521  Bitcoin / Legal / Re: Do Kwon arrested on: February 22, 2024, 08:46:24 AM
It looks the dodging game has come to an end and the US has won the extradition battle to have Do Kwon tried in an american court according to news from multiple sources. The battle of who gets to taste the first sip of the wine has been lingering for a while now between the two nations and the high court of Podgorica in Montenegro has finally reached a verdict on Do Kwon's extradition case.

I would not put an end to this matter. I know that preparation for extradition can last 6 months minimum, and sometimes it takes more than a year. And during this time we will hear a lot more news or Do Kwon’s lawyers will come up with ways to delay this process.

Reports suggest that the party is considering lifting the ban on spot bitcoin exchange-traded funds (ETFs) and exploring avenues to allow institutional investment in cryptocurrencies, including initial exchange offerings (IEOs)."

Smiley

527  Bitcoin / Legal / Re: Crypto tax law in Germany. How does it work? on: February 21, 2024, 04:45:04 PM
As for the tax residency in Germany that the OP asks, it is the same as in other countries in Europe: you have to spend a minimum of 6 months living there.

This for people who are in the same case as the OP, living very close to a country with a better tax treatment, it is very tempting to rent a house to claim tax residency but without actually spending the required time. To this I have to warn that the tax authorities of the countries have become more and more sophisticated and can analyze things like electricity consumption or credit card payments and if you have not spent the minimum time you are going to have a problem.

It's not that easy to be honest. Many countries in the EU will treat you like subject to their local tax laws unless you prove to them that you're no longer their tax resident and a tax resident is different from a normal resident. You can live somewhere but that doesn't change your residency. To change residency you have to first have registration of residence, or "Anmeldung" is how they call it in Germany. That just proves that you live there and you can start counting your residency from that point. Then you can apply for permanent residence, but residence does not mean tax residence because remember that you're still a citizen of one country, but a resident of another, so you're still on the list of taxpayers in the country from which you've migrated. You have to tell them that you no longer live there and they will most likely check everything thoroughly, because they don't want you to cheat. Remember that you're a money making machine for them. By law most countries will not change your tax residency if you don't live abroad for more than 6 months a year. I also heard that they will deny your request if your wife and children did not move out with you.
This is a general question and depends on double taxation laws between countries. The very fact that a person has lived in another country for 6 months or more does not make him a tax resident. This means studying international legislation or seeking help from lawyers who will advise on the best options, including opening companies in other jurisdictions.
528  Bitcoin / Legal / Re: American banks require permission from the SEC to store cryptocurrency on: February 21, 2024, 04:39:34 PM
Banks in the US have been obstructing the development of the Bitcoin ecosystem in the US for many years, but after the adoption of the Spot Bitcoin ETF, there is no point in this confrontation. If banks used the services of organizations to lobby their interests to become custodial holders of Bitcoin, then according to US law this is possible.
Although it seems contradictory, I expect the banks to obtain approval easily, because this step will be welcomed by the US government, and the banks will obtain the necessary licenses and legal amendments with great ease.

It would be very appropriate for the US government to centralize Bitcoin through ETF companies and central banks instead of trying to ban it. Containment rather than confrontation is the easiest and best solution.

I do not know what the impact of such a move on Bitcoin in the long term will be, positive or negative?
Any lever can be used for negative purposes, but the government always uses levers to strengthen its position and control over citizens.
I don't believe in Bitcoin as a coin that will live for many years to come.
There could be different scenarios when the price falls, investors suffer huge losses and Bitcoin is banned.
529  Bitcoin / Legal / Re: CFTC releases a report on DeFi, recommends certain actions from the government on: February 21, 2024, 04:30:59 PM
Very much to what has been speculated before by some people in the cryptospace, stablecoin issuers like Circle and Tether will become the governments shepherds to control how much inflows of fiat will he allowed in the cryptospace. This is the beginning.

On the government's mission to crackdown on DeFi, this should certainly be encouraged to cause the developers to create stronger infrastructure that would be more difficult to shut down hehehee. This is also only the beginning. DeFi will win.

Crypto critics often warn of digital currencies' potential to destabilize the U.S. dollar, but Federal Reserve Gov. Christopher Waller argued that stablecoins' dependence on the dollar could actually strengthen the U.S. fiat currency as decentralized finance (DeFi) catches on.

Read in full https://www.coindesk.com/policy/2024/02/15/us-federal-reserve-gov-waller-says-defi-could-boost-dollars-global-strength/
I am sure that Circle and Tether are unnecessary players in the future market. These companies will gain huge capitalization, and then large criminal cases will be brought against them, ranging from minor financial fraud to the financing of terrorism. Their assets will be confiscated and the price of tokens will drop greatly. I think it’s too early to do such a maneuver.

Then the government will tell everyone that you are fools, and the agreement on the use of Tether says that they are not responsible if 1 Tether costs less than a dollar.

And then the era of cbdc will come.
530  Bitcoin / Legal / Re: Argentina to Pressure Citizens on Declaring Their Crypto on: February 21, 2024, 04:20:26 PM
What we're seeing here is a political game that welcomes the adoption of crypto but puts all the citizens under government control.
I don't know who is adviser of Javier Milei and what makes him believe this will be a good idea for the country but from what I read about the crypto bill he (Javier Milei) introduced to the Argentine, Javier is planned to encourage them to invest in the Bitcoin spot ETF rather than be a self-custodial crypto holder/investor.

What everyone calls implementation or mass adoption is actually called centralization of cryptocurrency.
Governments will always control the finances of their citizens. If a person is stupid and uses centralized services, then he will not own his coins and will eventually lose his money. Cash in many countries will be reduced to a minimum in 5-10 years.

I know the mass adoption of cryptocurrency will attract centralization but not in the way the Argentine government is planning which sooner or later would put the lives of some cryptocurrency investors in Argentina in danger of burglary and other forms of attack.
Having said that, you said cash in many countries will reduced in 5-10 years. How is that going to happen when the government never seizes from printing new fiat currency every year?
I’m not saying that all cash will be destroyed, but there will be big restrictions.
There are places in Europe where you cannot pay in cash.
Cash transaction amounts are constantly decreasing in different countries, and therefore it will be difficult to buy expensive things with cash.
State support will be paid to citizens using the CBDC.
The US may be carrying out a major reform to replace dollars, and if you have more than $10,000-$50,000 in cash, you will have to prove its legal origin.

and if you can't provide legal origin, what will they do to money and the owner?
Nothing. The US government will give everyone a gift for gratuitous assistance to the state Smiley

Today the dollars are green, and tomorrow the government will issue blue dollars and give a year to replace the old dollars with new ones.
For American citizens there will be large limits and a simple procedure, but for non-citizens there will be an almost impossible procedure when the legality of your earnings is checked, and the illegality of earnings of those who gave you these dollars.
531  Bitcoin / Legal / Re: UK regulator issued 450 alerts for illegal crypto ads in 2023 on: February 21, 2024, 04:13:01 PM
Well that's the job of a regulator. At first, why there is a need of regulator? The definition says are regulator would be an agency to look after the security of the user and to enforce legal actions for non compliance. There is no denying to this fact that Google ads are indeed filled with scammers. Also with the advancements of the AI technology, it has become even more easier to impersonate unknown personality to promote anything. Every now and then I see the implementation of deep fake videos in Google ads. So I think what this independent regulator has done, Makes sense! At the end of the day, we all want the scammers to go out of crypto market.
The regulator in Russia is creating a register of verified market participants, and says that investments in other companies are very risky.

I receive up to 10 calls a day about fraud and financial investments. All this is blocked by special software, but personally, as a citizen, I don’t see much result.
There are a lot of scams involving cloning companies and accounts, and if you are not careful, you will be deceived by scammers.
532  Bitcoin / Legal / Re: Tether Cryptocurrency Becoming ‘Preferred Choice’ Among Money Launderers on: February 21, 2024, 04:04:04 PM
The fud against Tether is very head shaking and it appears it is becoming very clear who might be responsible and where this is coming from. I speculate that this is coming from the American government and with the help of Tether's biggest competitor Circle hehehe. It would not be shocking if the new mayor of bitcoin is helping also.

Caroline Hill of Circle have made their position very clear when she begged the lawmakers in congress to give the treasury department the authority to crackdown on Tether.

Mayor of Bitcoin

In a February 15 Congressional hearing, Caroline Hill, Senior Director for Global Policy and Regulatory Strategy at Circle, has called on Congress to grant the Treasury Department the authority to go after Tether and its banking partner Cantor Fitzgerald. Hill said that the US Treasury Department should have the authority to take action given “Tether’s reputation” as well as available data that “they are contributing to terrorist financing and other malign activities.”

Read in full https://www.blockzeit.com/circles-caroline-hill-asks-congress-to-go-after-tether/
The capitalization of Tether USDT is currently about 98 billion dollars. I think it’s too early to call them terrorists.
Tether is backed by American bonds, meaning they have already given most of their money to the American economy, and for this they received an unofficial work permit. When Tether's capitalization reaches several trillion dollars, they can be called terrorists and their assets as collateral taken away.

How do I exchange for cash?
I heard that Russian tourists easily exchange cryptocurrencies for cash in Indonesia and live there on the income they receive in cryptocurrencies.
Exchange rates in such exchangers may be 10-20% less than on the stock exchange, but everything is anonymous.

From the Centralized Exchange tho there is always a method like using the P2P but the rate might be different. I actually rarely use P2P outside the centralized exchange but I think there is one or two sites or people who do transition using this way.

Maybe those Russian tourists using p2p from the CEx and withdraw it without a problem and the only problem is they should make an Indonesia bank account but here creating an account is easy without going to the bank.

I also heard that Indonesian citizens who study in Russia also use Cryptocurrency to do fiat cross exchange maybe because Swift is blocked by I'm not really sure.

I was talking about exchanging USDT for cash
https://www.bestchange.ru/tether-trc20-to-dollar-cash-in-bali.html
There are many Russian exchangers in Bali that will exchange your USDT for dollars with a discount of 1.1-4%. I saw a very big discount in exchange offices in India, but in Bali the rates are quite good.

535  Bitcoin / Legal / Re: Do Kwon arrested on: February 21, 2024, 03:43:09 PM
~snip~
But the criminal's agreement with the United States is valid only if he returns all the funds to the government. If the violation is discovered even after serving the sentence, the offender will receive a life sentence or more.
And this does not mean that after the trial in the United States, Korea will not stop hunting for Do Kwon.

I have already mentioned the case of the Centra scam and the person who was behind everything, so although it is mentioned that about 100 000 ETH were returned (unofficially), the man completely avoided prison for a fraud of tens of millions of dollars only because he cooperated (put the blame on the associates). Immediately after the verdict, he buys a luxury house, drives luxury cars, and no one asks him where he got the money for all that.

Don't be fooled that the laws apply the same to everyone, because it is more than obvious that everything is a matter of agreement, the ability of lawyers and the lobbying of influential people.
Whoever handed everyone over to the police first is the witness Smiley
I don’t think that this will be a similar case where the fraudster escapes punishment, otherwise the US judicial system will no longer be respected throughout the world. If there are charges from citizens in the United States, Do Kwon will receive a significant prison sentence. I think that negotiations are underway now, and if Do Kwon is not in a hurry to go to the USA, then his prospects are bad.
