I'm curious if cryptsy or bittrex got a subponea, especially cryptsy since Vern opened up a USD/XPY market...
I think cryptsy is a registered MSB, so they most likely did. I don't think they'll be in trouble since they were operating on a good-faith basis with GAW. This is just a guess though.

This is so epic I actually took some BTC dust and bought a paycoin for nostalgic purposes! This is going to be a legendary fail. I want a physical coin with 1 PayCoin inside Only one i not buy more. You bought 1 XPY already? I´m thinking about doing it now. Go ahead it's so cheap I bought it from dust on cryptsy I totally forgot about. I screwed up though in my hurry I actually got 1.17 XPY. To the mooooooooooooooooon!!!!!!!!!

One of the most interesting issues w/ the SEC investigation is the potential effect on proof of stake coins.
Hmmm I wonder what will happen to coins like peercoin. Forgive my ignorance but what is the issue of POS v.s POW on an investigation?

Oh, but we did. That's kind of the point. At least the ZenPool "mining" involved market activites, which means we were getting a share of capital gains. "Mining" ZenPool was a form of investment. That's why it was illegal.

IANAL but I doubt SEC wants to actually talk to any GAW customers except a few large-ish ones perhaps. The stuff they're requesting about customers is mostly regular business accounting, they'd need all that to conduct any decent investigation. Also GAW's failure to produce such business records would be quite important by itself.

All 50,000 of the emails leaked last night are fake , eh? Cool theory bro. Even the random one I posted a screen of last night from Scott Booth which he verified was the real deal? (Sorry about that, by the way, Scott. Just figured it was a clear way to verify these- and I removed the phone #s)
It's OK. That specific communication was a message (sorry for the typos) submitted via their support system since Garza and I were already at-odds and he was not responding to my normal commutations regarding the several thousand in BTC he was STILL holding in my now locked Zenminers account after banning me for the 3rd and last time from the HT forums. In total it took over two months to get access back to my BTC and by then the value had tanked so it is what it is... Scott-

What about an "immortal" hashstaker with a loaded XPY, can't beat that Seriously though, I also agree with many here that this is it for XPY. The GAWtards will try to believe all mails are lies fabricated to destroy the mighty XPY because it was such a big threat to Bitcoin for a while more but every hour forward, there will be new ex-GAWtards who will start to see the light. I know MrCoins is actually a very nice person, who is very devoted. He is the kind of guy any coin hopes to get as your supporter as he puts his money where his mouth is, but lately it is very clear that he made a bad decision supporting XPY and is in it too deep to see the light. We have had some very nice times together and I feel sad for him now. Same time I do not accept that he seems to try to do some CPR on the scam, not maybe thinking about that he needs new victims for the scam to be able to exit without huge losses. I also think that this badbitcoin.org guy is very out of line running a site where he reports scam sites while openly shilling for XPY/GAW on both twitter and HT, trying to be an authority on internet scams and promising everybody that XPY is legit

That's why it was illegal. But there's the rub though. What we were sold was sold as mining capacity (specifically, a "cloud miner"). It wasn't until the downfall of zen that it became really clear that it was actually a derivative. Until then there wasn't much difference between what was being sold (a "virtual" miner) and if we purchased a physical miner and pointed it at a particular pool. GAW running zenpool was illegal, but people thinking they were buying mining capacity in good faith most likely wasn't. IANAL but it seems to fail to provide any mens rea. And being a customer doesn't automatically make you an investor. If I go to walmart and buy a roll of toilet paper, am I now an investor? The ICO is a different story, but again, GAW stated several times that they were working with regulatory authorities through the process to ensure compliance. So again, customers should be safe. I still maintain that they most likely want the information to see how many individuals were definitively impacted. That kind of information is important in determining punitive damages against GAW. Also if GAW can't provide all of the information with proof, they are in violation of "know your customer" laws that a lot of MSB's have to maintain.

I'm pretty sure you ALWAYS have the option to go tell someone to go fuck themselves at the end of the day The onus on a libel/slander charge is on the person to prove that what you are saying is false. So far as I know, GAW hasn't proven themselves to be legit.

There was something posted on GH forum about one wallet having 30% of all coins gathered last days, so it might be that this wallet is not staking at the moment, but if this is the case, it should get all "unstaked" stake when it does open up for staking due to the coin-age variable. Maybe they will fork the coin with this massive wallet?

So far as I know, GAW hasn't proven themselves to be legit. Yep, before you start libel claims you better be sure you can prove what the person is saying is not true and even still its not easy. It's beyond comprehension that Gonzo was wasting resources pursuing fruitless endeavors like this, then again while the ship was is sinking he was is talking about going to space so it's foolish of me to be surprised by anything he does. Gonzo has proven himself incompetent every step of the way and on every level possible and you can quote me on that.

I reserve the right to seek recovery for the time and legal costs both me am my company have incurred thus far regarding Garza and his associates. However, it has been advised to wait until the FinCEN matter has been legally settled in order to anchor the evidence. Even if there is nothing left financially on his side, a default judgment is a viable consideration. Regardless, we are not there yet. Scott-
