Wouldn't someone have to break a contract and have no intention to pay to be considered a scammer? Has there been a contract broken? Is there implied intention to pay?
Yes. I know you have a lax understanding of what a deadline is, but Pirate failed to repay bitlane on time and then again on his second self-given deadline. That's a broken contract already, regardless of possible future mitigation. Then he proceeded to add insult to injury with his messages. Just me spreading FUD but: Im going to call it, at least one of the admins are involved with pirate and want to give him as much time as possible to wind up his scam. I want one extra condition placed on this gambling: if it's discovered that Matthew is helping Pirate pay back the money in any way, it will not count as Pirate paying back the money and Matthew be declared the loser.
Screw that I'm sure pirate's investors will be very happy if matthew helps pirate pay them back. I'm all for the investors being paid back, but not out of the pockets of the people betting against Matthew; it would also be a way for Pirate to keep the money, repair his good name at no cost and run the scam again. How could anyone be paid back from my pockets? I don't get any money unless he pays everyone back.

I just had a really f'ed up thought: Bitcoin cannot be seized... If I was in pirateat40's place, I would keep that entire 500k BTC in Bitcoin, then just before defaulting move it to a brain wallet address. Then I would just let things play out, get arrested, and go to jail. 7 years or so later, if ,VERY conservatively, Bitcoin triples in price, I'm out of jail with $15,000,000 in my account, and can retire. A few years in prison isn't too bad for making that much money that fast.
Talk about long on bitcoin...

That said, just because we don't know what's happening doesn't mean it is a scam with 100% certainty, and accusations should be made accordingly. , Ok, so if we find out this was a ponzi with 100% certainty, do you think all the FUD being spread was unwarranted? Considering it hit all the red flags (which is the only way to detect a ponzi, and as far as I know there are no examples of legit businesses hitting them like that) and considering what's at stake? Do you also scold people who passionately warn others to encrypt their wallets, backup private keys, and maintain control of their own BTC? I mean, you don't know for sure they're going to get hacked or have a hard drive crash, after all. Its hard to tell fanatical religious extremists that God might not exist simply because there is no way to prove otherwise. Matthew is seemingly running a campaign against fanaticism. There is only one company at this point that could be interested in this tale, Bitcoin Magazine. Very good move for them in fact, it'll increase readership significantly, at lest for that one issue. Either Matt has full story and knows how is it going to end so this bet is easy 10k BTC win for him, or he's been played by Pirate to push his plan further, Pirate won't pay and Matt is going to lose his coins or face.
So, this would be fraud by the magazine, matt, and the people "in the know". If what you suggest is the true. This wont end well either way. This kind of risk has to be factored in, but 10K BTC or whatever Bitcoin Magazine can pay Pirate makes very little difference considering the astronomical figures Pirate owes. Maybe someone has a decent estimate, but it's several hundred thousands and 10, 20 or 30K would be a small % of that. Or do you honestly think anyone values this potential article for millions of dollars? Fact: Bitcoin Magazine has nothing to do with this private wager between me and the general public. Fact: This is not a publicity scheme thought up by Bitcoin Magazine. In fact, many individuals in Bitcoin Magazine are reportedly pissed I even did this. If this is true then I respect you for it.
