I'm not convinced BFL's current timeline is reasonable - unless they're intending to ship out units that are totally untested and just hope they work (and continue to work for a significant period of time).

It's highly unlikely BFL can deliver by 22 February, but they may be able to ship around the time of the next difficulty jump.  Sooner or later Avalon units and BFL units are going to enter the wild in large numbers.  ASICMiner has a fairly unique opportunity for a very short period of time here.  Yes, they'll bring the next difficulty jump closer if they throw everything they have at the network and they'll have to mine at the higher difficulty themselves - but it also means that their competitors' units will be starting out at that higher difficulty. 

If ASICMiner doesn't exploit the advantages available to them, they'll lose them - it's not like Avalon or BFL customers are going to hold off mining with the machines they've waited months for just because it's going to affect difficulty.

Well we don't know how he's doing it.  For all we know he's testing machines one by one, then taking them back offline - with the plan to put them all back online when difficulty rises.  I haven't (and can't be bothered to) done  the math to figure out if that actually makes sense (giving up earnings now for lower difficulty later) but would assume he has if it's relevant.

Difficulty just jumped to 3651011.63069.  Around the time of the next jump, BFL machines should be coming online and that will affect the following difficulty jump regardless of what friedcat does. This current difficulty period seems like the ideal time for friedcat to put his 12 TH online.

If something like that went to trial you need witnesses in person along with expert witnesses who can explain Bitcoin.  Then, even if you get a judgment, you still need to collect it.  http://en.wikipedia.org/wiki/Digital_evidence

It's not necessary to bring the nature of Bitcoin into a breach of contract action - in fact, if you read the California action filed in respect of Bitcoinica you'll notice that they've been careful to avoid making the nature of Bitcoin an issue and kept it about the USD value owed.

What might be an issue is people not having acceptable proof of their transactions.  If Tom has adequate records, this shouldn't be a problem.   If he doesn't, though, it's much more difficult to obtain independent evidence relating to the transactions than it is with bank, CC or PayPal transactions where a disinterested third-party can provide information relating to the transactions.

I still haven't seen any updates on what's happening at the bumping facility or how a slip in the bumping facility schedule would affect the remaining steps in getting BFL ASICs completed.  I suspect that there's no hope now of them shipping on 22 February - the question is whether they'll be able to ship before March.

Well then you want to get in touch with your CC provider as my refund asked for date was similar to yours maybe a day or two earlier and it has been refunded to my account for weeks. When you do get in touch make sure to mention this was pre-order as the expected date of delivery is when the clock starts ticking for a chargeback not the order date. If it was not so I would have been screwed if I had had to do chargeback as I was over the 90 day limit from my provider when I requested the refund using the order date as the start point.

You can also mention that the company is being investigated for fraud and that several banks have advised people who paid by CC to cancel their cards and get new ones issued.  Where fraud is involved, CC providers will generally waive usual charge-back period limits.

that's called deflation: hold it until there is no other possibility. which is good for an asset but not for a currency.

Most people who don't plan on bequeathing their wealth to someone else are intending to liquidate their assets at some point - whether those assets are BTC, property, or Berkley Hathaway shares.

While everyone should make provisions for living comfortably in retirement, quality of life in the meantime also matters (after all, with official retirement age nearing 70 in many Western countries, a lot of people aren't even going to live to retirement age).

If the other 10 TH was running, you'd notice it in the overall network hash-rate very quickly.  You can't hide 10 TH in the current network, whether you're mining solo or through pools

Im surprised no one has setup a passthrough yet. I know there is a trading platform coming but in the meantime a pure passthrough might be the way to go.

Do their rules allow it?  They seem pretty intent on doing everything possible to keep it as a legitimate investment and avoid the kinds of cluster-fucks we've seen in the past due to sketchy intermediaries.  You can almost guarantee that if they allow anyone and everyone to operate a pass-through, someone will eventually scam people who invest in the pass-throughs.

You can't really disallow a passthrough. How would you do it?

I guess I'm thinking of the way you could do it here, which is by setting up a class of shares which can only be sold to other existing shareholders or back to the company (you can essentially attach any conditions you like to share classes in a private company here are long as those conditions are fully disclosed).  If such conditions aren't already baked in, then you'd obviously need a special resolution by existing shareholders to implement them.

It will definitely be interesting to see who operates pass-throughs and how well or badly they manage them.

Let's wait until everyone's been refunded before we get too excited.  I don't think we've had one of these clusterfucks yet where every single person has got back everything they were owed, although we've had several where many people got partial payments or some people got paid and others didn't.

Heh.  It's still pretty impressive.  If they can get the whole 12 TH online before BFL ASICs hit the network, they will be looking at about USD 50k per day.

I roughly estimate the debt to 100k USD, and roughly estimate the stress test mined coins to value around 150k USD.

How did you arrive at the USD 150k figure?  I calculate it to be about a tenth of that using shares*PPS.
