Yeah, and now he's going to try to play internet lawyer. I have news for him - I own more shares of 100TH than he does, so he's outvoted.
I could care less! It's all about what it right and fair.

As was stated before... some people are just angry and will never be satisfied. Personally my MBP purchase experience was night and day compared to my Avalon one. Keep up the good work Dave and crew... you are definitely setting the standard on customer satisfaction... now if only Tytus could come down a bit on price

I find it interesting, he is putting you in the same position that he was in on his previous failed project. He's pulling a "Tom" and using you to respond what what he will not address directly.
Dave is not doing anything like that. Dave is very busy working on deploying hardware and fulfilling obligations. I am doing this of my own free will to take some of the load off of him, as I won't be able to help with the deployments until Sunday. I am sorry that you and I cannot see eye to eye, and also sorry that you felt that my above negotiated offer of the theoretical maximum output was insufficient. If you would like a larger cut from 100TH mine's output, I suggest you ask Tytus personally and/or pose a vote to the shareholders of 100TH mine, as our position with 100TH is limited to that of the hoster, deployer and operator, not an owner or decision maker. Anything they agree to we will of course abide by. As of now we feel that we have made the most fair offer we possibly can to provide for all of our customers. You are also free to request a refund at any point and we will honor it without delay. Thank you for expressing your concerns to us. First, your offer was unilateral. As per your statement of a negotiated offer, you are acting as an official agent for megabigpower and your actions here are deemed as official and on the record. Additionally I am a shareholder in 100TH->200TH mine, maybe you should have read the thread a bit more before jumping in. I will not request a refund on the hardware you have embezzled, I do officially request specific performance for you to deliver all orders immediately as Time is of the Esence, as per what was offered and accepted in the terms of purchase as the public statements made by Dave (BuzzDave). I will expect delivery immediately via overnight shipping as I have already paid for it. They are giving you the same you would make with mining minus all other associated costs until they ship your hardware and you are still fussing? Bizarre. You actually do not know how I mine or what my intentions were with the hardware.

My objection is how they made a decision and imposed it on all of us. Mainly for their own profit. If creating a bias that I am angry makes you accept their action, then be at peace with that.

My guess is you are selling it at a premium to someone else and every day its late someone else is pissed at you, at least that was the first thought that came to my head as to why the compensation wasn't good enough. Anyhow their offer seems way more than fair considering this is the only company to ever do this and they certainly didn't have to.

Pretty much my thoughts - an eBay seller with an upset buyer, threatening to charge back. Whatever. My suggestion is to just use the ignore key...

It doesn't bother me any I was just confused as to how you could even complain about the compensation. Anyhow I will just stop so we can allow the thread to continue with its original purpose.

lol, no buyer, I would not sell without unit in hand, I've been mining since March of 2011. Please use your ignore, that way I do not need to waste my energy on someone who cannot possibly understand or appreciate the position that I am coming from. Only people who wish not to be f'd over will read my post.

Actually, I'm pissed that they said they were out of M-Boards, I could deal with that, but when Dave posts in another thread that they brought another 50 Rigs online, I feel like I am getting screwed. They are using hardware allocated to fulfilling my order to their mining operations. My position is I want to have the option to do with my hardware as I want, selling, trading or keeping.

I'm sure you'll care when an injunction is filed holding all payments until a resolution is accomplished.

He (Dave) really got to you. Relax man. Bitching here will not change a thing. If you don't like how he does things, don't buy from him. Ask for a refund. So far, he has been more transparent than other ASIC sellers.

Dave want's to ignore me, good, dig your own grave, they send in some young naive kid to run interference, fine, his ass will get caught up and it will be on his permanent civil record as will all his staff. He tried to give a shit deal, he didn't ask, he imposed, too bad, he made his bed, now he has to sleep in it. His refusal to head it straight on, shows how much he realizes how he was so caught trying to F over people. You do realize that anything said/stated is admissible in any private/criminal action

Only person feeling this f'ed over is you. No company can please 100% of its customers, never happened and never will. There is always a small percentage of people no matter how outstanding a company is, that will never be satisfied. Not saying your concerns are not important to you or not valid but you're flame level is off the charts. You might want to take a break from posting to calm down and reflect if this behavior is really necessary.

Not quite. My flame level is inversely proportionate to Dave's attempt to ignore the facts that I have stated. I would have been satisfied to receive the hardware I paid for on time, not having to read he accomplished 50 rigs and his contradictory statement he was out of boards to fulfill orders. He lied! Answer my questions directly Dave. I hope your wife and family can be proud of your decisions and actions.

I'm sure you'll care when an injunction is filed holding all payments until a resolution is accomplished. You can waste your time if you want but you have no case. You ordered a product product is delayed. Your options are to wait or ask for a refund. You were offered a full refund and declined. If you do decide to sue anyone you will lose. You have no damages. You may think You have damages but you don't have the kind of damages a court would recognize. Trust me on this one I have lots of lawyers in my family. You would end up paying for both your legal costs and Dave's as your case would be dismissed as frivoulous. I have no stake in the 100TH mine nor have I ordered a bitfury device. Just following this thread because I am thinking of ordering an ASIC unit in the future. You should know that to a neutral party, you arguments come across as weak and your tone makes you sound childish and spoiled.

Maybe it's time Dave does a "forced refund" for Mobius which is common practice with certain ASIC manufacturers.
Not proud of that Butterfly Labs episode, but this level of vitriol towards Dave and Co. at this time is unwarranted, IMO. Barring a couple speed bumps and part shortages, this has been the most professional and timely ASIC project I've seen so far. They are clearly shipping, are making a very reasonable effort to mitigate loss for August orders, and by all accounts, it would seem that production will be ramping up once the parts come in, and quality will most likely be improving with assembly refinements as people in other threads discuss issues with this first batch. Lets try to get some perspective here. I don't understand where that level of anger is coming from.
