Why? Who cares about FCC? It mines and does not catch fire, it is good enough for me.
It could be a flaming torch but the FCC only cares if it interferes with radio signals. FCC doesn't care if it burns down houses. Well there are chips buzzing away at 300Mhz, could interfere with crucial radio bands, especially if it produces a significant amount of 2nd or 3rd harmonics. The metal case may well save them though (faraday effect).

A day later and I'm still stunned. Hopefully will get refunded to Paypal today and put Butterfly Labs into my rear-view mirror. Your list is pretty reasonable, PL. Instead of BFL being reasonable, they now have one pissed off former customer who is even angrier than before, and two formal consumer complaints against them with various government consumer protection agencies. As tempting as it is to use some of my industry and media contacts ("Hey, know about Amy's Baking Company ? Boy do I have a similar tech-related story for you...") to shed way more public light on this insanity, I'm just not "that kinda guy". Yet. This case should serve a chilling cautionary tale. All I wanted was my BFL product and not be constantly lied to. Guess I expected too much.

I'm in the game to try and make some money. Putting all your eggs in one basket (be it avalon, BFL, or anybody else) is foolish, IMHO. I'd be offering a similar response if somebody had let their mouths run them out of Avalon or ASICMiner as well. But those companies aren't the 'hip' ones to troll on this forum, so all of the lemmings here think that if they want to be a 'cool kid' they have to trash BFL. Fine. Say and do what you want, trash whoever you want. Just don't come crying when the companies you're trashing kick your ass to the curb. Make up shit, forge order documentation and post false shipping manifests. Just don't come crying if/when you get your ass sued for libel/defamation.

Say what you will about Avalon Batch 2 and 3 delays, or the pricing of ASICMiners products, but they have clearly demonstrated that they can deliver. Point is "nobody ran their mouths off to an extreme at Avalon or ASICMiner, because that level of frustration wasn't warranted."

Wall-of-angst Deleted. I've never ever felt this abused as a customer before. Filed a complaint with the Missouri AG Customer Complaints dept and the FTC Complaints Dept. Provided a Paypal address to office@bfl to get refunded for $4,698, hopefully, and moving on with my life, although I'm not confident of even receiving a refund for whatever long, and possibly more drawn-out, punitive shenanigans with the way this is playing out.
Sorry for getting all fired up like that, forum-denizens. I guess I hit a frustration limit I've never personally experienced before when purchasing products, and way overreacted.
Lessons learned, namely, if I'm going to be critical of a company I plan to do business with, I should probably choose a moniker that they can't trace back to their customer database.
You didn't order a product! You placed a per-order for a project in development. I too am somewhat annoyed over the lack of delivery, communication and the long lead time but seriously you need to use your judgement. BFL has also been offering refunds freely to anyone who wants them so I don't get this "outrage" no one is forcing you to wait.

I think that what Xian tried to do was encouraged people who have BFL orders to cancel and bump his order. After seeing a trickle of Jalapenos out of the assembly line to customers hands, he ordered more and doubled his efforts but the plan backfired. I've seen this kind of behavior before from people who were wait-listed/in queue.
