In polite circles, its fashionable to say someone 'Mis-spoke' …

Or maybe it was the simulation results that encouraged them to say this …

Or maybe it was the need for some positive news …

It is hard to interpret anything they say or do kindly after all the forum bannings, post-facto editing of terms and conditions and other company statements on the forum, deletion of customer posts on the forum, lack of good will towards customers regarding refunds, absence of transparency into development, missed deadlines etc etc etc

But who knows, maybe Dexcel told them the chips turned out better than expected ...

Maybe, maybe not. 10% of the company, for helping them out of a hole? If they manage to perform a miracle and actually ship units, then it's a sizeable stake. If they go under, he hasn't got much to lose. I think he's just offering guidance.

They claimed that after the first tapeout disaster, someone came along and pumped them with money to carry them through to the end.

That's a lot of "guidance".

Sounds like a scam to me.  From my understanding, in the UK, only a judge can turn several cases into a class action.

"The main benefit of any class action is that the costs are divided equally between clients therefore making litigation viable for almost any client."  This is the most scammy part.  In a class action, the clients don't pay up front, the lawyer gets a very large cut of the final product, usually 25-35%.  A "Lawyer" emailing you out of the blue telling you how cheap it is... SCREAMS scam.  Never pay up front to recover fund owed to you... It's called "throwing good money after bad"... Meaning Giving someone $1k up front to recover $2k will most likely result in you being out $3k.

I have not been in this thread since I posted pissed off comment in January about them stealing 40% of my refund plus fee. Seeing all the crap here now Im really glad I got my refund before it was too late :-)
Haven't been that lucky with Black Arrow and Hashfast though

They are probably quite successful. I used to live in the Notting Hill Gate area just up the road many years ago. Its a posh area full of successful small businesses and expensive residential areas on a road that runs from Notting Hill Gate down to Kensington not far from Kensington Gardens and Hyde Park, and eventually on towards Harrods.

It wouldn't hurt to give them a chance and hear their terms and advice before you decide to participate.
My guess is that they are trying to judge the number of people who might like to participate, the scope of damages and the likelihood of recovery before they decide its worth their while. If I had an Alpha-T pre-order, which I don't, I'd give 'em a chance. At the very least, if I felt unhappy with Alpha-T, I would let them know why and how much money you have at stake.

It looks like the best offer on the table at the moment.
