My identity has been public since day 1 of Bitcoin. Our pictures and identities are on the front of intersango.com. Our company info is on the about page which has a number and address. My house address is on google. We've run many honest services for 2 years now in bitcoin land.

On this point, I agree fully with genjix. And it is true that the claims process means a lot of work.
I just don't understand why it takes so long to pay out verified and accurate claims.

This is clearly unacceptable. After almost 2 months, 83% of people did not get back anything.

i didnt have anything in bitcoins, i had a very very small short position and the rest in cash, over 99 percent was in usd.

has anyone got usd payments yet or just bitcoins?

I am in the same disappointed mindset. I just transferred some funds to bitcoinica after hearing that they got registered as a financial service, so I thought it would be good idea to diversify. Obviously I was wrong. And unfortunately I did not receive anything back depsite all the reassurances that the claim is accurate since weeks.

I am opening up two polls here to try and help the community to reveal the status of the situation, also potentially to take legal steps in case there is no progress.

Nice to hear from genjix again. Finally, you are on the right track giving information more often. I believe transparency isn't just good for customers, but is in your own interest as well. I'm certain customers would have been much more supportive and understanding if you had tried to explain the confusion a little more, and a little earlier. If I were you, and I hadn't signed any papers yet, and realized I was blamed for something I wasn't even legally involved in at the time, I would have not been the first to take responsibility, either.

Nevertheless, let's get this over with so we can enjoy the summer and won't need to spend the rest of the summer reading this forum. Make Bitcoinica's customers good, even if it's only 80%, send more confirmation emails, give daily updates. Most will be satisfied and remember this as one big investment mistake, we can all go buy some ice cream, sit in a beer garden with public viewing and watch Italy, Spain and Russia make it to the semi-finals.

+1. I can only echo that genjix's more frequent communication is great in (re)building trust

They still need an audit to be taken seriously.  Independent as Mark may be, I doubt he knows better than to, for example, challenge the laws of physics and jump off a building naked to defy gravity.  I am sure the value of an audit is not lost on him... that is, unless it would report bad news.

I agree to the need of an audit for MtGox.

It is a risk for them not to do it. Even if it might take a while, a competitor exchange will come up that does not delay withdrawals and then they will see their market share go down. Look at Nokia and Ericsson. They were the leaders in the mobile business and are now nowhere any more as they have missed the train.

This is also a call for BETTER and VERIFIED and TRUSTWORTHY BITCOIN EXCHANGES.  If you do it right, you can get a major share in this growing market.

Couldn't have said it better.
Unless of course the fundamentals change drastically.

I'll admit I'm new to BTC, but in forex when (for example) a National Bank brings out the big guns, TA simply just fails.

TA doesn't work all the time here either. The market is too small, and it's too easy for someone with the capital to break the charts in their favor.

TA also works in these cases, because if you define support and resistances properly, you can (i) anticipate certain moves to a high probability and (ii) quickly jump on the train if it left the station, well before others can do. We have proven to be able to time this well since late 2010.
