Quotes form the last news from Bitmine :

Eventually, BITMINE AG operations will return back to a profitable position and all pending refunds and orders will be cleared, we just ask you a bit of patience for the delays, we understand that many may be in a hurry and could possibly be waiting from several months but we are committed in resolving the situation in the fastest possible way.

Thank you for your precious patience.

Are they serious ? This must be another joke to make all of us pranksters have a good laugh.

What do you think about it Colider or Mr new bitmine's cloud community manager ?

My opinion :

It also depends on how the PSU manufacturer has built the PSU.

Server grade psus can usually handle way over spec as long as properly cooled

I think that there is so many that is going to take them to court that they will never reach profitable level anymore.
They are facing thousands of dollar in cost's for court cases that they are going to lose because they are breaking their own TOS and CPP

It is better to call them, takes about 10-15 minutes, but then you can ask your questions.

About emails...

Support answers in 1 or 2 days if you are in good terms with them and you are polite...

Info answers in 5 or 6 weeks if you are in good terms with them and you are polite as well...That's if they don't loose it or asks you to
verify something as a delay tactic, then begin waiting 5 or 6 more weeks again...
Emailing every day makes it worst, once a week is good enough.

By the time you get things resolved at that speed it will be the end of the year...

I was in contact with Bitmine yesterday by phone. They did answer within a couple minutes.
I asked them about that when I'll receive my refund, they told me they'll answer me by e-mail after checking the schedule with their accountants.

This is the reply I got:

Quote
Kerim (Bitmine AG)

Dear Mr. XXXX,

as you may already be aware we are facing some difficulties to process all the refund requests we have received. With this e-mail we would like, first of all, to apologise for the delays you are facing and to thank you for the patience so far.

Given your position in the refunds processing queue and our cash-flow projections, your refund is expected to be processed about on the first half of September, 2014.

We understand this may be a long time to wait for, as such we would like to give you some alternative options that may be available in shorter time:

1) We may restore your order and send it to you with 100% more hashing power than the original order was. That is, if you ordered 1TH/s, you would get 2TH/s. Shipping would usually take place same day or day after we received confirmation from you, anyway not more than 5-7 days.

2) You may convert the amount we owe you (including the 10% penalty) into hosted mining contracts, which will be available from August 15th. More information is available at http://bitmine.ch/hosted-mining-plans-now-available-starting-1gh/

Let us know if you are interested in exploring either of the alternative options, otherwise we kindly ask you to bear some more patience until your refund is processed.

Best regards,

Bitmine AG, Bitmine.ch

and here is an earlier e-mail from Kerim

Dear Mr. XXXX,

I am sorry to hear you weren't refunded. On the 27th of may I sent a note with a list of names including yours, reminding I got confirmation that those people received assurance that their payment would arrive within the 30th. On the 30th I sent another note, and only today I received confirmation that some of these people have been paid but for some reason you weren't. You may feel insulted to hear this again, but the only thing I can tell you is to bear some more patience until your payment arrives.

Best regards,

Bitmine AG, Bitmine.ch

Now... Who has been in contact with Swiss lawyers already and could give me some prices and other details?

Okay it's final:

I called them for the 10 times today because they still haven't refund the full amount of my money.

I made pressure because they promised me like the 10 times in the row now that they will refund the money asap. And that's what I am hearing for over 2 months now straight from them.

In the end Kerim stated: quote "You will not get any money from us. Take a Lawyer if you want money from us." and put down the phone immediately.

so Shit is getting real, I am going to talk to my Laywer today even thought I would like to avoid this step.

These Guys only have $$$ in their eyes and don't give a fuck about customers neither they are afraid the lie all day.

Does anyone have a copy of the "old" terms of sale (the ones that provided the additional penalty of 10% ? ).

I might need it to check with my lawyer how costly the Betreibung in Switzerland is.

As I said earlier, if anyone need help to send them an official Swiss summon to pay, I will help you with great pleasure.

This BS is over, I'm getting back to serious business and let my big legal guns do the work.

I ADVICE EVERYONE LIVING IN SWITZERLAND TO SEND THEM A SUMMONS TO PAY FOR THEIR REFUND.
First of all, it puts pressure on those lazy greedy useless entrepreneurs.
It blocks this debt for a unlimited time, if you don't after 10 years it's gone.
It adds a 5% interest/year to what they already owe you.

Contact me via mp if you need help in this approach.

here is a link to launch the seizure protocol.
https://www.e-service.admin.ch/eschkg/cms/content/betreibung/betreibung_einleiten_fr

It is in french, german and italian. In the end the form created is in italian.
And you have to send it by postal mail.

This apply to international customers too, you just need someone to represent you in Switzerland and I am willing to help. I am taking them to court soon. My Swiss legal insurance is set up on the case.

oh sorry I wasn't calling them 10 times today. in the last 2 months 10 times.

Yes I wasn't super polit this call. I was annoyed because they never answer my mails (which are always friendly) and they obviously refuse giving back the missing amount.

But today I didn't want him to just pass "a note". I wanted an Answer why they still owe me money.
I didn't insult them or anything like that. I just repeaded asking them why they are unable to pay it back and why they try to scam me.

I still don't get it what is so hard refunding the missing amount in my Bitcoin Wallet.

The missing part is not much anymore, they stated they flipped two numbers what I don't belive.
But still money is money and they owe me money.

seems more like I expected, they can help everyone with hardware,
but not with money (refunds) atm.

Short of liquid cash/coins, contract(s) with suppliers, ...

you can always make a proposition for them to work it out:
-pay half now
-remaining part on fixed date (few months)

Still have to say that in the beginning everybody was excited that a company
like Bitmine could offer business, by setting up all the suppliers etc.
Then shits begins to rumble on delivery dates (properbly out of hands of Bitmine),
and suddenly everyone wants a refund.

A company has obligations to supplier(s), which has to deal with huge amounts of money.
I am convinced that money is there, but if everyone is paid out immediately at once,
they could miss some obligations to supplier(s).

If people are refunded on the same scale as new orders arrive,
business will not be damaged.

And I dont see why this business has to be damaged.
It takes a lot of engineering to make this product,
and its a decent product that works well.

Am still happy with my desks.

My opinion is that there is no money/coins left at the moment, that's why they try to give the customer other options.
When a big refunder sues them, you can't get anything anymore, if the parts and funds are frozen, so I would make a deal with them. (I guess this will always be better then getting nothing)

Hello,

Here is the wallet where all the BTC went to from CCD and CCR orders
originally
https://blockchain.info/address/1Cz1pTK8GxsJqdHQrFLWh77WwYsyqyDX3k

From there most has been scrambled and moved to this wallet
https://blockchain.info/address/13f6g7bobzbEdov9d3E8DJrPNQfCF8p37N

A total of 1797BTC which at the moment is worth ~1.160.862$

A lot of people is wondering why you are not using these funds to refund
people now when you have done it earlier.

There has been done some confirmed refunds
from https://blockchain.info/address/1Cz1pTK8GxsJqdHQrFLWh77WwYsyqyDX3k
Now there is still a lot of BTC left there but no refunds has been done
since 2.6.2014 if that even was a refund.
Last confirmed refund was 21.5.2014 and after that large amounts of BTC has
been sent
to https://blockchain.info/address/1Fwy1ohpdinkcsTSkEJ4pvRnLj3Q8TVSp5 and
from there on scrambled a little to
https://blockchain.info/address/13f6g7bobzbEdov9d3E8DJrPNQfCF8p37N.

XXXX

I don't know anything about these wallets, I guess they might be for covering future costs of the new facility in Iceland. It's not just the wafers, there is the leasing of the facility and many other costs.

Mr. XXXX, trust me when I tell you that everyone here at Bitmine AG wants all pending dues to be cleared and I really don't think we're holding any money just for the fun of it.

Best regards,

Bitmine AG, Bitmine.ch

Good morning,

So now you tell me that I'll have to wait 2,5 months over the late delivery
+ CPP?

I know that you have over 1700BTC in various wallets so why aren't you
selling those?

You have already paid the 3milj for the wafers so isn't that BTC now
available for refunds?

BR,
XXXX
