They are still there.  I have had contact. No BTC refund mind you.

How did you get in contact?  This week, I've sent three emails,  and been on hold for 5 hours. They have not picked up a phone nor written back.  Should I book a flight to europe? Write a letter via postal service?

Seriously,  please tell me.  I have an issue that needs to be dealt with ASAP,  and I'm sick of losing sleep to listen to their hold music every night.

I also tried to call yesterday, no response.  Some sort of holiday in Switzerland, I hope?

"I've got the power, hey, yeah, hey

Like the crack of the whip, I snap attack
Front to back in this thing called rap
Dig it like a shovel, rhyme Devil on a Heavenly level
Bang the bass, turn up the treble

Radical mind day and night all the time
Seven, fourteen, wise, divine
Maniac, brainiac, winning the game
I'm the lyrical Jesse James"

They are still there.  I have had contact. No BTC refund mind you.

Their hold music song choice is the absolute worst, I got sick of it pretty fast, and I am sure the rest of you guys are as well. It is also highly ironic indeed, THEY'VE got the power, they've got our money, not delivering the products (the rigs were announced to be in production 6 weeks ago, no news of production or shipping since then). "Maniacs" and "Jesse James" indeed! Almost like they are confessing to being highway robbers.

Listen up Bitmine, we are tired of this song, and we are tired of you not responding to phone queries or email. Some people have lost their homes, some even their marriage, thanks to your business practices. You abused the name of Switzerland, and have cast a shadow on Swiss business ethics and professionalism. It is not pleasant to say this, but if you think you can get away with stealing people's money then the people will come after you, not just with a civil suit, but a criminal one as well. At least be open and transparent and tell us your plan for refunding. Your lack of communication points to an astounding lack of business ethics and makes us all worried that you are going to run away with OUR money. Don't try to blame the customers for feeling like this, the cause is entirely and 100% your practices. At best you have been incompetent, in which case we still hope you will refund us. At worst you are a fraudster (not that I am not accusing you, merely stating one of several possibilities), and hence why we are already looking into legal means of redress. At the moment it is only because we are undecided between whether you are incompetent but really trying to do the refunds, or just trying to run with the money, that we have not launched full legal proceedings. That day is not far however, so for your sake as well as ours, please issue a statement in which you (a) apologize for everything that has happened so far and (b) explain your plan for refunding as well as shipping of rigs and desktops to customers who have not claimed a refund.

any one had any problems where the coindeska lcd screen is reading out 10024ghs and on the btcguild website it reads out 670ghs or 540ghs or 339ghs, is it the machines or the pool??? most confusing readindgs

What are your voltage / overclocking settings?

I had problems with one module with the factory settings, had to set to "medium turbo" in order to reach ~680 GHS with 3 modules.
The one machine is at nominal reads at the screen and software say 1024ghs but at pool btcguild its at 370ghs.

Just checked some stuff connection is slow at 4.5mbit a sec too slow tor 11 machines. Also was told the pill could be throttling the connection.  Will try changing pools today and see what happens.
Temps are ok at 50 to 60 , big 24inch industrial fan for cooling and intake aswell.

You are just spreading your Gh between the 3 pools.
Go to Settings / Mining / Pool Balance

Add 3 workers from 3 of your pools, or just the same pool 3 times (not recommended, cause if this pool fails you're not hashing)

select Failover and press
save-restart

That will do.

This.

Also, explain why you can't refund people who paid through bank wire with BTC.  If what you said about a queue and bank limits are true, give people the BTC refund option so we can speed up the queue.

Everyone who wants to return the money go here. http://bitminech.blogspot.ru/

looks like a fraud, because there are no pictures in the profile also indicates the place of residence, gender 'female' in profile, in spite of the man's name.
https://plus.google.com/112943630058334196350/about
Also if someone is really going to act without the police, usually receives a large sum and cover all costs from the culprit.
and naturally never advertise such information.

do not be fooled once again!

As mentioned before, myself and my partner we have already contacted a lawyer in Switzerland. We advised Bitmine we will do so unless they refund us as per their terms. He agreed to take our case and Bitmine will hear from him very soon.

Now, although having two Russian guys break Giorgio's legs might seem like a great way to get your money back AND some satisfaction out of this whole ordeal, I'd suggest staying within the confines of the law when dealing with this issue.

If Bitmine refuses to refund us as per our lawyer's instructions we will press further - if some of you would like the contact information of our lawyer I am happy to provide that to you. Also working together might be cheaper (sharing legal costs).

Ever started a reasonable conversation with bitmine by phone? (without the I want, I want & I want part)
And ask them how to solve the matter?

Dont you think they dont want to solve the matter(s)?

Some people have serious communication problems.
Others have to seek a shrink, there's nope hope for.

If you just calm down on the phone and explain the situation,
they will understand and act if needed.

From their perspective they have also other obligations to forfill.

Lets see it gray-white:
1. you invest in order.
2. they invest in suppliers with own money and yours.
3. supplier is late / other issues
4. you cancel order
5. they are stuck with your order (hardware), and have to resell it.
6. you want your money back.

However, as a business Bitmine has to manage the risk involved in production and R&D.

They have to take steps to ensure customers funds can be returned in the event of failure, that is what a company´s share capital or Investor money is for.

I am quite sure they have more than enough funds available, as they sold miners at 5$ per GH...

At this point in time they are lucky when people settle for their owed money back, as swiss contract law does allow people to claim resulting damages from not fulfilling a contract.

If at any point it becomes obvious that certain safety margins weren´t met, one might be able to sue for fraud.

guess you're right.
Come from from a planet where normal people
live, not like you and others here.

Q: why is it when I write a email towards them I receive an reply?
Why is it when I call them, I get to talk to them, and they fix my problem?

Yes there's certainly something wrong with me...#fail
