I am also going for a claim if they don’t refund me or don’t answer my mails anymore.
There is no doubt that a claim would be successful because Q3 delivery is stated in their terms. They must know this and so I would find it strange if Alpha didn’t at least offer 80% or sth. like that. Because else they will have to pay 100% plus court fees etc.
Unless their defence is like that there is no money bla bla because its gone into production whatever. With a CCJ however its difficult to go on with business that’s clear.
Anybody an idea what happens in this case? Can they operate further? Will they be forced into bankruptcy? Would also be interesting if Alpha as an UK registered company is obliged by law to have the assets on hand in UK etc. Because if not its going to be difficult to get the money back. Would a claim against Mr. Akram in person make any difference then?
Court fees can go over £1k (incl hearing etc.) if someone ordered a big viper or even more. If there is no money to gain that’s not going to be a funny thing.

If you want you can even impose bankruptcy to Alpha T if they refused to refund you. But it is recommended to consult your lawyer before you take this action. It's clear that most of these ASIC manufacturers are testing or "burning in" their machines on the actual network instead of the test-net. BFL is a perfect example of this business model. They were more interested in running customer machines for their own benefit then actually shipping them. They held back customer machines to the tune of 3% of the entire BTC network. Might not sound like a lot, but it represents a lot of money.
So now we have AT, and they aren't even in charge of assembly of their units. I can just imagine it now. All of these Vipers running in India for weeks or even months before being shipped to the UK. Where they will likely be tested again so that AT can pocket as much as possible before shipping a worthless product. Essentially it's a double dipping out of the customers mining hardware.

Sounds like they outsourced everything, including the non-existent customer service. So if a customer gets a faulty "Unit", or if they refuse delivery, it goes back to India? This just gets better and better doesn't it.

This just gets better and better doesn't it. They were always quite clear that they were going to outsource all of product development. Originally they stated that Dexcel was organzing pretty much everything and Alpha was providing support and knowledge of scrypt mining.

Let us summarize what we can AT accuse in court in order to get our money back! So far I've got; - Misleading omissions; discribed here, http://www.legislation.gov.uk/ukdsi/2008/9780110811574/regulation/6 - Failed to meet the shipping target, Q2/Q3 2014 - Several changes to the T&C without permission from the customers - Refusing refund; Under the DSRs, a customer’s right to cancel is unconditional. http://dshub.tradingstandards.gov.uk/dsrexplained - changed the product specifications; 25MH/S, 600 watts -> 250MH/s 1875watt - changed the price, then Total price: £5450. Remainder will need to be paid 8-10 weeks before shipment, which will include shipping cost to your location. Now Full Price: £5450 (excl. VAT & Shipping) Any more that I've forgot to add in the list? We need a strong case before we go to court!

Alpha has violated the following:Claiming Paypal would be an option for final payment and not offering it.(Now they say they are offering it at the end of development, but that would be impossible to offer it 8-10 weeks prior to shipping) One-sided compliance with obligationsThey requested final payment for delivery 5/22/2014 and 8-10 weeks have passed and the product is nowhere near shipping. By requesting final payment for delivery and then pulling the option for credit card transactions only days later(Thereby forcing buyers into an unprotected transaction.)
