Sorry to hear this, OP.

Gambling addiction needs to be taken seriously by all parties involved and this is certainly not something that is ideal.

They are right in some regard, you could have labelled these emails as spam etc. but I personally think that they should be at least somewhat liable for any losses given that you have signed up to be excluded from their services, and it is a glitch on their end.

Did you apply for voluntary self-exclusion?

If yes, then they certainly should not have sent all of these marketing emails to you and they could get into trouble with authorities if they were regulated.

I don't think that they would take responsibility, though, just because that is the industry standard right now. Though I would hope that these things will change.

Would really be bad looking for Stake if they do continue out on having that kind of behavior.I dont know if this would involved legal actions with this kind of act
but if OP would push up some actions against them then it could really be but still a hassle thing to do and op should just let this one pass and
better not to access that email anymore if hes really serious on quitting gambling for good.

May I ask how much exactly you lost by doing this?

If you really wanted to pursue this case then you could possibly get in touch with the ombudsman in the appropriate jurisdiction for these matters, although I honestly don't think that they will be able to track down the Stake team given their remote nature.

It's a lesson to be learned, don't expect others to take responsibility for your actions.

Please let me clarify my issue more. I have created a new account after recieving those mails, since the first account was already excluded. I have let them know about the issue and asked them for a refund. As they were fully aware I am a problem gambler they immediately locked the new account to, however I managed to lose some money on that account.
I want to blame you for doing that. Try to have a control over yourself. Stake has done the mistake by sending you promotional messages after your self-ban request. But they aren't responsible for the losses in your new account. You had the option to unsubscribe their promotional message (some forum members has mentioned it above), but you haven't done it.

What a casino can do if you create a new account after requesting self-ban from your old account? They have nothing to do until they recognise you by the IP address. And it takes time to complete the process. You should block gambling sites URL from your device.
I can understand your point of view, however thats not how every person works. A casino has failed in their responsibility to protect a problem gambler. Also who knows to how many people they are doing this. If casino makes a mistake they should rectify that mistake. Last month there was a case with a casino I won't name here that has done the same thing, however they only accidently send emails to excluded members for sending out just one email, they are facing some serious legal action. So why do you think Stake should get away with this?
Not everyone understand how you really feel about this as a recovering addict like what fiulpro said as none of us are in your situation.

I don't think Stake will ever refund you for the lost money from the new account as a result of the promotional emails that they sent irresponsibly unless they are taken to a court. Maybe get a legal advice and present those evidences that you are saying then proceed from there. Goodluck to you.

They have already acknowledged their mistake and blamed their database and said it had errors. While you might see this as a small mistake, we all are not aware to how many problem gambler Stake is doing this. Problem gamblers are probably their main source of income and they should not target excluded account for their promo mails. There is no casino that is allowed to do this.

I get why OP is making a big deal out of this. Based on the response of the casino, they had little to no remorse to the impacts of even the simple error of sending promotions to gamblers undergoing such situation. These gamblers are vulnerable, and OP for one, perhaps felt being taken advantage for his weakness to temptation brought about his condition.

Yeah, as others have been saying a company has to have a way of unsubscribing from emails, otherwise they're in breach of the law. So, while I understand you might be angry about it, there is a way of unsubscribing. If you made them aware of your issues, and they didn't manually do it, I can understand your frustration, but you also have the option on every email that they send. They should have probably explained that better, but just unsubscribe, if they continue to send emails after you've unsubscribed you can report them, though I don't think this will be an issue. Stake has been operating for a long time now here, and while there are complaints the majority of users experience is positive (You know, as positive as it can be losing money Cheesy).

I can't exactly tell from your screenshot if you tried to unsubscribe yourself via the self exclusion or you just contacted them bringing up the issue of receiving the emails?

It would only be a problem if the OP tried to unsubscribe to their emails, but they either didn't allow it or continued sending. The OP always had the option to stop these emails themselves, despite letting Stake know about their issues, without being explicitly told they don't want to receive anything further from them, they aren't going to assume that's the case.

If OP tried unsubscribing, and it didn't work or they continued to doing it they would have a decent case, and would likely win it. Usually, companies avoid the drama though, and offer benefits. For example, I know someone who was offered gift cards, but refused, and asked them to sort out the issue, and donate to a charity instead.

I have contacted live support and the legal department, and they have admitted their was a error in their database allowing to send promotional emails to problem gamblers, they have let me know they have fixed it after my messages.



Unfortunately Stake is not taking any responsibility regarding my issue and will blame me for their mistakes.

I hope there is someone noticing the pain Stake is causing to some of the problem gamblers out there, and I still hope Stake will solve this issue with me.



I'm sorry you are undergoing this problem knowing that you're still in the process of recovering from gambling addiction. The casino which is Stake should be responsible for this because they handle the lists of subscribers they would send promotional emails and bonuses advertisements for. The moment they knew your condition, they should have eliminated your name in the list that they would spam email to, to avoid doing any harm to you. It's just so saddening that the casinos have a very little concern to their clients and previous clients to the point that respecting the healing or recovering phase of someone who became obsessed or addicted to gambling is hardly done. This should be one of their priorities as a matter of fact because so many people have been suffering from this and it's no joke undergoing such challenge in life.

As small concern as it appears to be to others, this is a serious issue and a bomb to some. These promotions trigger the sleeping and slowly taming addiction in them. It won't help them recover if the sites would keep on spamming. I know there are other things that can be done such as unsubscribing or blocking their emails. But still, the casino should be held liable of their actions or lack thereof because not everyone can do such things (deleting emails, blocking, and unsubscribing) without triggering their addiction at all.

As far as I am concerned, when you are got for any of breach in term of term and conditions, your account will be locked and NOT removed from the database. It means you are entitled to have all communication but not allowed to gamble anymore until your account is restored. In short, it is closed for gambling but not for other purposes.

Unfortunately Stake is not taking any responsibility regarding my issue and will blame me for their mistakes.
I read/checked twice still I could not find the exact scenarios of your problems. You must provide detailed information on the situation you are facing with them before calling them not taking any responsibilities to solve your issue in public forum.

Yes I agree, unfortunately I have been treated like shit by the Stake support team and they really don't care about this issue. I am still hoping for a representative to reach out to me to take responsibility for this.

While it is really distasteful and underhanded for them to continue to send you promotional emails you need to learn how to set up automated rules for your inbox. Almost every email service provider these days offers the ability to do this, learn how it works with your provider and you can instantly remove all trace of any emails coming in from stake.com. That way you'll never see them and can avoid being triggered to gamble. You're seriously wasting your time complaining to most of these gambling sites, even the bigger operations, because they reside in jurisdictions or have licenses in places that have little ability to enforce any damaging measures. Filter them and move on.

I agree, it felt like OP wanted to get more out of that small mistake.
Small mistake? They might be taking advantage of alot more problem gamblers this way. I dont think their regulator will see this as a small mistake.
Well, it depends on how you look at it ig? For the victim it might seem to be a big case, after all, they are trying to recover from their gambling addiction tendencies, anything related to gambling could be seen as very sensitive to them and could lead to a lot of repercussions while for the average joe, it might just seem like it's nothing. I'm more on the side that OP is making this a bigger issue than it should be, could've simply, as I recommended, turned off email subscriptions and whatnot. Now if he did, and he still got sent gambling-related stuff, then THAT'S the time it would become a really big issue.

We have our own interpretation of OP's shared experience for us regarding his journey of combatting his addiction to gambling. Actually, I didn't have any thought about OP's concern other than he was trying to get rid off of his addiction and I do understand that for a person who is moving on and treating himself from gambling receiving emails about promotional and bonus emails will go to challenge his resistance on gambling again, it will be challenging for him.

Please let me clarify my issue more. I have created a new account after recieving those mails, since the first account was already excluded. I have let them know about the issue and asked them for a refund. As they were fully aware I am a problem gambler they immediately locked the new account to, however I managed to lose some money on that account.
so, you are asking for compensation for the money you lost on the new account you created on their website? although I agree that you should at least get compensation(outside their gambling site since you said yourself you are a recovering addict) but not the money you lost on the new account you created. I hope you get some kind of compensation from them though.

Dear fellow users,

Let me explain the situation im in with Stake.com,
I am a recovering gambling addict with an account at Stake due to problem gambling.

This account has been closed for a long time and they still kept spamming me with promotional and bonus emails, even though they were fully aware of my problems.

I have contacted live support and the legal department, and they have admitted their was a error in their database allowing to send promotional emails to problem gamblers, they have let me know they have fixed it after my messages.


Unfortunately Stake is not taking any responsibility regarding my issue and will blame me for their mistakes.

I hope there is someone noticing the pain Stake is causing to some of the problem gamblers out there, and I still hope Stake will solve this issue with me.


It is unfortunate that this happened, however while I am in favor of features in casinos that have to do with responsible gambling, at the same time I think it is important to make an effort by ourselves to also put some measures in place so we can isolate ourselves in the case the measures of the casino fail for some reason or another, the most obvious is to have an email exclusively dedicated to your gambling activities, that way in the case a casino sends you an email with a bonus you can just use a filter to not even see it or in the worst case scenario you could just delete that email account and avoid seeing those emails that way.

The Stake team has notified me that this actually was a database error and has been fixed after my message, I have also provided them with proof that I recieved those emails on the account that was closed for gambling problems. They should however compensate the account I created after I recieved those promotional emails, I am not talking about the account that is already closed for problem gambling.
are you planning on gambling on the new account you created? if I were the recovering addict I would have asked for compensation outside their gambling site. asking for compensation(i am sure you are asking about money right?) on your new account could trigger or further trigger your addiction. a relapse could mean wasting all the time and effort you gave on your recovery.

I'm sorry you are undergoing this problem knowing that you're still in the process of recovering from gambling addiction. The casino which is Stake should be responsible for this because they handle the lists of subscribers they would send promotional emails and bonuses advertisements for. The moment they knew your condition, they should have eliminated your name in the list that they would spam email to, to avoid doing any harm to you. It's just so saddening that the casinos have a very little concern to their clients and previous clients to the point that respecting the healing or recovering phase of someone who became obsessed or addicted to gambling is hardly done. This should be one of their priorities as a matter of fact because so many people have been suffering from this and it's no joke undergoing such challenge in life.

As small concern as it appears to be to others, this is a serious issue and a bomb to some. These promotions trigger the sleeping and slowly taming addiction in them. It won't help them recover if the sites would keep on spamming. I know there are other things that can be done such as unsubscribing or blocking their emails. But still, the casino should be held liable of their actions or lack thereof because not everyone can do such things (deleting emails, blocking, and unsubscribing) without triggering their addiction at all.

It's a good move that you have reached out to them. However, they really lack empathy because instead of doing something and apologizing for inconvenience, they chose to blame you instead. This shouldn't be their resolution. If their customer service would really insist to blame you or make the actions on your own, you can try to escalate it here in forum by reaching out to the higher ups who are managing the site. Maybe they could help you addressing your concern as a whole. I hope you continue to recover and please don't let this circumstance hinder you from totally healing. No, locking the second account is not the problem here because they locked it after he informed them about it.

According to the self-exclusion terms, an excluded user must not create a new account or use any of his alternative accounts.
You should not attempt or proceed to open any new accounts during your self-exclusion period, or indefinitely if a permanent self-exclusion has been selected.
If the casino finds out you creayed a new account they will lock it immediately.

Or simply wont really make out some access on your email if ever if you wont able to unsubscribe because you wont really be bothering yourselff on opening those emails you had when you are really serious on quitting gambling for good and for Stake then it wasnt really right that he was
been continually sent out those promotional emails despite of those self exclusion which it isnt really right which i do believe it was
