It's mixed, and, btw, if VB token ever did institutional sales (most likely it did not), it could be also in trouble as court said that institutional, but not programmatic and secondary sales, are securities.

In a significant ruling a US judge has declared Ripple XRP as not a security ending a years long legal battle with the SEC. The judge denied the SEC motion against the digital asset and ruled against its claims of XRP being a security. This landmark decision could have far-reaching implications for the cryptocurrency industry as a whole.

(Reuters) -U.S. District Judge Analisa Torres said Ripple Labs Inc’s institutional sales of its XRP digital token violated federal law because they constituted the unregistered offer and sale of investment contracts, according to a ruling on Thursday.

The SEC had accused the company and its current and former chief executives of conducting a $1.3 billion unregistered securities offering by selling XRP, which Ripple's founders created in 2012.

Torres, who is based in New York, said the company's $728.9 million of XRP sales to hedge funds and other institutional buyers amounted to unregistered sales of securities. However, Torres said the case must go to trial so a jury can decide other aspects of the SEC's claims.

Looks like we have a breakout on our hands. After a couple weeks of straight sideways even this little move upward of a couple percent seems significant. It seems pretty clear now that $16K was the bottom and the train is starting up to get ready to leave the station. I wouldn’t want to be on the sidelines right now.

Some more market news. It looks like with Ripple winning their court case that Coinbase decided to immediately bring back XRP listings on their exchange. I didn’t think that Coinbase was team Ripple so I find this slightly surprising, but less so when you see that Coinbase is complaining about regulators. Seems like they’re poking the bear a bit.
