Transactions must be included in a block to be properly completed. When you send a transaction, it is broadcast to miners. Miners can then optionally include it in their next blocks. Miners will be more inclined to include your transaction if it has a higher transaction fee.

As for adapting the core protocol itself for smart contracting, I don't believe that is something actively in development.

just opened my wallet for first time since last year.  It said warning please update before October of 2015.  Ha, I take it that means I'm holding dead coins?  What a racket that would be.  I thought the point of investing in blockchains was immutability?

Please someone tell me my coins are still valid.  How would I know if they were valid or not

You're welcome. I'm surprised David hasn't himself said anything - you might find more activity in the Reddit (http://reddit.com/r/blackcoin). I know he wanted to finish off some bits before open sourcing it - the latter is probably why it never became known widely.
