That makes absolutely ZERO sense.

If you're willing to send the money to Bitcoin Foundation if they sign the message with their BTC address, then why can't they just do that and then you send THEM the bitcoins?  That's totally and utterly inconsistent.

Please Deprived, since you have a horse in this race, why don't you just armchair quarterback the whole situation and we'll let you get all of the nastygrams.

I'd much rather see my money to go the Bitcoin foundation.

If some people are unwilling to release their personal details and would rather sign a message with the associated btc address invalidating their claim, I think that those coins can be donated to the Bitcoin Foundation.

This is not an unreasonable request and I will speak with counsel to see if something like this can work.

Stop trying to place blame on GLBSE, its your negligence and by taking the legal route you are just making things worse for yourself, if you have to spend 1000s on legal fees and hours in court then thats what's going to happen.

As someone else stated you could have worked this out partially on a case by case basis, I'm.sure you know people who you can resolve with without lawyer intervention

EDIT: you state that you cannot verifiy the list nefario gave you, so can I ask why you placed trust in him and his platform to host your contract and all of a sudden decide not to trust him? Again this is your negligence.

You also seems to not read anything I write. The list is a starting point. The list needs to be verified. I need to have legal recourse if things go awry. This is to protect all Gigaminers.

The lawyer is involved so people can trust that their information can be held in confidence. It is a lawyer's sworn duty to uphold laws and play by the rules.

Please look past your blinding anger and try to see another point of view.

The only reasons payments stopped was because GLBSE shut down. I actually sent in 500 BTC to GLBSE hours before they closed for the next weeks coupon payment.

Or him pooling up profits is ok with everyone and changing terms to get it legit?

GLBSE changed the terms by closing.

Bankrupt his operation and make it hurt his wallet instead of yours.

Bankrupting me is not going to get Gigaminers their coupon payments.

You seem to ignore all of the points that I have made regarding why a claims process even exists.

To the bitcoin community:

We are all in the very unenviable position of riding in the wake of the aftermath of James McCarthy. I have been placed in a very bad spot in this wake, and my only goal is to protect and serve Gigaminers as I have over the last half year.

I would like to point out that I am the only asset issuer on GLBSE, as far as I am aware, who is trying to move forward and abide by all the laws of local, state, federal and international law. I am the only asset issuer, as far as I am aware, to hire legal counsel and to send via certified mail, a demand letter to James McCarthy after multiple unanswered emails and phone calls. I am fairly confident that the asset lists only started arriving once the letter was received.

Further more, how exactly would you like me to handle situations where claims are made against gigamining that are not in the list provided from GLBSE? Should I and all Gigaminers just keep trusting nefario? This is the exact reason to have a claims process in the first place. Nefario is withholding information for a mistake he made, Gigaminers should not have to suffer because of Nefario's mistakes any longer.

I have received claims for over 10% of Gigamining that are NOT on the lists given to me by GLBSE. This is a significant percentage and it warrants the claims process.

Finally, what should happen if I pay the wrong individual a large amount of the held coins? Guess what, I'm still on the hook according to the law. It is only right to protect the interests of all Gigaminers by making sure I have legal recourse should such a situation occur.

I hope it is clear that I am only trying to clean up and move forward from the situation at hand.

Question for giga: people contacted by you via email was on the Nefario's list, or you have some other sources?

I have been sent PMs on the forum with claims that are currently not on the GLBSE lists given.

Question to everyone: How can revealing of identity prove you are rightful shareholder, if giga doesn't have trustworthy source to compare with (if we consider Nefarios list untrustworthy)?

Revealing your identity provides legal recourse should you not be entitled to payments received. Verifying that you own a public key does little other show you own the address.

This begs the question:

If the list given by Nefario to Giga is false, how is a lawyer going to fix this? It's not like the lawyer has the true list and we have to prove ourselves to him first.

The only way to do so is to compare notes from all parties to try and verify the information given by GLBSE.

I am yet to understand why somebody being able to prove they own the private key associated with the account isnt good enough proof of ownership. What does all the other detail you demand have over this? I didnt register any of the information with GLBSE, so what are you trying to do here? i think thats pretty clear, grab yourself minimum 6 TH/s unit from BFL off the mini rigs we all paid for.

Proving you own a private key provides no legal recourse should you be proven to be colluding with Mr. McCarthy.

I've decided that gigavps will not get a scammer tag for this. Nefario has proven himself to be untrustworthy, so it would be unreasonable for gigavps to pay out large sums of money based entirely on Nefario's list. Requiring affidavits and proofs of identity are reasonable precautions. It's impossible to strictly follow the contract in a safe way.

now that you have the list, where my email should appear, together with my BC adress, I kindly ask you to confirm this to the registered email and pay my weekly dividends to the BC adress from now on.
I will definetely not jump through your hoops since none of this was originally part of our contract.
If you or your attorney fail to confirm my email adress and send the owing BC back, or contact me in any other way personally to talk through this, until 30th of November, I will have my lawyer taking criminal charges against you.
We are not playing games here. We had a contract, everybody gave you time since obviously you didnt have the information needed to fulfill it. Now that you have the information, its your turn to fulfill your obligations. Not ours to do whatever you think is necessary and was not at all mentioned in the original contract.

I live in Europe in a non English-speaking country... Other points are somehow acceptable but this - I just don't get it  Huh

An affidavit is simply a document, you create and sign, attesting that you own a specific number of gigamining 5Mh/s contracts. You would then have it notarized.

"apostille of the competent jurisdiction" just means to have the document notarized.

You can see all past and future dividends at http://gigamining.com. There have not been any decisions made about buybacks nor does the current contract enable this since the price to quote is from GLBSE.

Gigamining / Teramining will no longer be relying on any third party semi-anonymous systems for trading.

How many shares have given to you by Nefario? what is the % of the total share number?

I do not see a reason to release this information at this time as the list is not final per Nefario.

Please tell us we can change our BTC withdrawal address if we wish. I no longer have the keys to the deposit address I had on file.

When we are ready to make payouts and claims have been verified, this should not be an issue.
