blah

We are not hear to help you define your dumbass legal challenge to our own investment MyFarm lol.  From how you write about it you have the legal mind of a potato because owning a coin confers zero legal rights, give it a rest mate.

I think that's a little harsh BlockaFett. It's an understandable response to MyFarm, but he clearly has a far greater handle on legal issues than a potato! (obviously)

His points are important and his take on the situation is worthy of discussion. My concern (and by now most other DRK/DASH community members' concern) is whether his potential to use his possible Dashcoin >51% position to somehow set up a legal precedent against DRK/DASH has any legs (and furthermore is of obvious dubious moral value). I agree his line of thinking (coin holders have as much right to the IP as the original dev) is way out there and not likely to be taken too seriously but, this discussion is an important one and needs to be had (even though there's potentially more uncertainty being raised we have to get past it).

What you guys really need to understand is it is not me you should be worried about.  It is the deep-pocketed company that Darkcoin has royally pissed off that you should be concerned about.

I have a stake in Darkcoin.  I don't have a stake in that company.

Is my argument out of line?  Maybe.  But that doesn't mean the argument couldn't work its way through the courts for YEARS because of the amateur way Darkcoin has handled this situation.  What happens if the opposing company fights this?  And make no mistake.  They will.

no one is worried mate, you are someone who has basic law real confused and thinks if you buy 51% of dashcoin you can ransom the rebranded DRK.  But coins are not incorporated, ownership of % of a supply conveys zero rights.  Plus DRK is a top 5 coin and you think if there was any opportunity here they wouldn't have bought the supply?  Like another user said, DRK now owns dashcoin codebase, they can do whatever they want to the supply if they have to - Duh!!! Hmmm.  So the bitcoin trademark is less than 1 million dollars?  How about I use my capital in a positive way, purchase the bitcoin trademark, and we rename Darkcoin to Bitcoin, send a cease and desist to all bitcoin holders/exchanges/companies and this entire argument is moot?

And just because some high profile lawyers deemed something to be so doesn't mean it is.  There has been no case law.  No case law means no legal precedent.  And this case isn't exactly like the bitcoin case.  There are some very important differences.

My farm you can't cease and desist people who bought property to stop using their property that's called property law!  You are thinking of incorporated companies with shares and confused. Stop using legal terms if you don't have the first clue how they apply in law!

You may want to read this: http://arstechnica.com/business/2014/01/kanye-wests-lawyer-orders-coinye-to-cease-and-desist-just-before-launch/

Nice to see the cow moo'ing again!!! Specially after all the discussion.

16:16 <@gitcow> [ darkcoin | master | Evan Duffield | 2 days, 10 hours, 5 minutes ago ] bb7672f Complete implementation of Proof-of-Service (not debugged)

https://github.com/darkcoin/darkcoin/commit/bb7672fb0f6d5d57475b250f633bd2cebe6c3e10

So what is PoSvc, well it checks:

1.) Making sure Masternodes have their ports open
2.) Are responding to requests made by the network

Interesting future expansion: Want to be able to prove nodes have many qualities such as a specific CPU speed, bandwidth, and dedicated storage.
E.g. We could require a full node be a computer running 2GHz with 10GB of space.

This makes me very excited to think about the future of the Masternode network. A time in the future when this PoSvc code could detect a masternode offering VPN services, storage services, really anything that can live on top of a VPS.

It also got me to thinking. For this type of future expansion shouldn't we be starting to think about how we could solve the need for remote ip's. I was almost envisioning turning our publicly published remote ip into an nginx reverse proxy that could proxy all types of "external" requests to the internal network of mn's. Sort of like how when given a subnet you are given a routing address that all your ip's need to leave from.

Now this is a far from finished thought but could that give us the ability to have perhaps two at the most unqiue ip's per masternode cluster. Perhaps that would be a better way, is let each MN publish two (four) for load balancing or DDOS. Then you could use a type of pfsync almost to keep traffic in sync and load balance.

Any other networking guys care to take it from here or point out the total mis-understanding as to why this wouldn't work?

You are proving how confused you are...Kanye owns that brand already, so someone trying to sell property under that brand is doing so illegally and the propery is not legally owned.  Totally different in this case where Evan is now the original owner of the dash brand, this does not affect legal property status of the dashcoin owners, they can still legally trade dashcoins.  Trademark law vs property law - seriously please stop digging the hole bigger!  Roll Eyes

lol this is hilarious

dude comes up with possible case for trademark infringement

buys up what possibly is the biggest bag in crypto history

comes here to derail rebranding

I'd like to thank eduffield and the other developers for this critically important evolution in virtual currency. DarkCoin is what bitcoin should have been. Some might call it "Bitcoin 2.0" but would do better by saying: "DarkCoin is digital cash."  -  Child Harold - February 28, 2014

Adam is truly worn-out with all this arduous FUDing of this and many other threads. He gets very little sleep and it's a 24/7 undertaking. In his FUD-Central command centre he has multiple monitors setup that track multiple BCT threads. Bleary eyed, he pours over them looking for tid-bits he can latch onto. It's exhausting and repetitive work. We need to have some sense of the challenges involved. It's very hard for anyone of us to keep up with what's going on here. Is it any wonder then that he just keeps writing the same mindless BS? You're being way too hard on him Tok, expecting him to be on time for his appointments. With all that's going on he doesn't go to bed until 4am each night/morning, so 7am appearance is difficult. Life of a troll - not something you'd wish on your worst enemy!

The wally's missed all the action - only about 50 pages have passed by where he could have been capturing valuable acraege of "instamine, dev's got x-zillion coins, we're all going to hell" instructional commentary in.

Good luck with your taking advantage of those in vulnerable situations it must be great for your spirit.

At present, the only vulnerable people who are being taken advantage of are the Dashcoin holders who should have been compensated.  In my opinion, the next most vulnerable people are Darkcoin holders because of how this has all gone down.  Allow me to summarize how I see this proceeding:

1.  The opposing company gets the trademark contesting notice.

2.  They sit around and ask, "What the fuck is a Darkcoin and Dashcoin" and start to do their research.  Once they get a feel for what is going on...

3.  Their attorneys get giant boners and start to pick out new vacation homes.

4.  The most seasoned executives get big smiles.

5.  They wait for the Darkcoin to Dashcoin branding to happen later this month so that Darkcoin is caught in a corner.

6.  They then begin the fight knowing that they have far deeper pockets and the Darkcoin argument is somewhat dubious.  As there is no legal precedent in a case like this (that I'm aware of), they know that a case like this is going to be long and protracted.  They know they don't even necessarily have to win, they just have to prolong the fuck out of it so the Darkcoin fanbase gets tired of, "Will you guys please just donate 10 more DRK each to the legal fund?" posts.

7.  They realize eventually there will likely be a settlement that doesn't even set legal precedent but it benefits them.  Does Darkcoin get to be Dash?  Maybe, maybe not.  But the settlement will be much bigger if yes.

Or Darkcoin could have properly acquired Dashcoin for likely less than $25,000 in Darkcoin.  And this is why Darkcoin needs a seasoned executive on board.  Because without one, the Darkcoin base is vulnerable.

Now remind me again how I'm taking advantage of vulnerable people?

you keep not understanding the basics here.  There is no fight, because no one who bought or mined a dashcoin from the dashcoin trademark owner has any claim on the dashcoin trademark.  The mark owner does who is Evan Duffield.

Like if you bought half the world supply of Big Mac's and then decide to rename them BigFarms, you can't cease and desist McDonalds from using the BigMac name under trademark law

Saying 'yes you can because there is no legal precedent' - you don't understand legal precedents then too
