1401  Economy / Scam Accusations / Re: Scammer tag: PatrickHarnett on: November 08, 2012, 08:13:49 PM
You need to read up on contract law then.  Anything written can count as a valid contract.  Heck, even a verbal or handshake agreement can be a contract, and enforceable in court.  The only thing that needs to be done is the contract has to be proven.  IRC logs can server that purpose, as can emails, recorded telephone conversations, etc.

The only thing an official signed contract does is makes it easier to enforce, especially when it comes to the nitty-gritty details.  But from what was said in IRC, this is easily an enforceable contract in which Patrick promised to pay back interest on a loan, and has failed to do so.

Unless Patrick repays the loan, he absolutely SHOULD be called a scammer.  He has an obligation to pay, because he said he would.

http://common.laws.com/contract-law

Quote
The most important feature of contract law is that one party must make an offer for an agreement that the other party accepts. When the agreement is made tangible through a signature, the agreement takes the form of a legally-binding document.

http://signaturecapture.com/laws.htm

Quote
For an electronically signed document to be enforceable in court, it must meet the requirements for legal contracts in addition to the electronic signature guidelines specified in the appropriate laws (e.g. UETA, ESIGN, etc.). According to ESIGN, an electronic signature is "an electronic sound, symbol, or process, attached to or logically associated with a contract or other record and executed or adopted by a person with the intent to sign the record." In contract law, signatures serve the following general purposes:

Evidence: authenticates agreement by identifying the signer with a mark attributable to the signer that itself is capable of authentication

Ceremony: act of signing calls attention to the legal significance of the act, preventing ‘inconsiderate engagements’

Approval: express approval or authorization per terms of agreement

http://www.legalmatch.com/law-library/article/writing-and-signature-requirements-for-a-valid-contract.html

Quote
Handwritten, stamped, engraved, electronic pen, and photocopied signatures are all generally adequate to validate a contract unless the circumstances of the contract indicate otherwise.  Some states indicate a simple mark or “x” is sufficient as a signature, but if this is an issue in a case, courts will look at all the facts to determine whether both parties intended to enter into the contract.  Electronic and email signatures are now valid, but the exact requirements of electronic signatures vary from state to state.

http://www.australiancontractlaw.com/law/formation-formalities.html

Quote
The following discussion is based on complying with the formalities required by s 126 of the Instruments Act 1958 (Vic). The easiest way to comply with the formalities requirements in this provision is simply to enter into a written contract signed by both parties. This is not, however, essential. It is sufficient if there is a memorandum or note of the agreement (this might, for example, be as informal as a diary note or letter) and it is only necessary for the party against whom action is being brought to have signed it. The note or memorandum must, however, contain all the material terms (eg, identity, subject matter, consideration).

Deposit was made, as per an agreement. Deposit was not returned, as per the agreement.

Still, you did not provided the evidence required.

Where is the contract that you both signed to a third party verify the legitimacy of your claims?

The legitimacy of the claim is not disputed. Heck, the scammer is not only taking the Nefario route to PR, but moreover the address was listed in his list of depositors that he himself maintained for the entire interval.

You transferred 500 Bitcoins to Patrick and did not require a signed contract to secure or to determine both parties obligations? Is that the way you handle your stock exchange business?

If you think an IRC log represents a legitimate contract, you have completely failed.

How do you expect a third party to trust in your claim if Patrick alleges that your claim was not a mutual agreement? How could a third party be sure that no other agreement was settled between both parties?

IF augostocroppo would do an analysis of MOE-PR's posts as he has with CharlieContent he would probably identify similar attributes.  Members trolling these board for their own humor and amusement while really adding nothing to any meaningful conversation.

I recommend you look at the thread where the user MPOE-PR requests a scammer tag for Theymos. If you compare that thread with this, you will realize that evidence is a concept outside the scope of the user MOE-PR. That and this thread are just claims...

http://oxforddictionaries.com/definition/english/claim?q=claim

Quote
Definition of claim
verb
1 [reporting verb] state or assert that something is the case, typically without providing evidence or proof.

And the user that was shilling for usagi for months and egging her/him/it on with trying to discredit as trolls those who were asking valid questions; that user is now a valuable "analyzer of posts"?

False statement. I never have been "shilling for usagi for months" and I never "discredit as trolls those who were asking valid questions".

He's also one of very very few people here who actually behaves like a businessman, instead of just imitating being a business man like most cargo cult followers here.

A user which is unable to require a signed contract is not businessman...

I am relatively certain the only one who agrees with Joel in this thread is Joel.

I fully support JoelKatz arguments, which are very reasonable and based on factual data.

Political views
I am not a libertarian, and I find many of the views expressed by people in the Bitcoin community to range from silly to appalling.

What is your political view regarding the diplomatic relations of Israel with Iran and Palestine?

Are you religious or atheist?

What are your origins? Your parents or grandparents migrated to Israel after Second World War or they were already established on the region when the state of Israel was formed?
1405  Bitcoin / Bitcoin Discussion / Re: Could declaring Bitcoin a religion protect it from Finacial Regulation? on: November 05, 2012, 12:15:05 AM
The title says it all- tax exempt status, the act of transacting Bitcoins an act of faith with the scripture of the blockchain?

One could even argue it might protect Bitcoin from being outlawed in countries that recognize freedom of Religion.

Tax exemption for religious enterprises is a form of financial regulation:

http://oxforddictionaries.com/definition/english/regulation?q=regulation

Quote

noun
1a rule or directive made and maintained by an authority

The tax exemption is a "directive made and maintained by an authority".

I’m currently on sabbatical from my job as a conceptual copywriter in a big London agency. I’m taking a year off to enjoy being a new father and support my wife, who sadly can’t afford the luxury of a long career break. I really want to keep my hand in (daytime TV is killing me! Too many of my old ads!) but the terms of my contract prohibit me from taking up any freelance work while I’m away. I think they won’t mind me hammering out a few thousand words for you guys though, just so long as I’m not doing work for their competitors.

Thanks man. I think it's a pretty fair price too. I'd never usually work for so little, but this is a community, plus I love the idea of Bitcoin. I'd be surprised to see myself doing volume here anyway, it's just for a little Bitcoin pocket money.

I should probably also mention that I won't be cashing out whatever Bitcoins I may get paid to fiat, I'll be spending them. They'll stay in the economy for one more transaction at least. Smiley

You're a disgusting little cunt and I'm glad you've got even a tiny portion of what's coming for you. Your buddy Sabu hit the FBI. Do you know what that means? He's going to get caught. As soon as they catch him, the American's are going to try and extradite you under RICO laws. You've been seen on IRC handling their money and the Blockchain will confirm this. Under RICO legislation, that's enough to make you complicit.

You better hope and pray that the Dutch government doesn't roll over and extradite you. Either way you've got a tough autumn and winter coming up. You've bitten off more than you can chew here, son. I'd be very, very scared if I was you.

Do you actually have downs syndrome or what? Classic. Good luck getting your money back on the 12th, you fucking dumbass. When will you people learn that Bitcoins can be stolen with complete impunity? No government in the world recognizes them as a currency, a commodity, or a financial instrument of any kind. Why on earth do you expect a government law enforcement agency to step in when you are dumb enough to be scammed out of your coins?

(...)

Stealing Bitcoin isn't a crime. You wanted a currency that exists outside of governmental systems, and now you've got one. Stop crying to the police when people steal them from you. It's YOUR responsibility to protect your coins. If you are too fucking stupid to do that, and you can't help yourself from just handing them to anyone who asks, then you shouldn't be involved in Bitcoin in the first place.

To everyone who lost coins in various Ponzi schemes: I am glad you had your money taken from you. You would only have spent it unwisely. I hope that you have been left at such a severe financial disadvantage that you are unable to look after your children and they are taken from you by the state so they can be looked after by people with better critical faculties than your own. If you don't yet have children, I hope that the financial loss leaves you stinking and in rags so you are unable to reproduce. Your genes should not be passed on to humanity.

https://bitcointalk.org/index.php?topic=96163.msg1248808#msg1248808

Honestly, any sane person would tell you to fuck off. And I like Bitcoin, I think it is a neat idea, a fun gamble, and I currently hold roughly 5000 of them, but do you have any idea how stupid it sounds to everyone else in the entire world? And you want to phone up some guys parents and tell them that their son stole $25k worth of meaningless (to them), thin air Autism kroners?

If you think any regular person is going to take that phone call seriously, think again.

If something is intangible, non-physical, has no practical use, is unrecognized as a real thing by a court of law, can only be sold to a very small pool of people, and isn't money, then most people would have no problem writing it off as nothing of value. For a lot of people it would be written off as nothing at all, just incomprehensible nonsense.

(...)

I don't condone scamming, but c'mon, this is Bitcoin. It's the wild west of currency. People need to learn that they can't run to the government to help them when they lose their coins. But people CAN run to the government if someone tries to be violent, harass someone's family, or otherwise apply that same lawlessness to another situation. If you lose your coins, they are gone. That is Bitcoin. That is the whole point of Bitcoin. If you want government protection, there are lots of government backed currencies. Why not use one of them?

If you had learned a hard lesson I would feel sorry for you and I certainly wouldn't be rubbing it in, but your complete lack of contriteness shows you haven't learned a thing. I'm not mocking you because you were dumb enough to be scammed. I am mocking you because you are so dumb that you don't seem willing or able to analyze that situation, realize where you went wrong, and learn from the experience. I don't just think you are stupid, I am blown away by your staggering inability to think. 1408  Economy / Securities / Re: GLBSE Payment Claims (Announce your payment here) on: November 03, 2012, 12:48:01 PM
[Maybe you feel better when you take a look at the first (updated) post of this thread if you didnt do already. It means that already 17% of the usermoney (if it was 8000BTC in total) was returned yet. So something is moving.

Only 17% is REPORTED in this thread, but I'm sure the whole 90% was returned.

There were 8762 BTC returned in two chains: 5000 BTC and 3762 BTC.
The last 1000 BTC of the latter was mistakenly distributed as double payments.

As you see, Nefario supposedly returned near all BTC of users, but the last 1000 BTC which went to improper people.
So part of the people (~1/9) still got nothing, but they should get their money soon, when most of the 1000 BTC is paid back and Nefario send it again, with proper addresses this time.

Just because you recognize a chain of payment it does not mean every fork is a payment for GLBSE users. You are speculating over the expectation that all GLBSE users have being paid in every fork with no evidence whatsoever.

If you verify the taint analysis of few payments declared in this thread, you will realize that such payments does not come from a payment chain.
1409  Other / Meta / Re: [To Theymos] Why was Goat banned? on: November 02, 2012, 01:52:48 AM
The timing is legitimate evidence.  The arguing for long term problems for the users is undercut when these so called long-term problems are only handled immediately after criticizing Theymos on GLBSE.  You ignore this, and the only evidence you will consider is the words of the very same administrators who are being questioned.  Of course they are going to deny wrong doing, but the timing doesn't support their claims.

So, where is the evidence? Present the posts with the time-stamp and I will discuss the matter. Your assumption is not evidence.

If repeating bad arguments over and over and not listening to the points of the other side is bannable, augustocroppo should have been gone a long time ago.  He argues for Theymos instead of against him though, so it isn't a problem.

Ignoratio Elenchi.

Quote
Ignoratio Elenchi, according to Aristotle, is a fallacy which arises from “ignorance of the nature of refutation.” In order to refute an assertion, Aristotle says we must prove its contradictory; the proof, consequently, of a proposition which stood in any other relation than that to the original, would be an ignoratio elenchi… For instance, instead of proving that ‘this person has committed an atrocious fraud,’ you prove that ‘this fraud he is accused of is atrocious;’” … The nature of the fallacy, then, consists in substituting for a certain issue another which is more or less closely related to it, and arguing the substituted issue.

The subject in discussion is about Goat's banishment, not what you fictionally assume about my character.

Do your own research if you want to read the posts where he took issue with Theymos.

I do my own research:

I decided that he harms discussions too much to be allowed to continue. He posts more than Atlas and his posts are of lower quality. When he argues about something, he ignores all of the arguments of his opponents and just repeats the same nonsense over and over. I suspect that he may be intentionally trying to stir up drama in order to hurt the forum and the community.

The ban will not expire automatically. I may review it later.

Goat's gone off the deep end lately, you can't reason with him at all. Warnings won't work he'll just troll about that too.

He needed a break from the forums.

So, where is your evidence which demonstrates that the user Goat was banned solely because he/she criticized Theymos? You just have fallacious assumptions like this?

Well he didn't get banned before he criticized Theymos on the forums, did he?

Because event A did not happened, it not means event B happened.
1412  Other / Meta / Re: [To Theymos] Why was Goat banned? on: November 01, 2012, 10:46:48 PM

No one is expecting you to know everything, but when you assume you know more than someone else and you are wrong, well....

...you know what they say about what happens when you assume. You make yourself look like a bit of a cunt.  Wink

That is true. So why was he only banned when he criticized Theymos, and not before? I admit that he became more vexing recently, but it's a rather rum coincidence that his behavior was suddenly deemed to be intolerable as soon as he began to take issue with the personal dealings of Theymos, isn't it? Especially as this has happened a few times recently.

How do you know that? Which evidence you have to prove that Goat was banned only when he/she criticized Theymos?

You had put yourself in a very fragile position in this board with the above offensive post.

I recommend you to find evidence to support your assumptions.

So if someone in power has not been democratically elected they can and should be free to do whatever they want, no matter how unfair or corrupt it is?

If is not detrimental for the matters which they represent, yes.

With that kind of mindset I wonder why you are even involved in the Bitcoin project.

I am not yet involved in any project related to Bitcoin. I am only a participant of this forum.

So there is no reason to wondering.

I think if a man owns a house he should be able to do anything he wants in it. But Theymos does not own this house. He is merely looking after it for the benefit of us who live in it.

This is not a house and the participants of this board do not live here.

This forum is the heart of Bitcoin discourse. It has been since the very beginning of the Bitcoin project. It's not just some private forum that Theymos started.

That does not mean the forum administrators have any obligation to agree with the demands of Bitcoins users.

I don't have a problem with forum rules. Spammers, scammers and anarchy makes for shitty discussions. The problem is that the rules don't seem to be enforced in a consistent, impersonal and impartial way. If rules suddenly become more strictly enforced when the person who breaks them criticizes the private business practices of the administrator, then we have an unfair situation, wouldn't you agree?

No, I would not.

Moreover, no user has been banned due criticism against Theymos. This has already been explained by the administrators and moderators.

This forum is important to the Bitcoin community. It does not belong to Theymos, he is merely the caretaker. He did not create it, he does not own it, it was entrusted to him for the good of the community. He should be held accountable for his actions, for the good of the community. If he continues to impose an iron rule on those who criticize his private business activities, he should be ousted. For the good of the community.

To just allow this to stand is to risk damaging Bitcoin.

This is a private forum. There is no such thing of "community". Theymos was not elected, he was appointed. Therefore, he is entitled to ban whoever he deem necessary to protect his position and the private matters of this board. If you cannot cope with such harsh reality, here is not an appropriate place to you. You are free to leave at any time. But if you are willing to participate in this board, you have to abide with the rules and with who rules.

Quoted for future reference at 29 October 2012, six weeks after the original date of this post:

Have you considered that you may be (knowingly or not) be furthering a scam?

Yes, and either the scam is so elaborate that we have shipped product and spent a ridiculous amount of money on the development of ASICs as to be almost unimaginable or we are actually legitimate.

Quote
Can you provide any convincing argument to the contrary?

Yes, check back with me in about 6 weeks.

Quote
I pause to note that this should be trivially easy if ASICs are anywhere close to being shipped..

They are, however, you seem to be under the impression that the investment in this venture is trivial.  It's not.  We will not be giving away free strategic information to our competition as to our business plans, technology, etc...  As much as you want it (and the competition wants it), it's simply not going to happen given the amounts of money involved in the development of our ASIC products.

Quote
If any of the whiny allegations are unfounded, you are hereby cordially encouraged to demonstrate it by directly confronting them.

Again, I will in ~6 weeks.  When we ship the ASICs can I expect a public apology from you as well in these forums or are you going to slink off with the rest of the people and try to forget what complete asses you've been?

Quote
Use this opportunity to crush the "crying whiners" under the heavy heel of the truth!

Then we can stop shouting, go about our business, and everyone will be happy for it.

Do you seriously believe this?  There is literally nothing, nothing I can post short of shipping out free ASIC devices that would satisfy the people of this forum.  Not a single thing.  If you believe otherwise, you are exceptionally deluded.

As it stands, I think you are lying, or being lied to, or some combination thereof.

Come clean.

Great, come the shipping of the ASICs I expect a public written apology to both myself and BFL.

Rarity is not exactly working alone. A brief read of her/his past posts show that Rarity represent the agenda of a well know religious organization: The Church of Scientology.

The user could not conceal his true purpose in this forum board. Signs of fanaticism are evident in the responses granted by Rarity in his/her past posts. Among this countless posts, two links for Internet pages managed by The Church of Scientology:

I am not talking about sex addiction. I am talking about loving someone (being addicted to them) so much that you go into a fit of rage when they do something you do not like.

I must inform you at this point that if you tell me you are abusing your partner I will be seeking to report you to the relavent authorities.

I'm going to be afk for a few hours before I can resume this conversation, anyone that is facing challenges with drug issues should check out this site:

I understand it can sound wrong to say some should give up their wealth to benefit others, or that it should be taken against their will through taxes, but this is really about self-benefit for everyone.  Doing the right thing can be good for us as individuals:

"Like ethics and justice, good and evil have long been subject to opinion, confusion and obfuscation...it must be understood that good can be considered to be a constructive survival action. It is something that, to put it simply, is more beneficial than destructive across the dynamics. True, nothing is completely good, and to build anew often requires a degree of destruction. But if the constructive outweighs the destructive, i.e., if a greater number of dynamics are helped than harmed, then an action can be considered good. Thus, for example, a new cure which saves a hundred lives but kills only one is an acceptable cure."

Narconon is very energetic in publicising its claims and, over the years, it has managed to persuade a number of state and national governments to fund its activities. Founded in 1966, the modern Narconon programme is the work of the late L. Ron Hubbard, the science fiction author and founder of the Church of Scientology. It combines what might be termed his moral philosophy with his theories on the nature of drug addiction and his solutions to the problem, providing a mixture of educational and therapeutic activities.

The most interesting fact is that the user Rarity already admitted many times to come from Clearwater, Florida:

Scientology's town

As Scientologists launch unprecedented expansion, downtown Clearwater's identity is at stake. A two-part special report

By ROBERT FARLEY
Published July 18, 2004

CLEARWATER - The room is packed with computer consultants, real estate agents, home financing professionals, Web site designers, accountants, hairstylists, artists, interior designers.

All based in Clearwater. All Scientologists.

Guest speaker Mark DeEulio bursts in.

"How are you doing?" he booms.

"Great!" comes an enthusiastic chorus.

"Who could use more money?" DeEulio teases.

Without pause, he launches into the basics of financial planning - as taught by Scientology founder L. Ron Hubbard.

It is the weekly meeting of the Clearwater chapter of the World Institute of Scientology Enterprises, business people using Hubbard's business techniques. Akin to a chamber of commerce for Scientologists, WISE members network, recruit employees, share business tips and hear lectures on topics such as marketing.

CLEARWATER, FLORIDA: THE TOWN SCIENTOLOGY BOUGHT

Posted by RB on March 23, 2008 · 14 Comments

Decades ago, L. Ron Hubbard moved his Cult of Scientology into Clearwater, Florida. The plan, entitled Project Normandy, was to take over Clearwater. Documentation of this comprehensive operation – which included plans to infiltrate government and media organizations, and to identify and “handle” enemies – was discovered in a 1977 FBI raid of Scientology headquarters.
Despite the discovery of Project Normandy, the cult has achieved notable success in carrying out this project. The cult has come to own a very generous proportion of the city, with the total value of owned property estimated at $40 million in 2000. Given the cult’s ambition to continue to expansion in Clearwater, I would be interested in knowing how much land they control now, 8 years later. Some have come to call Clearwater Scientology’s town.

You can't make longterm predictions of which groups you may need to extract social benefit from later or how one group interacting with a group you do need may change their perceptions of you.  Sometimes a group you had no idea you might be doing business with will end up as one of your main customers, witness the success of the television program "My Little Pony - Friendship is Magic" with a periphery demographic.

When the only downside is some nebulous concept of not "keeping it real", it's better to play it safe.

Never been to Iowa.  In London at the moment, grew up in Clearwater, Florida.  Why do you think I sound homeschooled?  My parents are gonna be pissed they wasted all that money on private schools.

Google hosted its Pwnium 2 competition at Hack in the Box 2012 in Kuala Lumpur yesterday. The winner, Pinkie Pie, went home with a $60,000 prize and a free Chromebook. Pie, incidentally had also won $60,000 in the first Pwnium competition held earlier this year. The bug that Pie had discovered relies on a WebKit Scalable Vector Graphics (SVG) compromise to exploit the renderer process. This time, he found a bug in the IPC layer to escape the Chrome sandbox.
