1881  Bitcoin / Legal / Re: SEC vs LBRY Summary Judgement Ruling on: May 18, 2023, 11:02:18 AM
The United States securities regulator is seeking to revise its $22 million punishment against decentralized content platform LBRY, acknowledging it is unlikely to be able to cough up the funds to be able to pay it. "
I'm not familiar with how the US gives punishments to companies, but do stuff like this often happens? How did they arrive at the 22 million number in the first place? I thought they'd calculate the assets of the company they punish so if they refused to pay they can just seize them. It is hard to believe they just take the raised ICO numbers as punishment as you mentioned above without considering anything else.
These events happen frequently because many tokens are securities under US law. Some companies are less affected by fines because they prevented US residents from buying tokens, or used licensed intermediaries who monitored it.
Another question is what investors bought for: fiat or cryptocurrencies.
One of the punishment options is the amount of sale of tokens (shares) on ICO plus interest and penalties. For most companies, this is bankruptcy.

I have not read through the entire article but from what you have said the woman is entirely wrong if she actually sue someone concerning an already concluded deal.. well let's not look just from one side of the story, the right for the woman to sue the her buyer might be base on the agreement which was reached between the buyer and the seller and another things is base on the country, maybe the country is not a crypto friendly country which they can use that against the purchaser for buying something with hug amount of crypto, this case might not just end with the Lamborghini purchase it might also go deeper to the length at which they will request his other crypto assets and the source of those incomes.
And in vain you did not read the article, although it is very interesting. In any civilized country, only the court decides who is guilty (not right) and who is not guilty (right). If you enter into financial transactions for large amounts, then you must know the laws of the country or use the services of consultants in order to understand the consequences of such transactions.
There is no need to be naive and live in the world of your own feats, if the country is not friendly to cryptocurrency, then you need to minimize any legislative consequences for yourself.

1884  Alternate cryptocurrencies / Announcements (Altcoins) / Re: [ANN] Ethereum: Welcome to the Beginning on: May 17, 2023, 09:17:03 PM
The Ethereum blockchain suffered from a technical issue on Friday that caused the network to stop finalizing blocks for over an hour, the second such outage in the past 24 hours and it could happen again.
https://btcbit.net/news/ethereum_developers_have_released_a_patch_to_fix_network_failures
"The Ethereum Foundation developers have released a software update for Prysm and Teku clients to prevent further network outages.

Large-scale failures occurred on May 11 and 12, when the Ethereum network faced the problem of block finalization twice in a day. The first incident lasted 25 minutes, and the second more than an hour. There are speculations that this could be related to ether staking and MEV bots. The Ethereum Foundation claims that they are still investigating the reliable cause of the failures. Most likely, it is in high load on some clients.

Superphiz, an Ethereum developer and Beacon Chain consultant, assured via Twitter that the impact of the disruption is minimal and does not pose a threat to users. Transactions were not stopped, the blockchain continued to work, and failures did not affect network activity in any way."

"Laws set to be agreed next week would require crypto companies to register with tax authorities, even if they’re based outside the bloc or offering non-fungible tokens.
The European Union plans to force crypto companies to give tax authorities details of their clients' holdings, according to a draft bill released to CoinDesk under freedom of information laws.
The data-sharing law, based on a model from the Organization for Economic Cooperation and Development (OECD), is set to be agreed by finance ministers next week, and will allow tax authorities to share data within the 27-nation bloc. Commission officials have said the bill received unanimous acclaim at a meeting on Wednesday, though people familiar with the matter told CoinDesk that some finance ministers have not yet received formal approval from parliaments."

https://cointelegraph.com/news/federal-reserve-s-fednow-will-integrate-with-metal-blockchain
"The Federal Reserve’s forthcoming instant payment service FedNow will be connected to Metal Blockchain, according to a May 11 announcement from the Metal Blockchain team. The announcement said that the integration will allow Metal users to instantly convert funds to stablecoin and back again using FedNow’s “send/receive” function.
FedNow is an instant payment system developed by the United States Federal Reserve. It allows for round-the-clock, near-instant payments between banks. Currently, U.S. residents can only make instant payments domestically through third-party apps such as PayPal and Venmo, or crypto wallets. The Federal Reserve has stated that the new service will launch in July.
Metal Blockchain is a crypto network developed by Metallicus, based on a fork of Avalanche's code. It was created to offer compliance-friendly options for decentralized finance (DeFi) developers. In the May 11 announcement, Metal developers claimed that the network is “built on the foundation of BSA [Bank Secrecy Act] Compliance,” implying that it has identity verification and Anti-Money Laundering features built in."
1889  Bitcoin / Legal / Re: More Regulation Incoming! on: May 17, 2023, 08:44:34 PM
@zasad@. Centers for cryptocurrencies in other countries. This does not solve the problem of regulatory inclarity for the people who want to invest and use the cryptospace in America.

It also appears that it is not only the businesses that are focused on the cryptospace that want regulatory clarity. The US chamber of commerce has filed a brief questioning the SEC for acting unlawfully vs. Coinbase.

The SEC’s actions are not just harmful policy; they are unlawful; and the consequences of the SEC’s continued delay are severe for that reason too.

The SEC’s unwillingness to announce the rules of the road ex ante, combined with its use of enforcement actions to impose or threaten liability ex post, conflicts with the Due Process Clause and basic principles of administrative law. And the SEC’s continued inaction on Coinbase’s rulemaking petition compounds these violations.

Source https://www.uschamber.com/assets/documents/U.S.-Chamber-Amicus-Brief-In-re-Coinbase-Third-Circuit.pdf
Let me tell you my opinion, if I'm wrong, then you tell me where I'm wrong.
In the US, democracy, they do not have bribes, but there is lobbying. Binance in the US is declared a criminal and almost an accomplice of terrorists, so many officials are afraid to lobby for the interests of this company. The Coinbase exchange has a lobby, so they influence the SEC from different angles. This is how American democracy works.

The argument is on regulatory clarity and how the SEC does not have a clear definition on what is an illegal security on much of the projects in the cryptospace. Also, you mention lobbying. Coinbase can lobby to influence the SEC, however, why is the SEC suing Coinbase based on accusations that cannot be backed because uncle Gary does not have the regulatory structure to bring these cases to completion?
The SEC disagrees with your opinion.
They believe they are acting in accordance with US law.
Many projects preferred to negotiate with the regulator and pay fines.

Coinbase Request for Clarity on Crypto Rules ‘Should Be Denied’, Says SEC

I have not read all the news today, and I will probably update the post. But I don't see any information that the SEC is suing. While I see a circus with a petition.
And while this is happening, secret negotiations are underway.
1890  Bitcoin / Legal / Re: Solution for Bank Account frozen by Cyber Police due to P2P Trading (India) on: May 17, 2023, 08:29:04 PM
Hi Sir,

My PayTM account was blocked due to WestBengal Cyber Cell for the similar reason in this thread. I am from TamilNadu.
When you say "Contact Local Lawyer", do you mean I should contact a lawyer in TN or lawyer in West Bengal?

I have also PM'd you regarding the same.

Thank you in advance.

Its always better to hire a lawyer in the same state from where the complaint came from.
Do you have different tax laws in each state? In my country, for example, the activity of a lawyer is licensed and controlled by the Bar Association, in which he will then work. If you need help in another region, the board will find a lawyer.
At the first stage, as a rule, telephone conversations or correspondence via mail are required. Any lawyer can do this, the main thing is that he has experience in such cases.
It is he who should contact the bank, sort out the problem and offer options.

Arkham tweeted that the U.S. government currently holds more than $6 billion worth of bitcoin on-chain.
"The bitcoins they held were seized from three incidents:
69,370 bitcoins were seized from Silk Road in 2020;
94,640 bitcoins were seized from Bitfinex hackers in 2022, and Silk Road hacker James Zhong was seized in 2022.
There are 51,326 bitcoins (9,861 have been sold and 41,500 are left).
The U.S. government announced plans to sell these bitcoins in batches in 2023."

selling bitcoin that don't belong to them imo is an unethical act, and what are they going to do with the money from selling the bitcoins....to pay off debts?  to fund the next presidential campaign?  or something else?

if they want to make FUD then the method is completely wrong, the news of the sale of large amounts of Bitcoin will only reduce the sympathy of many people for the US Government, and everyone will think badly of all the catches they managed to get.
All money confiscated from criminals in the US will go to the country's budget, and I don't think it's unethical. This is the policy in all countries. For the American budget, this is a small amount, and for the bitcoin market, the sale of 200,000 coins can collapse prices in the market greatly. But if they sell in parts, then this does not seriously affect the prices in the market.
1892  Bitcoin / Legal / Re: The legal status of crypto currencies all over the world on: May 17, 2023, 08:07:07 PM
I just found this global bitcoin adoption country list rankings in 2022. Happy to see that Pakistan is listed at the Number 6 position. Although the legal status area is grey if you ask about the adoption at the government level, but our youth is very much involved in bitcoin.

Look like the government changes in Paksitan in last few months have not been good for the crypto adotption in our country. The minister of state Aisha Pasha has stated in here that Cryptocurrencies in Pakistan willl never be legalized.
Well, she will not going to remain the finance minister forever and the stance can be changed with the passage of time but right now it seems that Pakistan will ban crypto from thier country and they will do it by banning the crypto apps through the Internet.
Quote
The Senate’s Standing Committee on Finance has decided to ban cryptocurrency services in Pakistan from the country’s Internet.
Maybe they do not know that crypto sites can be opened through VPN but by declaring it illegal and banning it, may spread disappointed amoung the crypto investors and they may start to think in investing in something other than crypto.
There are a lot of bans in Russia, and even this forum is banned, so everyone uses VPN, and our community is big. Cryptocurrencies are not prohibited, but they will not be allowed either, and this does not stop anyone from investing and gaining knowledge.
Cryptocurrency is a global trend of the last decade, and you need to invest only in such trends if you want to make good money.
Prohibitions are also different, and the main thing is not to leave your data on centralized services.

Mass Adoption.

Project Polaris: secure and resilient CBDC systems, offline and online

"As part of Project Polaris, the BIS Innovation Hub Nordic Centre has published a comprehensive handbook exploring key aspects of how central bank digital currencies (CBDCs) could work for offline payments.
The ability to make payments offline means being able to use a CBDC without being connected to the internet, either temporarily or because of coverage limitations. Central banks considering the potential implementation of CBDCs with offline functionality must take into account a complex matrix of issues including security, privacy, likely risks, the types of solution, their maturity and applicability, and operational factors."
1898  Local / Oбcyждeниe Bitcoin / Re: ЦБ РФ защитит россиян от Биткоина on: May 15, 2023, 09:55:43 AM

1899  Local / Юристы / Re: Как вы думаете, какое будущее ждёт криптов on: May 15, 2023, 09:50:50 AM
