Originally justice and self defense belonged to the people.  So it was a good idea to respect other peoples life, liberty, and estate-the basic concept of natural law.  In the wilderness who really knows what grievance would invoke a fatal remedy. The Romans i believe recognized the ideas of natural law too, but had procedures to protect the accused and believed the crimes should be proportional to the acts committed-like many other early cultures.  Those prosecuting a crime were often the victims or their families, and in most early societies the punishment for a false accusation was proportional to the crime alleged.  A false accuser could have been sent to Rome to be killed, sold into slavery, or pay a fine-so there was substantial risk in proceeding with a prosecution.

The English system essentially perverted the justice system in that they allowed state prosecutions.  And so a murder against john doe basically was a crime against the state/crown/commonwealth.  In the modern era you have many victimless crimes, following the US civil war plea bargains became common practice, and the police (an 1829 invention) now swears out many false warrants as they extort people or to make quotas.

I think that under a roman type system that the death penalty is acceptable.  However, in the English/US system it is almost always unacceptable.  Even the borderline folks may say it should be reserved for serial killers. But even the Colorado movie theater shooter took plea bargain to avoid the death penalty.  Many killers and sometimes innocent people in the preservation of their own life plead guilty to life, or even a lesser manslaughter charge.  only a handful of death penalty cases occurr, and sadly they involve people who are not mentally competent to take a plea or stand trial, people who don't think the evidence is strong enough to convict, people gambling the state made an error that the conviction will b reversed on appeal, and people who are actually innocent.  I met a serial killer (already sentenced to life), beat another murder charge, wanted by the feds for an alleged hit job, and accused of yet another killing who took a plea deal to a murder he claimed he didn't commit just to get out of jail-cause the American jails are much worse than the prisons; they want people to plead guilty even though pretrial detainees, unlike convicts, cannot be punished.  Because of qualified and sovereign immunity and the often short term nature of jails which can render a case in equity moot, there is rarely any federal judicial oversight of the jails and they are much worse than the prisons.   Basically the justice system we have under an English based system of laws end up protecting the criminals, and punishing innocent people severely-which in a capital murder case is death.    In so many ways the English based legal system is flawed, and it is too flawed to continue to allow the death penalty.    And even if someone beats their case, at least in the united states, many states do not have programs to compensate those falsely imprisoned and the courts will always try to immunize the police and municipalities.   international treaties hold that there must be compensation, but they are not enforceable in the federal courts.

i don't think America can take much more of the corrupt judicial and police system.  But the death penalty should be opposed with how flawed the system it.

I believe that if you are going to think rationally death penalty is reasonable. Me myself cannot afford the thought and risk of being a possible target of a exconvic or a loose killer running around the street. Even if a criminal or killer promised to change and has his parole due to years of imprisonment there is no telling that he/she wont comeback to his wrong doings. For example will you risk the chance of 10 innocent people getting killed by one criminal or killer? Or save the 10 innocent  people in exchange for the killer?  Of course not if you think rationally. Without Ironhand innovation and change will not be successful so I agree with death penalty

I disagree. Because we need to give a chance for a person to change him or herself. If death penalty were passed, there would be some person who are not really a suspect who would be killed.

I definitely agree with death penalty. Criminals who did a very bad thing like massive killing or brutal killing should all be gone in this world. If they know how to take a life then they must know how to be taken life away from them.

If someone is committing a petty crime such as robbery or fraud, then he can be given another chance to reform himself. But on the other hand, hard core criminals who engage in violent crimes such as murder, rape and home invasions almost never change. So these people needs to be removed from the society, to make sure of the safety of the other people.

Yes, I agree with capital punishment. Capital punishment is extremely necessary. We should take these people out back and let their victims or victims family beat them to death. This should be televised nationally. We should send a message to our society that we will not tolerate violent criminals. Doing this would deter crime and save a lot of money.

I believe in the death penalty. I believe criminals do not deserve to live their lives by taking some other people's life. God also said an eye for an eye, a tooth for a tooth. It is only just to sentence criminal who have taken lives with death.

I really will not have agree with death penalty, but for the purpose of rehabilitating the criminals and try to change their orientations for life, but based on what God says about all authorities here on earth is to be obeyed. It then mean that we are to be guided by the laws of the land, so as to be a good citizen, and to obey all constituted Authorities. In a situation where some people then go into crime, deliberate Robbery and killing of innocent soul, gang Raping and even killings, when the arm of the law catch up with such Criminals that have shed innocent blood knowingly and deliberately, the law will then take its cause. The law does not Permit any body taking laws into their hands to kill or commit all other vices the law is against. So therefore if it is the law that finds an individual guilty of death penalty, there is nothing any body can do about it, considering the circumstances that court have consider to condemn the individual by death penalty.

I can't say if I agree ether disagree. We humans god created us and making us alive with our fullest. But I can't say I agree but a part of it because if there is no death penalty other people will harass the law and also they will not afraid of laws because it just imprisonment

I am in favor of the death penality for mosquitos and a few other flying insects. I am even in favor of preemptive strikes against them, a sort of pre-crime minority-report-styled repression.

I don't support the death penalty because it is not nearly humane at all. A big thing here is that two wrongs do not make a right, which is absolutely correct. People change, they make better decisions and they change their frames of mind all the time. In many cases, the penalized human is innocent. Why would you want to take the risk of killing an innocent person because you think that they are guilty? You must give people a chance to change who they are before you make an immediate assumption.

I strongly agree in the imposition of death penalty but only for heinous crime like murder, rape kidnapping with extortion, etc and that the accused have been proven guilty without reasonable doubt that he is really the one.Sentencing them to death is necessary so that criminals will have second thought of doing such crimes, it will also act as a deterrent for them to stop and for them to think that the law or the government is really serious in implementing the death penalty.

No I don't agree in death penalty because everyone deserves second chance,as long as they are willing to change, they should be allowed a second chance. It is only fair by killing them that they won't change anything.

I used to be against the death penalty, but what is happening in my country now, and you watch TV, and you understand that it's time to start the death penalty, because the other does not reach anyone)) and especially if a person killed a person, then he too must be killed, and not imprisoned and released)

I'm in favor of what you said but in our time today the person who makes the law. Sometimes the person is pathetic, but I'm not in favor of death penalized for those who have committed a lot of sin. Some people have sinned and have not changed and because they repeatedly commit sin? the court decides that death will lead the person suspect of crimes. But people should not commit a crime so they will not be punished.
