I hate to burst your bubble, but in order to find out IQ scores, a parent had to accompany you to the principal's office.  When my mother heard mine she asked me if I had an off day... Mine pales next to hers.  Since you have no understanding of growing up in my situation, you also have no understanding into my character.  Your comments are indicative of how it would be were you yourself to impart that knowledge first.  For me, that number indicates I am lacking in comparision to my mother.

It's not a need, it's a fact.  It is not presented to impress, it is presented to paint a picture.  Facts are needed to know the whole story, without them all you have is bullshit.

Fraud is easier to prove in this case. All the elements of fraud are present in this debacle. We all need to contact the Department of Justice, FTC as well as write your Congressman. The more you shed light on BFL's practices, the sooner they will get investigated if they aren't under investigation already. So let Joshua and his minions of puppets keep trying to derail the thread and put doubt in your resolve.
Then get off your butt and stop posting!  Go file that lawsuit!  Let the lawyers be the only profiteers!!

I am neither for nor against it, I just feel that more facts than have been thrown out here need to be considered.
Can you list a few bullet points that need to be considered?

If you were standing in these folks homes right next to them. What would you advise as a course of action?
1) Research.  And I'm not talking the troll bait fluff that flies around this forum.  I'm talking honest to god research, like maybe private investigator type stuff.
2) Cold Hard Facts.  I use what facts I personally know and extrapolate logically, most of what I see if hate filled bashing with .01% actual fact being presented as fact.
3) Talk to a GOOD corporate lawyer.  Research corporate law as pertains to your intended suit
4) Look for similar cases in the past.  Have references to point to in order to get your point across.
5) Be willing to go the distance.  This is gonna cost MONEY.  Lawyers are NOT cheap.

I think you get the jist.

Retired after 20 years.

I don't think he's trying to make excuses for BFL.   I think he's a contrarian type of guy who enjoys some good rhetoric and is obviously pretty smart and probably educated as well.

I welcome guys like him - it's nice to be able to learn from others even if I disagree.  He makes a valid point even though the flip side of the coin is very true as well.  BFL did very poor planning and even more pathetic execution and very sad communication and tons of lies on top of lies.  Like clearing the backlog by end of August at a time when Josh knew their inventory potential.  There's no excuse for that - just like there's no excuse for running out of common easy to get power supplies.

They were a monopoly and thus acted arrogantly and carelessly like one and now they're gonna lose massive business to Cointerra et al, and deservingly so.

But that doesn't mean there isn't a contrarian view to all of this - there always is.

Who can show actual damages which cant be attributed to having 20/20 hindsight vision?  Meaning any argument along the lines of "well if i would have just been able to predict the future I would not have lost money" doesn't count. 

Actual damages is the lost mining income that resulted from BFL's failure to deliver in Oct 2012 (or whenever the latest promised date from BFL was when the order was placed). Should be a slam dunk case, since BFL is violating FTC rules (which are there to prevent this exact sort of situation).
In which case you would also need to know their exact orderbook at that time, along with the total increase in network speed that would occur prior to you receiving your equipment along with your current mining receipts from that time until now to prove you hadn't spent anything (since most will claim the 10x increase in BTC pricing as a loss as well). You'd probably need a lot more as well, like estimates on the drop in BTC price due to the flood of extra coins on the market while the difficulty tries to keep up while more than double the normal amount of coins is mined.

The BFL order book can be had with a subpoena. A June 2012 order should have been be delivered before any other ASIC, so it should be trivial to calculate from BFL's order book how much mining income was destroyed due to their delays.

Now how much did they make with non-asics while the shipping had not occurred?  They surely were mining already and have made steady BTC during the time their ASICs did nto ship.  What is the difference between them having shipped in Oct when the income generated from other means is factored into the equation?

In my opinion every mini rig that is shipped with a pay date later than the current single date is a stolen board from that production line (they use the same boards if I am not mistaken). Every single that is shipped ahead of the current 3rd mini rig ship date is stolen from that line.

They are absolutely not following their 1/3 shipping plan and they are just doing whatever the hell they feel to give the illusion of shipping faster or giving certain people benefits.

They way they are running this show is a completely retarded train wreck.

Furthermore their monarch line released last sat morning starts a whole new pay date regardless of your original pay date unlike current waiting line. The early numbers for that (people who supposedly will get the cards months before people who converted a day or two after the announcement) were sold out almost immediately..Gee I wonder who got the heads up on that....
