenue. All the best!

I don't think this happens in all countries. The tax office in the country does not have the right to operate as a commercial company, and in my country this is impossible. To enter into a government contract with the tax authority, you need to have a lot of licenses and certifications, and as a rule, the state has a share in such companies.
In my country, most public corporations are managed by corrupt officials who are mostly appointed by politicians. Most of these agencies including the revenue collection agencies are not productive because most funds realised are out in private pockets. So it is commonly said that the government is not a good businessman. In order to get the best returns, the government usually signs contracts with private firms to run these agencies and bring returns. And this decision has turned out to be the best option for the government because these public companies are well-managed by private organizations.

Quote
The private sector is the part of the economy run by individuals and companies for profit and is not state-controlled.
Therefore, such cooperation must involve a lot of legal formalities, which are sometimes impossible to fulfill. For example, a private company cannot advise both tax and commercial companies, because this is a conflict of interest.
There have always been corporations and partnerships between state-owned companies and private organizations. It's usually called a mixed system or public-private partnership. Sometimes the government might not have enough funds to invest in business, they will always go into partnership with private organizations that can fund such projects. In some cases these private organizations are the ones that have the business idea and expertise and the government will have no other option but to partner with them. Like you rightly said it will involve lots of legal work that will ensure that the interests of both parties are balanced.
In my country there are also public partnerships, but this is almost the same, because any private company needs to fulfill a lot of requirements for such a business.
But this is a very large business where I have no experience.
After a certain period of operation of such a company, the state will conclude important contracts with it, which are not available to ordinary private business.
