I'll tell you what they can do. They can provide to a court that a report was filed, even if nothing happened with it for any reason. It somewhat shifts the onus onto the cops. This gives much weight when the court has some preponderance of evidence when they decide to file suit. But I guess if they aren't going to file suit even when they know who was responsible, then who gives a flying fuck.

i didnt have anything in bitcoins, i had a very very small short position and the rest in cash, over 99 percent was in usd.

has anyone got usd payments yet or just bitcoins?


when can i expect my money please?

I am in the same disappointed mindset. I just transferred some funds to bitcoinica after hearing that they got registered as a financial service, so I thought it would be good idea to diversify. Obviously I was wrong. And unfortunately I did not receive anything back depsite all the reassurances that the claim is accurate since weeks.

I am opening up two polls here to try and help the community to reveal the status of the situation, also potentially to take legal steps in case there is no progress.

I would like to see the above posted everywhere where RackSpace's current clients can view it. They need to be made aware of how secure their data ain't and, moreover, RackSpace won't file a police report, thus allowing future hackers to continue their nefarious practices. Perhaps, even, then somebody at RackSpace may shed some light on this episode if they're privy to do so.

Don't forget : the longer you wait the less chance you have to get your money back.

genjix, is the USD interest you guys are getting not enough to pay out everybody STILL ?

The claim / threat that if we guys file for legal action nobody will get anything back is BS by me.

Why would any company say that ? To avoid having to pay back 100%.

ATM it looks like nobody is getting any USD back, only BTC so I am like Huh

The USD also was stolen ? Some of this story really does not check out with me.

My name is public, and my address/location too. If you want to get the police involved, I would be fine to go to them and let them have the problem to deal with. Good luck getting any money back then ever. I've got nothing to hide. Bitcoin people are always believing conspiracy theories like us making money from interest or it being an inside job.

To be honest, interest payments would not cover our time investment for processing payments out. It is a net loss considering I'm worth $50+ per hour. I charge $200 per hour for consulting work, and here I am spending 20 mins at a time researching claims and answering emails for sums less than $10. Doing this for interest payments would be absolutely stupid. It takes a long time because it's complicated. We're paying people back because it's the right thing to do.

We'll never know why you started to pull the scam and backpedaled but I think your identity being made public was a big part in that.  But no matter what you say on these forums, the fact you don't want legal authorities involved (even just a report) is because you know who "stole" the money.

Please dont' try and play the victim.  I don't figure you guys for fools - I know you watched the other scam sites and realized you could take 20%-50% of every users balance without any real repercussions.    Plus you get the full balances of every user that cannot validate their claims to your satisfaction.

On this point, I agree fully with genjix. And it is true that the claims process means a lot of work.

My concern is a very legitimate one and relates to the topic of this thread - security investigation.

Unless you and your staff are incompetent, there is no way a hacker could have destroyed the database backups that were kept on a different machine.  So your system was accessed by someone with your blessing, and all the backups conveniently wiped out.  

So your latest stance is "call the police and you will never see your money"?  That sounds like blackmail to me.  Why are you trying so hard to keep the police out of it?

Is there something/anything you could outsource by hiring someone ?

I had not made change to my account for months before the hack.
I have been told my claim was accurate.
I'm now to be expecting 50% of that ~2 month later ... (while the sum involved were above 10K$)

... I've been researching Donald's username on that forum, Do he post here ? if so what is it ?
