Vote with your feet, by filing a real complaint - it only takes a few minutes at https://www.ftccomplaintassistant.gov/ - The FTC will only take action if they receive a number of real complaints.

I honestly don't see why it would take several filings before they act, when one letter should do it.

It's obvious even to most brain-dead person that nobody has or will receive what they paid for a year ago. Case in point, is the missing PSUs which, by the way, allows BFL to make more money on the shipping since the boxes will be lighter.

I wouldn't be surprised if Sonny Vleisides charges his employees for using the toilet paper.

The regulators and law enforcement have to make a conscious decision to pursue a matter of this type (which is why more complaints = more likely they will spend resources to investigate).  Even if they know about it (which they clearly do at this point) they may decide (for any number of reasons) not to pursue it.  With that said IF they do decide to "go after" BFL it will be methodical, slow and fact based.  They will take there time and build a rock solid case (remember a win is all that matters to these folks and their careers, not the consumers best interest).  Lastly there is a very real possibility that the AG may be diving much deeper than say UCC laws, FTC regulations.  If they are investigating BFL and Sonny they may be looking for other violations.  There as so many laws on the books that they may be looking at other avenues to pursue as well.  IANAL and I don't have specifics in mind but it's not hard to believe they may be looking at mail fraud, wire fraud, false advertising tax evasion and the list goes on for a long time.

Just because law enforcement hasn't taken action yet doesn't mean they aren't and won't however you and I won't hear about it until well after BFL does!  They will not tip their hand and they have all the time in the world so to speak.

How long did it take from Pirate disappearing until the SEC weighed in last month?  DO NOT believe Josh when he says that just because no one is doing anything right now that things are not being done.

In 2006 the USA passed the UIEGA which was aimed at stopping online gambling in the US.  A few brazen poker sites still served the US and they "allowed" two of the biggest sites to serve US customers for almost 5 years before going balls deep with indictments on those two corps.

i did that a couple of weeks ago, i got the standard "No" form letter. I really want my equipment more than the money though so i let it ride for now.

It's looking like the next difficulty is going up 25% tomorrow. You sure you want to let it ride?

This is the problem:
I could have bought a jally for 13 BTC (then $160) when they first came out. That machine could have made me 10 BTC over its life (now $1000+).

You would have given up 13 BTC to get 10 BTC.
That is a loss of 3 BTC.
If you are buying a miner, it is surely because you want to get more BTC.
Instead, it gave you less.
It has used up lots of electricity, and generated lots of heat, to leave you with less BTC than you started with.

You guys should read the rule further.  BFL has received customer agreement to an "indefinite delay".  When you purchase a BFL product you agree to wait 2 months of more.  According to the mail order rule this is what a company must do if they ask for and receive an indefinite delay.  I've pointed this out in a number of threads and people seem to ignore it.  BFL IS FUCKED IF THE FTC DECIDES TO PURSUE THEM.

Not only must they offer cancellations/refunds they must provide the client a statement that they have the right to cancel the order any time until the product ships.  So BFL is not only doing the opposite of what they are supposed to, they are also further breaking the mail order rule by telling the client no refunds are possible.  They are telling the client the exact opposite of what the FTC tells them they must tell the client.

•a statement that, if the customer agrees to the indefinite delay, the customer may cancel the order any time until you ship.

BFL is playing a very dangerous game ATM, IF the FTC decides to go after them, I would bet dollars to dimes BFL gets their ass handed to them on a platter.

Is there a rule against using multiple accounts to try to spread an opinion of a business? I would like to see if it is possible for an admin to check if the ip addresses are the same.



The official forum rule about sock puppets, is they are explicitly allowed (because they can't stop them) coincidently account selling is also perfectly acceptable here.  As far as I have seen the admins will not check IP's (mods apparently don't have the ability).

What I am wondering is:

-Did BFL get enough pressure (or finally wake the fuck up) and are starting to honour refunds and they are trying to keep it as quite as possible to stem the flow so to speak (ya unlikely I know but I have to consider it as possible)
-Did your pressure aid in getting you only a refund (did you file a complaint with any government agencies?)
-Was this a mistake or something like that on BFL's part

I think these Asic companys are under the impression they can sustain a cycle of high prices, piss poor support, and products that are outdated when they get into customers hands. Its down right embarrassing, some of these venture's cant even put up a website with a half decent shopping cart. They cant even write a privacy policy or mission statements.. they are using templates and basically are under the impression that their customers are there to be abused.

They are under that impression because there are enough optimistic buyers to support them.  Just look at the Monarch, it appears to be selling well despite all Josh and BFL have done to try and convince people not to buy their stuff!  Look at the numbers from an investment stand point, there is a very strong argument that simply buying and holding BTC is a much less risky investment than mining, and even if mining pays off as a better investment the margin of extra profit doesn't seem to correlate to the extra risk associated with it (again look at BFL for clear examples of how holding BTC would have been significantly better than mining).  For every person that doesn't like or support these type of companies there are 20 optimists waiting to take the gamble cause hey mining with ASIC will make you filthy rich now right?

30 days seems really short for a $4500 computer product - don't most warranties on computer equipment last at least a year??  Even if they offered to sell an extended warrenty it seems like a better idea then putting it at 10 days!  Seriously - if I had it for 11 days and it started on fire and they told me they wouldn't cover it (even though I was operating in all the "appropriate" conditions) I'd be seriously pissed off!  Thanks for catching this...

Avoiding most consumer protection (which is funny they care about miner protection but not consumer protection, aren't they the same people?): check
10 day warranty for an almost 5k product to go along with all the miner and consumer protection: check

Received the coins. It took 8 days since my first email to them. Expected this to be much harder.

Was there any correspondence from BFL you could share with us?  It is weird that they seemingly so easily gave you a BTC refund after they have been publicly stating for a few months now no refunds will be honoured.  I am curious why you are the only non PP customer I have seen recently get a refund.

They are all taking MILLIONS in full payment pre-orders and they can't get a website shopping cart straight.

I'm not clear on why people say that BFL is a scam. I guess their definition of "scam" is different from mine, or perhaps I am missing something.

To me, a scam would be taking pre-orders without ever intending to ship anything. BFL is shipping miners, right? So, what is the scam?

I don't think the fact that they are shipping 8 months late is a scam, either. I doubt they intended for the delay to be this long. Without intention, how can there be fraud? No fraud, no scam.

I sympathize with the people that pre-ordered, but this is clearly a case of BFL incompetence, and not a scam.


BFL is breaking federal regulations by not allowing customers to cancel their orders before they ship their product.  They are also breaking federal regulations by not telling their customers that they have the right to cancel at any time before they ship their units and in fact BFL is telling their customers the exact opposite stating refunds will be refused.

BFL doesn't understand the legal difference between an order and a sale and are using false language to illegally hold customer funds that want it back.  Basically they are trying to get the uninformed to roll over and give up on trying for a refund by stating "All Sales are Final".

BFL is a scam rest assured, delivering a small percentage of units to a small percentage of customers doesn't automatically disqualify all the other relevant facts.
