Guys, investments and bets are not the same thing. You're both confusing a "gamble" with "risk". Gambling is risky, but risk is not a gamble. Gambling involves blind luck. When you walk across a tight rope, you're risking your life, but it's hardly blind luck. Anyone making this bet is basically blindly gambling. If you invested in pirate without even bothering to research his business model, find out his info, etc, you're also basically gambling, but only -you-. Others who invested in him may not be gambling, they may be just taking risk. I am taking a risk with this bet. I believe I know what he's doing and I believe it is not a ponzi. I am taking a risk of being wrong, but to me it is hardly "dumb luck". That said, since I have absolutely no control or even influence on payment, I admit that I could succumb to dumb bad luck and lose on a shit technicality (couldn't make it to the bank on time, lost his password, electricity cuts out, tornadoes takes out his house, any number of things).

This. Pirate's agreement with Goat only includes themselves. Nobody else.

Its basically 3rd party beneficiary.  The bond never limited this liability.  The whole reason goat setup the bond was so others could use it as a PPT.  It was setup to benefit someone else.

I think PPT operators should bear in mind that if they choose to negotiate with pirate on behalf of their investors, they'll probably be leaving themselves wide open to liability if the investors are not happy with the outcome or if they do not vigorously pursue any and all means possible to recover their investors' money, up to and including taking legal action against pirate.  I'd strongly suggest that the PPT operators seek legal advice regarding their own position should they advise their clients not to deal with pirate directly.

I don't think PPT operators are even considering such a thing. What we're seeing though is outright -blockage- of client information. Chaang Noi is refusing to allow his own clients to contact Pirate even if they -want- to. That's going to make calling my bet a bit difficult to say the least, if everyone got paid except Chaang Noi's clients due to his stubborness.   Undecided

It would be easy to show a jury that pirate told his pass-throughs to supply sub-account information, therefore he could not use that as (legal) justification to claim his contract terms were broken.

Give it up. BTCST will never be in front of a jury. I will book odds on it if you think that scenario is realistic. Off the top of my head, I'd offer 8:1 or more. Let me know if you want to give me action & how much you'd want to risk.

This might be a good way to pay for court costs.
