Yes They sold off all the Dash and Eth and other coins with value to make up for the BTC / LTC losses at least that's what I read in the story their trying to sell.

There are cases when negligence is criminal. Whether Cryptsy's negligence was criminal I don't know but if reasonable precautions could have been made and standard practices weren't followed then I think it should be criminal.
