Open Source Steel LLC accused of infringing California man's patents

SAN JOSE – An inventor alleges a Washington company has unlawfully incorporated his designs in its products.

Elliot Kremerman filed a complaint on Jan. 20 in the U.S. District Court for the Northern District of California, San Jose Division against Open Source Steel LLC, Joshua Dellay, James Dellay and Does 1-20 alleging patent infringement and other counts.

According to the complaint, the plaintiff alleges that he has been and will continue to be irreparably harmed and damaged by defendants' conduct of manufacturing and selling infringing products incorporating plaintiff's designs that mimic a combination of several elements of plaintiff's product trade dress. He alleges the defendants had knowledge of plaintiff's '310 and '238 patent registrations for distillation heads, which covers the infringing products.

The plaintiff holds Open Source Steel LLC, Joshua Dellay, James Dellay and Does 1-20 responsible because the defendants allegedly could cause confusion and mistake in the minds of the public with respect to the origin, affiliation, and source of defendants' products.

The plaintiff requests a trial by jury and seeks judgment in his favor, damages and costs incurred, enjoin defendants from further infringement, interest, attorneys' fees and costs of suit, corrective advertising, treble damages, disgorgement of profits, and further relief as the court may deem just. He is represented by David B. Draper, Mark W. Good and James A. McDaniel of Terra Law LLP in San Jose.

James Dellay and Joshua Dellay are Twin brothers based in Washington whom have shut down their highly questionable YouTube channels, marijuana forums, and other related information about themselves possibly due to the illegal content and activities that were recorded and documented online.

Stealing others intellectual property is not "Open Source"



They tried to get information on our Cannabiscoin app developments to do the same thing.

Due to current legislation and lottery style drawings for dispensaries in Arizona, D9 and other local investors had plans to open up a CANN dispensary this year but did not get awarded a license as with many others in the industry.  Recreational marijuana also did not get voted in this year which effects many things for our state.  We can only hope it will happen here in Arizona.  We are active within the cannabis community here, donating and advocating the use of cannabis as medicine and continue to use available time and resources to  help build a better platform for cannabis and crypto.  

We ask the community to assist with future ongoing developments and work together to make this community stronger.  We all have personal and professional lives outside of crypto and are limited on resources.  Cannabiscoin remains an open project and there are constant changes on the ground here in the Medical Marijuana industry.  We ask if you have the knowledge and talent that can help the Cannabiscoin community please introduce yourself and we can all stand together.

Push your efforts where legislation did pass.

CA just passed rec MJ and has a strong med MJ community. Penetrate just CA(worlds 6th largest economy http://fortune.com/2016/06/17/california-france-6th-largest-economy/) and success is achieved.
California has long been a starter/leader of trends/legislation that seems to permeate across the country.
